Making emergency supplemental appropriations to respond 
to the attacks in Israel for the fiscal year ending Sep-
tember 30, 2024, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
That the following sums are appropriated, out of any 3
money in the Treasury not otherwise appropriated, for the 4
fiscal year ending September 30, 2024, and for other pur-5
poses, namely: 6

For an additional amount for ‘‘Operation and Main-5
tenance, Defense-Wide’’, $5,035,750,000, to remain avail-6
able until September 30, 2024, to respond to the attacks 7
in Israel: Provided, That of the total amount provided 8
under this heading in this Act, $4,400,000,000, to remain 9
available until September 30, 2025, may be transferred 10
to accounts under the headings ‘‘Operation and Mainte-11
nance’’ and ‘‘Procurement’’ for replacement of defense ar-12
ticles from the stocks of the Department of Defense, and 13
for reimbursement for defense services of the Department 14
of Defense and military education and training, provided 15
to Israel or identified and notified to Congress for provi-16
sion to Israel: Provided further, That funds transferred 17
pursuant to the previous proviso shall be merged with and 18
available for the same purposes and for the same time pe-19
riod as the appropriations to which the funds are trans-20
ferred: Provided further, That the Secretary of Defense 21
shall notify the congressional defense committees of the 22
details of such transfers not less than 15 days before any 23
such transfer: Provided further, That upon a determina-24
tion that all or part of the funds transferred from this 25

until September 30, 2026, shall be for the Secretary of 17
Defense to provide to the Government of Israel for the 18
procurement of the Iron Dome, David’s Sling, and Iron 19
Beam defense systems to counter short-range rocket 20
threats: Provided further, That such funds shall be trans-21
ferred pursuant to an exchange of letters and are in addi-22
tion to funds provided pursuant to the U.S.-Israel Iron 23
Dome Procurement Agreement, as amended: Provided fur-24
ther, That nothing under this heading shall be construed 25

EC. 101. Section 12001 of the Department of De-22
fense Appropriations Act, 2005 (Public Law 108–287), as 23
amended by Public Law 115–141, is further amended as 24
follows: 25

(1) In paragraph (2) of subsection (a), by strik-1
ing ‘‘armor’’ and all that follows through the end of 2
the paragraph and inserting ‘‘defense articles that 3
are in the inventory of the Department of Defense 4
as of the date of transfer, are intended for use as 5
reserve stocks for Israel, and are located in a stock-6
pile for Israel as of the date of transfer.’’. 7
(2) In subsection (b), by striking ‘‘at least 8
equal to the fair market value of the items trans-9
ferred’’ and inserting ‘‘in an amount to be deter-10
mined by the Secretary of Defense’’. 11
(3) In subsection (c), by striking ‘‘30 days’’ and 12
inserting ‘‘15 days’’, and by inserting ‘‘Appropria-13
tions,’’ after ‘‘Committees on’’ in each place it ap-14
pears. 15

EC. 102. During fiscal year 2024, section 514(b) of 16
the Foreign Assistance Act of 1961 (22 U.S.C. 2321h(b)) 17
shall not apply to defense articles to be set aside, ear-18
marked, reserved, or intended for use as reserve stocks 19
in stockpiles in the State of Israel. 20

EC. 103. Not later than 30 days after the date of 21
enactment of this Act, and every 30 days thereafter 22
through fiscal year 2025, the Secretary of Defense, in co-23
ordination with the Secretary of State, shall provide a 24
written report to the Committees on Appropriations, 25

scribing United States security assistance provided to 4
Israel since the October 7, 2023, terrorist attack on Israel, 5
including a comprehensive list of the defense articles and 6
services provided to Israel and the associated authority 7
and funding used to provide such articles and services: 8
Provided, That such report shall be submitted in unclassi-9
fied form, but may be accompanied by a classified annex. 10

EC. 104. Concurrent with any notification of assist-11
ance made pursuant to section 506(b)(1) of the Foreign 12
Assistance Act of 1961 (22 U.S.C. 2318(b)(1)), the Sec-13
retary of Defense shall submit a written notification to 14
the congressional defense committees that contains a de-15
scription of the defense articles and defense services to 16
be furnished, including the quantity, approximate value, 17
and an estimate of the cost to replace such article or an 18
equivalent capability, and a timeline for the delivery of 19
such defense articles and defense services. 20

designated by the Congress as an emergency requirement 3

INTERNATIONAL SECURITY ASSISTANCE 6

FOREIGN MILITARY FINANCING PROGRAM 8
For an additional amount for ‘‘Foreign Military Fi-9
nancing Program’’, $3,500,000,000, to remain available 10
until September 30, 2025, to respond to the attacks in 11
Israel: Provided, That funds made available under this 12
heading in this Act and prior Acts making appropriations 13
for the Department of State, foreign operations, and re-14
lated programs for fiscal year 2024, in addition to funds 15
otherwise available for such purposes, may be used by the 16
Department of State for necessary expenses for the gen-17
eral costs of administering military assistance and sales, 18
including management and oversight of such programs 19
and activities: Provided further, That, to the extent that 20
the Government of Israel requests that funds be used for 21
such purposes, grants made available for Israel under this 22
heading shall, as agreed by the United States and Israel, 23
be available for advanced weapons systems, of which up 24
to $3,500,000,000 may be available for the procurement 25

further, That any congressional notification requirement 2
applicable to funds made available under this heading for 3
Israel may be waived if a determination is made that ex-4
traordinary circumstances exist that impact the national 5
security of the United States: Provided further, That such 6
amount is designated by the Congress as an emergency 7
requirement pursuant to section 251(b)(2)(A)(i) of the 8
Balanced Budget and Emergency Deficit Control Act of 9
1985. 10
GENERAL PROVISIONS—THIS TITLE 11

EC. 201. (a) During fiscal year 2024, and subject 12
to subsection (b), section 506(a)(1) of the Foreign Assist-13
ance Act of 1961 (22 U.S.C. 2318(a)(1)) shall be applied 14
by substituting ‘‘$2,500,000,000’’ for ‘‘$100,000,000’’. 15
(b) Subsection (a) shall not take effect unless the 16
Secretary of State determines and reports to the appro-17
priate congressional committees that the exercise of the 18
authority of such subsection is necessary to respond to the 19
situation in Israel. 20

EC. 202. Not later than 30 days after the date of 21
enactment of this Act, the Secretary of State shall submit 22
to the Committees on Appropriations a report on the pro-23
posed uses of funds appropriated by this title to respond 24
to the situation in Israel: Provided, That such report shall 25

TITLE III 7
GENERAL PROVISIONS—THIS ACT 8

EC. 301. Each amount appropriated or made avail-9
able by this Act is in addition to amounts otherwise appro-10
priated for the fiscal year involved. 11
S
EC. 302. No part of any appropriation contained in 12
this Act shall remain available for obligation beyond the 13
current fiscal year unless expressly so provided herein. 14
S
EC. 303. Unless otherwise provided for by this Act, 15
the additional amounts appropriated by this Act to appro-16
priations accounts shall be available under the authorities 17
and conditions applicable to such appropriations accounts 18
for fiscal year 2024. 19

EC. 304. Each amount designated in this Act by the 20
Congress as an emergency requirement pursuant to sec-21
tion 251(b)(2)(A)(i) of the Balanced Budget and Emer-22
gency Deficit Control Act of 1985 shall be available (or 23
rescinded or transferred, if applicable) only if the Presi-24

EC. 305. Any amount appropriated by this Act, des-3
ignated by the Congress as an emergency requirement 4
pursuant to section 251(b)(2)(A)(i) of the Balanced Budg-5
et and Emergency Deficit Control Act of 1985 and subse-6
quently so designated by the President, and transferred 7
pursuant to transfer authorities provided by this Act shall 8
retain such designation. 9
This Act may be cited as the ‘‘Israel Security Supple-10
mental Appropriations Act, 2024’’. 11
