Us Congress House Bill HB735

Introduced

Caption

Susan Muffley Act of 2023

Impact

The act establishes the Delphi Full Vested Plan Benefit Trust Fund to facilitate these increased payments. This fund will receive appropriations from the general fund of the Treasury to cover the costs associated with guaranteeing these enhanced benefits. Moreover, the bill provides for lump-sum payments to eligible participants who previously received benefits calculated before the enactment of this bill, adjusting for past underpayment along with accruing interest. This initiative aims to rectify past discrepancies in pension benefit calculations, thereby improving the financial well-being of retirees affected by such pension plan terminations.

Summary

House Bill 735, known as the Susan Muffley Act of 2023, seeks to increase benefits guaranteed under certain pension plans, primarily affecting plans terminated under the Employee Retirement Income Security Act (ERISA). The bill mandates recalculating monthly benefits for eligible participants and beneficiaries, ensuring their monthly benefits reflect the full vested plan benefits rather than the usual capped amount previously determined. This change is designed to enhance financial security for former employees of specific companies, particularly those whose pension plans have been transitioned to the Pension Benefit Guaranty Corporation (PBGC).

Contention

Despite the apparent benefits, the bill may face scrutiny regarding the fiscal implications of establishing a new trust fund and the sustainability of supporting increased benefits under federal pension insurance guidelines. Critics could argue about whether the general fund appropriations divert essential resources from other pressing areas of government spending. Conversely, supporters assert that ensuring fair and adequate pension benefits for retirees is paramount and justified, given the historical context of pension fund underfunding and the realities faced by beneficiaries of terminated pension plans.

Lifting Local Communities Act This bill specifies that government entities may not discriminate against religious organizations when awarding federal funds for social services programs (i.e., government programs that provide services for low-income individuals and communities, such as child care, transportation, employment, housing, and meal services). Specifically, religious organizations are eligible to apply for and receive federal funds to provide services for social services programs on the same basis as private, nonreligious organizations. Additionally, government entities may not discriminate against private organizations on the basis of religion when selecting funding recipients. Organizations that receive federal funds for social services programs may not discriminate against individuals on the basis of religion when providing services. If an individual objects to the character or affiliation of a private organization that is providing a service as part of a social services program, government entities must provide the individual with reasonable alternatives. Religious organizations may bring civil actions against entities for violations.
