1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Promoting Interagency 4
2020 Coordination for Review of Natural Gas Pipelines Act’’. 5

3232 ‘‘Federal authorization’’ has the meaning given that 2

3636 REVIEW.—The term ‘‘NEPA review’’ 5
3737 means the process of reviewing a proposed Federal 6
3838 action under section 102 of the National Environ-7
3939 mental Policy Act of 1969 (42 U.S.C. 4332). 8

4141 ROJECT-RELATED NEPA REVIEW .—The 9
4242 term ‘‘project-related NEPA review’’ means any 10
4343 NEPA review required to be conducted with respect 11
4444 to the issuance of an authorization under section 3 12
4545 of the Natural Gas Act or a certificate of public con-13
4646 venience and necessity under section 7 of such Act. 14

4848 OMMISSIONNEPA REVIEWRESPONSIBIL-15
4949 ITIES.—In acting as the lead agency under section 16
5050 15(b)(1) of the Natural Gas Act for the purposes of com-17
5151 plying with the National Environmental Policy Act of 18
5252 1969 (42 U.S.C. 4321 et seq.) with respect to an author-19
5353 ization under section 3 of the Natural Gas Act or a certifi-20
5454 cate of public convenience and necessity under section 7 21
5555 of such Act, the Commission shall, in accordance with this 22
5656 section and other applicable Federal law— 23
5757 (1) be the only lead agency; 24

6767 a Federal authorization for which the agency is re-7
6868 sponsible; and 8
6969 (3) take such actions as are necessary and 9
7070 proper to facilitate the expeditious resolution of its 10
7171 project-related NEPA review. 11

7373 EFERENCE TOCOMMISSION.—In making a deci-12
7474 sion with respect to a Federal authorization required with 13
7575 respect to an application for authorization under section 14
7676 3 of the Natural Gas Act or a certificate of public conven-15
7777 ience and necessity under section 7 of such Act, each agen-16
7878 cy shall give deference, to the maximum extent authorized 17
7979 by law, to the scope of the project-related NEPA review 18
8080 that the Commission determines to be appropriate. 19

8282 ARTICIPATINGAGENCIES.— 20

8484 DENTIFICATION.—The Commission shall 21
8585 identify, as early as practicable after it is notified by 22
8686 a person applying for an authorization under section 23
8787 3 of the Natural Gas Act or a certificate of public 24
8888 convenience and necessity under section 7 of such 25

101101 N GENERAL.—The Commission shall 8
102102 invite any agency identified under paragraph 9
103103 (1) to participate in the review process for the 10
104104 applicable Federal authorization. 11

106106 EADLINE.—An invitation issued 12
107107 under subparagraph (A) shall establish a dead-13
108108 line by which a response to the invitation shall 14
109109 be submitted to the Commission, which may be 15
110110 extended by the Commission for good cause. 16

112112 ESIGNATION AS PARTICIPATING AGEN -17
113113 CIES.—The Commission shall designate an agency 18
114114 identified under paragraph (1) as a participating 19
115115 agency with respect to an application for authoriza-20
116116 tion under section 3 of the Natural Gas Act or a 21
117117 certificate of public convenience and necessity under 22
118118 section 7 of such Act unless the agency informs the 23
119119 Commission, in writing, by the deadline established 24
120120 pursuant to paragraph (2)(B), that the agency— 25

130130 view conducted by the Commission. 7

132132 FFECT OF NON-DESIGNATION.— 8

134134 FFECT ON AGENCY .—Any agency 9
135135 that is not designated as a participating agency 10
136136 under paragraph (3) with respect to an applica-11
137137 tion for an authorization under section 3 of the 12
138138 Natural Gas Act or a certificate of public con-13
139139 venience and necessity under section 7 of such 14
140140 Act may not request or conduct a NEPA review 15
141141 that is supplemental to the project-related 16
142142 NEPA review conducted by the Commission, 17
143143 unless the agency— 18
144144 (i) demonstrates that such review is 19
145145 legally necessary for the agency to carry 20
146146 out responsibilities in considering an as-21
147147 pect of an application for a Federal au-22
148148 thorization; and 23
149149 (ii) requires information that could 24
150150 not have been obtained during the project- 25

160160 paragraph (3) with respect to an application for 6
161161 an authorization under section 3 of the Natural 7
162162 Gas Act or a certificate of public convenience 8
163163 and necessity under section 7 of such Act— 9
164164 (i) consider any comments or other in-10
165165 formation submitted by such agency for 11
166166 the project-related NEPA review conducted 12
167167 by the Commission; or 13
168168 (ii) include any such comments or 14
169169 other information in the record for such 15
170170 project-related NEPA review. 16

175175 TIONS.—A deadline for a Federal authorization re-19
176176 quired with respect to an application for authoriza-20
177177 tion under section 3 of the Natural Gas Act or a 21
178178 certificate of public convenience and necessity under 22
179179 section 7 of such Act set by the Commission under 23
180180 section 15(c)(1) of such Act shall be not later than 24
181181 90 days after the Commission completes its project- 25

188188 ONCURRENT REVIEWS .—Each Federal and 3
189189 State agency— 4
190190 (A) that may consider an application for a 5
191191 Federal authorization required with respect to 6
192192 an application for authorization under section 3 7
193193 of the Natural Gas Act or a certificate of public 8
194194 convenience and necessity under section 7 of 9
195195 such Act shall formulate and implement a plan 10
196196 for administrative, policy, and procedural mech-11
197197 anisms to enable the agency to ensure comple-12
198198 tion of Federal authorizations in compliance 13
199199 with schedules established by the Commission 14
200200 under section 15(c)(1) of such Act; and 15
201201 (B) in considering an aspect of an applica-16
202202 tion for a Federal authorization required with 17
203203 respect to an application for authorization 18
204204 under section 3 of the Natural Gas Act or a 19
205205 certificate of public convenience and necessity 20
206206 under section 7 of such Act, shall— 21
207207 (i) formulate and implement a plan to 22
208208 enable the agency to comply with the 23
209209 schedule established by the Commission 24
210210 under section 15(c)(1) of such Act; 25

215215 agency under applicable law concurrently, 2
216216 and in conjunction with, the project-related 3
217217 NEPA review conducted by the Commis-4
218218 sion, and in compliance with the schedule 5
219219 established by the Commission under sec-6
220220 tion 15(c)(1) of such Act, unless the agen-7
221221 cy notifies the Commission in writing that 8
222222 doing so would impair the ability of the 9
223223 agency to conduct needed analysis or oth-10
224224 erwise carry out such obligations; 11
225225 (iii) transmit to the Commission a 12
226226 statement— 13
227227 (I) acknowledging receipt of the 14
228228 schedule established by the Commis-15
229229 sion under section 15(c)(1) of the 16
230230 Natural Gas Act; and 17
231231 (II) setting forth the plan formu-18
232232 lated under clause (i) of this subpara-19
233233 graph; 20
234234 (iv) not later than 30 days after the 21
235235 agency receives such application for a Fed-22
236236 eral authorization, transmit to the appli-23
237237 cant a notice— 24

244244 ready for processing, that includes a 4
245245 comprehensive description of the in-5
246246 formation needed for the agency to 6
247247 determine that the application is 7
248248 ready for processing; 8
249249 (v) determine that such application 9
250250 for a Federal authorization is ready for 10
251251 processing for purposes of clause (iv) if 11
252252 such application is sufficiently complete for 12
253253 the purposes of commencing consideration, 13
254254 regardless of whether supplemental infor-14
255255 mation is necessary to enable the agency to 15
256256 complete the consideration required by law 16
257257 with respect to such application; and 17
258258 (vi) not less often than once every 90 18
259259 days, transmit to the Commission a report 19
260260 describing the progress made in consid-20
261261 ering such application for a Federal au-21
262262 thorization. 22

264264 AILURE TO MEET DEADLINE .—If a Fed-23
265265 eral or State agency, including the Commission, fails 24
266266 to meet a deadline for a Federal authorization set 25

276276 gress and the Commission of such failure and set 7
277277 forth a recommended implementation plan to ensure 8
278278 completion of the action to which such deadline ap-9

290290 plication for a Federal authorization shall iden-17
291291 tify, as early as possible, any issues of concern 18
292292 that may delay or prevent an agency from 19
293293 working with the Commission to resolve such 20
294294 issues and granting such authorization. 21

296296 SSUE RESOLUTION.—The Commission 22
297297 may forward any issue of concern identified 23
298298 under subparagraph (A) to the heads of the rel-24
299299 evant agencies (including, in the case of an 25

307307 EMOTE SURVEYS.—If a Federal or State 4
308308 agency considering an aspect of an application for a 5
309309 Federal authorization requires the person applying 6
310310 for such authorization to submit data, the agency 7
311311 shall consider any such data gathered by aerial or 8
312312 other remote means that the person submits. The 9
313313 agency may grant a conditional approval for the 10
314314 Federal authorization based on data gathered by 11
315315 aerial or remote means, conditioned on the 12
316316 verification of such data by subsequent onsite in-13
317317 spection. 14
318318 (3) A
319319 PPLICATION PROCESSING .—The Commis-15
320320 sion, and Federal and State agencies, may allow a 16
321321 person applying for a Federal authorization to fund 17
322322 a third-party contractor to assist in reviewing the 18
323323 application for such authorization. 19
324324 (g) A
325325 CCOUNTABILITY, TRANSPARENCY, EFFI-20
326326 CIENCY.—For an application for an authorization under 21
327327 section 3 of the Natural Gas Act or a certificate of public 22
328328 convenience and necessity under section 7 of such Act that 23
329329 requires multiple Federal authorizations, the Commission, 24
330330 with input from any Federal or State agency considering 25

337337 thorizations. Such information shall include the following: 4
338338 (1) The schedule established by the Commission 5
339339 under section 15(c)(1) of the Natural Gas Act. 6
340340 (2) A list of all the actions required by each ap-7
341341 plicable agency to complete permitting, reviews, and 8
342342 other actions necessary to obtain a final decision on 9
343343 the application. 10
344344 (3) The expected completion date for each such 11
345345 action. 12
346346 (4) A point of contact at the agency responsible 13
347347 for each such action. 14
348348 (5) In the event that an action is still pending 15
349349 as of the expected date of completion, a brief expla-16
350350 nation of the reasons for the delay. 17
351351 SEC. 3. PIPELINE SECURITY. 18
352352 In considering an application for an authorization 19
353353 under section 3 of the Natural Gas Act or a certificate 20
354354 of public convenience and necessity under section 7 of such 21
355355 Act, the Federal Energy Regulatory Commission shall 22
356356 consult with the Administrator of the Transportation Se-23
357357 curity Administration regarding the applicant’s compli-24
358358 ance with security guidance and best practice rec-25
