5050 The purposes of this Act are— 2
5151 (1) to achieve a fair, equitable, and final settle-3
5252 ment of claims to water rights in the State of Mon-4

118118 nized Indian Tribal entity included on the list pub-16
119119 lished by the Secretary pursuant to section 104(a) 17
120120 of the Federally Recognized Indian Tribe List Act of 18

351351 cludes the Secretary from approving any modifica-2
352352 tion to an appendix to the Compact that is con-3
353353 sistent with this Act, to the extent that the modifica-4
354354 tion does not otherwise require congressional ap-5
355355 proval under section 2116 of the Revised Statutes 6
356356 (25 U.S.C. 177) or any other applicable provision of 7
357357 Federal law. 8
358358 (c) E
359359 NVIRONMENTAL COMPLIANCE.— 9
360360 (1) I
361361 N GENERAL.—In implementing the Com-10
362362 pact and this Act, the Secretary shall comply with 11
363363 all applicable provisions of— 12
364364 (A) the Endangered Species Act of 1973 13
365365 (16 U.S.C. 1531 et seq.); 14
366366 (B) the National Environmental Policy Act 15
367367 of 1969 (42 U.S.C. 4321 et seq.), including the 16
368368 implementing regulations of that Act; and 17
369369 (C) other applicable Federal environmental 18
370370 laws and regulations. 19
371371 (2) C
372372 OMPLIANCE.— 20
373373 (A) I
374374 N GENERAL.—In implementing the 21
375375 Compact and this Act, the Fort Belknap Indian 22
376376 Community shall prepare any necessary envi-23
377377 ronmental documents, except for any environ-24

386386 Act of 1969 (42 U.S.C. 4231 et seq.), in-6
387387 cluding the implementing regulations of 7

392392 UTHORIZATIONS.—The Secretary 11
393393 shall— 12
394394 (i) independently evaluate the docu-13
395395 mentation submitted under subparagraph 14
396396 (A); and 15
397397 (ii) be responsible for the accuracy, 16
398398 scope, and contents of that documentation. 17
399399 (3) E
400400 FFECT OF EXECUTION .—The execution of 18
401401 the Compact by the Secretary under this section 19
402402 shall not constitute a major Federal action for pur-20
403403 poses of the National Environmental Policy Act of 21
404404 1969 (42 U.S.C. 4321 et seq.). 22
405405 (4) C
406406 OSTS.—Any costs associated with the per-23
407407 formance of the compliance activities described in 24
408408 paragraph (2) shall be paid from funds deposited in 25

416416 shall remain the responsibility of the Secretary. 5
417417 SEC. 5. TRIBAL WATER RIGHTS. 6

419419 ONFIRMATION OFTRIBALWATERRIGHTS.— 7

421421 N GENERAL.—The Tribal water rights are 8
422422 ratified, confirmed, and declared to be valid. 9
423423 (2) U
424424 SE.—Any use of the Tribal water rights 10
425425 shall be subject to the terms and conditions of the 11
426426 Compact and this Act. 12
427427 (3) C
428428 ONFLICT.—In the event of a conflict be-13
429429 tween the Compact and this Act, this Act shall con-14
430430 trol. 15
431431 (b) I
432432 NTENT OFCONGRESS.—It is the intent of Con-16
433433 gress to provide to each allottee benefits that are equiva-17
434434 lent to, or exceed, the benefits the allottees possess on the 18
435435 day before the date of enactment of this Act, taking into 19
436436 consideration— 20
437437 (1) the potential risks, cost, and time delay as-21
438438 sociated with litigation that would be resolved by the 22
439439 Compact and this Act; 23
440440 (2) the availability of funding under this Act 24
441441 and from other sources; 25

452452 RUSTSTATUS OFTRIBALWATERRIGHTS.— 7
453453 The Tribal water rights— 8
454454 (1) shall be held in trust by the United States 9
455455 for the use and benefit of the Fort Belknap Indian 10
456456 Community and allottees in accordance with this 11
457457 Act; and 12
458458 (2) shall not be subject to loss through non-use, 13
459459 forfeiture, or abandonment. 14

23832383 Mary Canal and appurtenances to convey 850 16
23842384 cubic-feet per second; and 17
23852385 (B) rehabilitating, constructing, and re-18
23862386 pairing of the St. Mary Canal and appur-19

23882388 (2) in cooperation with the State and the Fort 21

29642964 drawn, or reverted to the general fund of the Treasury, 12
29652965 consisting of the amounts deposited in the Trust Fund 13
29662966 under subsection (c), together with any investment earn-14
29672967 ings, including interest, earned on those amounts, for the 15
29682968 purpose of carrying out this Act. 16
