12		-	This Act may be cited as the ‘‘Critical Mineral Con-2
13		-	sistency Act of 2024’’. 3
14		-	SEC. 2. CRITICAL MATERIALS INCLUDED AS CRITICAL MIN-4
15		-	ERALS. 5
16		-	Section 7002 of the Energy Act of 2020 (30 U.S.C. 6
17		-	1606) is amended— 7
18		-	(1) in subsection (a)(3)(A), to read as follows: 8

	43	+	(1) in subsection (a)(3)(A), to read as follows: 10

20		-	N GENERAL.—The term ‘critical 9
21		-	~~mineral~~’ means— 10
22		-	‘‘(i) any mineral, element, substance, 11
23		-	or material designated as critical by the 12
24		-	Secretary under subsection (c); and 13
25		-	‘‘(ii) a critical material as determined 14
26		-	by the Secretary of Energy under para-15
27		-	graph (2)(A).’’; and 16
28		-	(2) in subsection (c)(5), by adding at the end 17
29		-	~~the~~ following: 18
	45	+	N GENERAL.—The term ‘critical min-11
	46	+	eral’ means— 12
	47	+	‘‘(i) any mineral, element, substance, 13
	48	+	or material designated as critical by the 14
	49	+	Secretary under subsection (c); and 15
	50	+	‘‘(ii) a critical material as determined 16
	51	+	by the Secretary of Energy under para-17
	52	+	graph (2)(A).’’; and 18
	53	+	(2) in subsection (c)(5), by adding at the end the 19

31		-	NCLUSION OF CRITICAL MATE -19
32		-	RIALS.—Not later than 45 days after the date 20
33		-	on which the Secretary of Energy determines a 21
34		-	non-fuel mineral, element, substance, or mate-22
35		-	rial to be a critical material under subsection 23
36		-	(a)(2)(A), the Secretary shall update the list of 24 3

38		-	critical minerals published under paragraph (3) 1
39		-	to include such critical material.’’. 2
