To amend the Immigration and Nationality Act to provide
for the detention of certain aliens who commit robbery.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Detain and Deport 4
Illegal Aliens Who Commit Robbery Act’’. 5
SEC. 2. DETENTION OF CERTAIN ALIENS WHO COMMIT 6
ROBBERY. 7
Section 236(c)(1) of the Immigration and Nationality 8
Act (8 U.S.C. 1226(c)) is amended— 9
(1) in paragraph (1)— 10

(A) in the matter preceding subparagraph 1
(A), by striking ‘‘Attorney General’’ and insert-2
ing ‘‘Secretary of Homeland Security’’; 3
(B) in subparagraph (C), by striking ‘‘, 4
or’’ and inserting a comma; 5
(C) in subparagraph (D), by adding ‘‘or’’ 6
at the end; and 7
(D) by inserting after subparagraph (D) 8
the following: 9
‘‘(E)(i) is inadmissible under section 10
212(a)(6)(A) or (C) or under section 212(a)(7); 11
and 12
‘‘(ii) is charged with, arrested for, con-13
victed of, admits having committed, or admits 14
committing acts which constitute the essential 15
elements of any robbery offense,’’; 16
(2) by redesignating paragraph (2) as para-17
graph (4); and 18
(3) by inserting after paragraph (1) the fol-19
lowing: 20
‘‘(2) D
EFINITIONS.—For purposes of paragraph 21
(1)(E), the term ‘robbery’ has the meaning given 22
that term in the jurisdiction where the acts oc-23
curred. 24

‘‘(3) DETAINER.—The Secretary of Homeland 1
Security shall issue a detainer for an alien described 2
in paragraph (1)(E) and, if the alien is not other-3
wise detained by Federal, State, or local officials, 4
shall effectively and expeditiously take custody of the 5
alien.’’. 6
