115115 (2)(A) since 2019, more than 60,000,000 poul-12
116116 try and 10,000,000 swine have been depopulated; 13

118118 (B) those massive cullings are often conducted 15
119119 using incredibly inhumane practices including ven-16
120120 tilation shutdown, ventilation shutdown plus, sodium 17
121121 nitrite poisoning, and water-based foaming (as those 18
122122 terms are defined in section 114(a)); 19
123123 (3) since 2019, industrial operators put slaugh-20
124124 terhouse workers in jeopardy and cost taxpayers mil-21
125125 lions of dollars; 22
126126 (4) industrial operators continue to experience 23
127127 record profits, including a 300-percent growth in 24
128128 profits during the COVID–19 pandemic; 25

134134 ambulatory livestock (as defined in section 3(a) of 3
135135 Public Law 85–765 (commonly known as the ‘‘Hu-4
136136 mane Methods of Slaughter Act of 1958’’)) that 5
137137 causes needless suffering, unsafe working conditions, 6
138138 and the spread of foodborne and zoonotic diseases; 7
139139 (6) industrial operators have abused the use of 8
140140 certain drugs that increase the risk of livestock be-9
141141 coming nonambulatory livestock (as so defined); 10
142142 (7) slaughterhouse deregulation and decreased 11
143143 Federal oversight of meat and poultry slaughter pose 12
144144 significant risks to workers, consumers, and animals; 13
145145 (8) Federal humane slaughter laws currently 14
146146 exempt 98 percent of animals slaughtered for food; 15
147147 (9) current Federal animal transport laws are 16
148148 ineffective and inherently cruel; and 17
149149 (10) Federal support is needed to create a level 18
150150 playing field for farmers engaged in higher-welfare 19
151151 practices who are struggling to compete in a highly 20
152152 monopolized market controlled by industrial opera-21
153153 tors. 22

166166 ing operation’’ or ‘‘AFO’’ means a single lot or 8

168168 (i) for not less than a total of 45 days 10
169169 in any 12-month period, animals (other 11
170170 than aquatic animals) are— 12
171171 (I) stabled or confined; and 13
172172 (II) fed or maintained; and 14
173173 (ii) crops, vegetation, forage growth, 15
174174 or postharvest residues are not sustained 16
175175 in the normal growing season over any por-17
176176 tion of the lot or facility. 18

178178 ULTIPLE LOTS.—For purposes of 19
179179 subparagraph (A), 2 or more lots or facilities 20
180180 described in that subparagraph shall be consid-21
181181 ered to be a single animal feeding operation if 22
182182 the lots or facilities— 23
183183 (i) are located within 3 miles of each 24

193193 pasture-based livestock or poultry production 5

195195 (i) are primarily raised on pasture, 7
196196 grassland, or other vegetative environ-8
197197 ments; 9
198198 (ii) have the ability to exercise spe-10
199199 cies-specific natural behaviors; and 11
200200 (iii) have access to appropriate shel-12
201201 ter, healthy vegetation, potable water, and 13
202202 adequate protection from predators. 14

204204 OVERED INDUSTRIAL OPERATOR .—The 15
205205 term ‘‘covered industrial operator’’ means an indi-16
206206 vidual or entity that owns or controls not less than 17
207207 the following number of livestock or poultry, as ap-18
208208 plicable, that are housed in an AFO at a single point 19
209209 in time: 20
210210 (A) 2,500 swine. 21
211211 (B) 30,000 turkeys or ducks. 22
212212 (C) 82,000 laying hens or broilers. 23

216216 (3) DEPOPULATION.—The term ‘‘depopulation’’ 1
217217 means the rapid destruction of a population of ani-2
218218 mals in response to urgent circumstances. 3

220220 ISASTER EVENT.—The term ‘‘disaster 4
221221 event’’ means— 5
222222 (A) a public health emergency declared by 6
223223 the Secretary of Health and Human Services 7
224224 under section 319 of the Public Health Service 8
225225 Act (42 U.S.C. 247d); 9
226226 (B) a major disaster declared by the Presi-10
227227 dent under section 401 of the Robert T. Staf-11
228228 ford Disaster Relief and Emergency Assistance 12
229229 Act (42 U.S.C. 5170); 13
230230 (C) a disaster designated by the Secretary 14
231231 pursuant to part 759 of title 7, Code of Federal 15
232232 Regulations (or successor regulations); and 16
233233 (D) a quarantine designated by the Sec-17
234234 retary pursuant to the Plant Protection Act (7 18
235235 U.S.C. 7701 et seq.) or animal quarantine laws. 19

237237 IGH-RISK AFO.—The term ‘‘high-risk 20
238238 AFO’’ means an AFO that houses livestock or poul-21
239239 try owned or controlled by a covered industrial oper-22
240240 ator. 23

251251 The Secretary shall establish an office within the De-8
252252 partment of Agriculture, to be known as the ‘‘Office of 9
253253 High-Risk AFO Disaster Mitigation and Enforcement’’, 10
254254 which shall carry out or enforce, as applicable, sections 11
255255 112 through 115. 12
256256 SEC. 112. REGISTRATION OF HIGH-RISK AFOS. 13

258258 EGISTRATIONREQUIREMENT.— 14

260260 N GENERAL.—A covered industrial oper-15
261261 ator shall be required to register with the Office 16
262262 prior to selling, buying, or transferring livestock, 17
263263 poultry, or any product derived from livestock or 18
264264 poultry across State lines. 19
265265 (2) I
266266 NFORMATION.—In registering with the Of-20
267267 fice under paragraph (1), a covered industrial oper-21
268268 ator shall submit to the Office— 22
269269 (A) identifying information about the cov-23
270270 ered industrial operator, including the location, 24
271271 animal type, and peak inventory animal totals 25

277277 (B) a standard disaster mitigation plan 3
278278 that includes— 4
279279 (i) a description of the type, location, 5
280280 and extent of all potential disaster events 6
281281 that can affect livestock or poultry housed 7
282282 in a high-risk AFO, including information 8
283283 on previous occurrences of disaster events 9
284284 and the probability of future disaster 10
285285 events; 11
286286 (ii) a plan to ensure that animals do 12
287287 not go without necessary resources such as 13
288288 shelter, food, and water during an extreme 14
289289 weather event; 15
290290 (iii) a plan to increase flexibility and 16
291291 resiliency, including— 17
292292 (I) identifying ways to house ani-18
293293 mals past their intended slaughter 19
294294 date; and 20
295295 (II) alternative slaughter and 21
296296 processing arrangements, including 22
297297 contracting with small-scale Depart-23
298298 ment of Agriculture, State-certified, 24
299299 or mobile operations with existing ca-25

307307 and labor to carry out depopulation in 5
308308 ways that most rapidly render animals un-6
309309 conscious in the event that depopulation is 7
310310 unavoidable; 8
311311 (v) a plan for disposal of any deceased 9
312312 animals that— 10
313313 (I) satisfies requirements under 11
314314 all relevant Federal, State, and local 12
315315 environmental and public health laws; 13
316316 and 14
317317 (II) does not rely on unlined bur-15
318318 ial or onsite incineration; and 16
319319 (vi) other information, as determined 17
320320 appropriate by the Secretary. 18
321321 (3) A
322322 NNUAL SUBMISSION.—A covered industrial 19
323323 operator that is registered with the Office pursuant 20
324324 to this subsection shall submit to the Office the in-21
325325 formation described in paragraph (2) on an annual 22
326326 basis. 23

328328 ESTRICTED FUNDS FOR PLAN .—A covered 24
329329 industrial operator shall not, in developing a stand-25

342342 N GENERAL.—A covered industrial oper-8
343343 ator registered under subsection (a) shall pay to the 9
344344 Office an annual fee by January 15 of each year for 10
345345 each high-risk AFO owned or controlled by the cov-11
346346 ered industrial operator. 12

348348 OTAL AMOUNT OF FEES .—The amount of 13
349349 the fee required under paragraph (1)— 14
350350 (A) shall be determined by the Secretary in 15
351351 a manner that will ensure that the total amount 16
352352 of fees collected for each fiscal year shall suffi-17
353353 ciently fund the activities of the Office for that 18
354354 fiscal year; but 19
355355 (B) shall not be less than $1 per animal 20
356356 unit (as defined by the Administrator of the 21
357357 Environmental Protection Agency) for each fis-22
358358 cal year. 23

360360 ESTRICTION.—A covered industrial oper-24
361361 ator may not reduce wages or grower payments in 25

371371 STABLISHMENT.—There is established in 5
372372 the Treasury of the United States a fund, to be 6
373373 known as the ‘‘High-Risk AFO Disaster Mitigation 7
374374 and Enforcement Fund’’ (referred to in this sub-8
375375 section as the ‘‘Fund’’). 9
376376 (2) S
377377 OURCE; USE.—All moneys derived from 10
378378 fees collected by the Office under subsection (b) 11
379379 shall be deposited in the Fund and made available 12
380380 to the Secretary, without fiscal year limitation, to 13
381381 offset costs relating to— 14
382382 (A) the administrative costs associated 15
383383 with operating the Office and technical assist-16
384384 ance offered by staff of the Office; 17
385385 (B) creating the national stockpile pursu-18
386386 ant to section 114(c)(2); 19
387387 (C) enforcement actions against covered 20
388388 industrial operators that do not comply with 21
389389 this subtitle; and 22
390390 (D) any other activities determined by the 23
391391 Secretary. 24

397397 A covered industrial operator shall be responsible and 3
398398 liable for, with respect to each high-risk AFO owned or 4
399399 controlled by the covered industrial operator, all costs as-5
400400 sociated with activities related to disaster events or de-6
401401 population of livestock or poultry, including— 7
402402 (1) procuring resources for depopulation of live-8
403403 stock or poultry, including from the national stock-9
404404 pile described in section 114(c)(2); 10
405405 (2) disposal of deceased animals that— 11
406406 (A) satisfies requirements under all rel-12
407407 evant Federal, State, and local environmental 13
408408 and public health laws; and 14
409409 (B) does not rely on unlined burial or on-15
410410 site incineration; 16
411411 (3) compensation for contract growers and 17
412412 workers, as provided in subtitle B; 18
413413 (4) compensation for any adverse health im-19
414414 pacts, property value diminution, and loss of use and 20
415415 enjoyment of property suffered by neighboring resi-21
416416 dents of the high-risk AFO; and 22
417417 (5) other costs determined by the Secretary. 23
418418 SEC. 114. RESTRICTION ON CERTAIN METHODS OF DE-24
419419 POPULATION. 25

427427 (A) sodium nitrite poisoning; 3
428428 (B) ventilation shutdown; 4
429429 (C) ventilation shutdown plus; 5
430430 (D) water-based foaming; and 6
431431 (E) any other method identified by the 7
432432 Secretary. 8

434434 ODIUM NITRITE POISONING .—The term 9
435435 ‘‘sodium nitrite poisoning’’ means a method of ani-10
436436 mal depopulation that involves feeding the toxic sub-11
437437 stance sodium nitrite to animals, causing changes to 12
438438 the blood that prevent delivery of oxygen to tissues 13
439439 and result in prolonged respiratory distress prior to 14
440440 loss of consciousness. 15

442442 ENTILATION SHUTDOWN .—The term ‘‘ven-16
443443 tilation shutdown’’ means a method of animal de-17
444444 population that involves sealing a building in which 18
445445 animals are confined, shutting inlets, and turning off 19
446446 fans in order to raise the temperature in the build-20
447447 ing until the animals die from hyperthermia or hy-21
448448 poxia, including ventilation shutdown plus. 22

450450 ENTILATION SHUTDOWN PLUS .—The term 23
451451 ‘‘ventilation shutdown plus’’ means a ventilation 24

461461 centrate combined with water into a building in 6
462462 which animals are confined until the animals die 7

465465 ESTRICTIONS; CIVILPENALTY.—Notwith-9
466466 standing any other provision of law, beginning 1 year after 10
467467 the date of enactment of this Act, a covered industrial op-11
468468 erator that uses 1 or more restricted practices for any 12
469469 event of depopulation of livestock or poultry on a high- 13

684684 the 60-day period following the disaster mitigation 21
685685 event with 12 weeks of severance pay, at a weekly 22
