79	79	LLOTTEE.—The term ‘‘allottee’’ means an 10
80	80	individual who holds a beneficial real property inter-11
81	81	est in an allotment of Indian land that is— 12
82	82	(A) located within the Reservation; and 13
83	83	(B) held in trust by the United States. 14

85	85	LACKFEET TRIBE.—The term ‘‘Blackfeet 15
86	86	Tribe’’ means the Blackfeet Tribe of the Blackfeet 16
87	87	Indian Reservation of Montana. 17

118	118	nized Indian Tribal entity included on the list pub-16
119	119	lished by the Secretary pursuant to section 104(a) 17
120	120	of the Federally Recognized Indian Tribe List Act of 18

338	338	the Compact consistent with this Act. 18

343	343	pact does not conflict with this Act, the Secretary 21
344	344	shall execute the Compact, including all appendices 22

351	351	cludes the Secretary from approving any modifica-2
352	352	tion to an appendix to the Compact that is con-3
353	353	sistent with this Act, to the extent that the modifica-4
354	354	tion does not otherwise require congressional ap-5
355	355	proval under section 2116 of the Revised Statutes 6
356	356	(25 U.S.C. 177) or any other applicable provision of 7
357	357	Federal law. 8
358	358	(c) E
359	359	NVIRONMENTAL COMPLIANCE.— 9
360	360	(1) I
361	361	N GENERAL.—In implementing the Com-10
362	362	pact and this Act, the Secretary shall comply with 11
363	363	all applicable provisions of— 12
364	364	(A) the Endangered Species Act of 1973 13
365	365	(16 U.S.C. 1531 et seq.); 14
366	366	(B) the National Environmental Policy Act 15
367	367	of 1969 (42 U.S.C. 4321 et seq.), including the 16
368	368	implementing regulations of that Act; and 17
369	369	(C) other applicable Federal environmental 18
370	370	laws and regulations. 19
371	371	(2) C
372	372	OMPLIANCE.— 20
373	373	(A) I
374	374	N GENERAL.—In implementing the 21
375	375	Compact and this Act, the Fort Belknap Indian 22
376	376	Community shall prepare any necessary envi-23
377	377	ronmental documents, except for any environ-24

383	383	(i) the Endangered Species Act of 3

386	386	Act of 1969 (42 U.S.C. 4231 et seq.), in-6
387	387	cluding the implementing regulations of 7
388	388	that Act; and 8
389	389	(iii) all other applicable Federal envi-9
390	390	ronmental laws and regulations. 10
391	391	(B) A
392	392	UTHORIZATIONS.—The Secretary 11
393	393	shall— 12
394	394	(i) independently evaluate the docu-13
395	395	mentation submitted under subparagraph 14
396	396	(A); and 15
397	397	(ii) be responsible for the accuracy, 16
398	398	scope, and contents of that documentation. 17
399	399	(3) E
400	400	FFECT OF EXECUTION .—The execution of 18
401	401	the Compact by the Secretary under this section 19
402	402	shall not constitute a major Federal action for pur-20
403	403	poses of the National Environmental Policy Act of 21
404	404	1969 (42 U.S.C. 4321 et seq.). 22
405	405	(4) C
406	406	OSTS.—Any costs associated with the per-23
407	407	formance of the compliance activities described in 24
408	408	paragraph (2) shall be paid from funds deposited in 25

417	417	SEC. 5. TRIBAL WATER RIGHTS. 6

419	419	ONFIRMATION OFTRIBALWATERRIGHTS.— 7

421	421	N GENERAL.—The Tribal water rights are 8
422	422	ratified, confirmed, and declared to be valid. 9
423	423	(2) U
424	424	SE.—Any use of the Tribal water rights 10
425	425	shall be subject to the terms and conditions of the 11
426	426	Compact and this Act. 12
427	427	(3) C
428	428	ONFLICT.—In the event of a conflict be-13
429	429	tween the Compact and this Act, this Act shall con-14
430	430	trol. 15
431	431	(b) I
432	432	NTENT OFCONGRESS.—It is the intent of Con-16
433	433	gress to provide to each allottee benefits that are equiva-17
434	434	lent to, or exceed, the benefits the allottees possess on the 18
435	435	day before the date of enactment of this Act, taking into 19
436	436	consideration— 20
437	437	(1) the potential risks, cost, and time delay as-21
438	438	sociated with litigation that would be resolved by the 22
439	439	Compact and this Act; 23
440	440	(2) the availability of funding under this Act 24
441	441	and from other sources; 25

707	707	available to the allottee under Tribal law before 16
708	708	initiating an action against the United States 17
709	709	or petitioning the Secretary pursuant to sub-18

2352	2352	an agreement occurs within the Missouri River 15

2355	2355	ate any water allocated to the Fort Belknap Indian 18

2537	2537	enter into agreements with the Fort Belknap Indian Com-18
2538	2538	munity to carry out all or a portion of this section. 19

2967	2967	ings, including interest, earned on those amounts, for the 15

3127	3127	Community elects to withdraw pursuant to this 21
3128	3128	paragraph, subject to the condition that the 22
3129	3129	funds shall be used for the purposes described 23
