Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Critical Mineral Con-4
sistency Act of 2024’’. 5
SEC. 2. CRITICAL MATERIALS INCLUDED AS CRITICAL MIN-6
ERALS. 7
Section 7002 of the Energy Act of 2020 (30 U.S.C. 8
1606) is amended— 9
(1) in subsection (a)(3)(A), to read as follows: 10
‘‘(A) I
N GENERAL.—The term ‘critical min-11
eral’ means— 12
‘‘(i) any mineral, element, substance, 13
or material designated as critical by the 14
Secretary under subsection (c); and 15
‘‘(ii) a critical material as determined 16
by the Secretary of Energy under para-17
graph (2)(A).’’; and 18
(2) in subsection (c)(5), by adding at the end the 19
following: 20
‘‘(C) I
NCLUSION OF CRITICAL MATERIALS .— 21
Not later than 45 days after the date on which 22
the Secretary of Energy determines a non-fuel 23
mineral, element, substance, or material to be a 24
critical material under subsection (a)(2)(A), the 25

Secretary shall update the list of critical min-1
erals published under paragraph (3) to include 2
such critical material.’’. 3
