37 | 37 | | order’ means a protection order, as defined in sec-8 |

38 | 38 | | tion 2266 of title 18, United States Code; 9 |

39 | 39 | | ‘‘(3) the term ‘extreme risk protection order’— 10 |

40 | 40 | | ‘‘(A) means a written order, issued by a 11 |
---|
41 | 41 | | State court or signed by a magistrate that, for 12 |
---|
42 | 42 | | a period not to exceed a time frame established 13 |
---|
43 | 43 | | by the State— 14 |
---|
44 | 44 | | ‘‘(i) prohibits the individual named in 15 |
---|
45 | 45 | | the order from having under the custody or 16 |
---|
46 | 46 | | control of the individual, purchasing, pos-17 |
---|
47 | 47 | | sessing, or receiving a firearm or ammuni-18 |
---|
48 | 48 | | tion; and 19 |
---|
49 | 49 | | ‘‘(ii) requires that any firearm or am-20 |
---|
50 | 50 | | munition under the custody or control of 21 |
---|
51 | 51 | | the individual be removed; and 22 |
---|
52 | 52 | | ‘‘(B) does not include a domestic violence 23 |

53 | 53 | | protection order; 24 |

66 | 66 | | ROHIBITEDINDIVIDUALS.—For purposes of 9 |
---|
67 | 67 | | this part, a State— 10 |
---|
68 | 68 | | ‘‘(1) shall establish standards for categorizing 11 |
---|
69 | 69 | | an individual as a prohibited individual for purposes 12 |
---|
70 | 70 | | of receiving a covered license; and 13 |
---|
71 | 71 | | ‘‘(2) in establishing standards with respect to a 14 |
---|
72 | 72 | | covered license under paragraph (1), shall take into 15 |
---|
73 | 73 | | consideration whether limitations may be warranted 16 |
---|
74 | 74 | | based on— 17 |
---|
75 | 75 | | ‘‘(A) criminal history; 18 |
---|
76 | 76 | | ‘‘(B) whether an individual has been— 19 |
---|
77 | 77 | | ‘‘(i) deemed a danger to himself or 20 |
---|
78 | 78 | | herself or other individuals by a court or 21 |
---|
79 | 79 | | authorized administrative body; or 22 |
---|
80 | 80 | | ‘‘(ii) committed to a hospital or insti-23 |
---|
81 | 81 | | tution as a danger to himself or herself or 24 |

121 | 121 | | corporate and implement the elements described in 5 |

122 | 122 | | paragraph (2) of this subsection. 6 |

---|
124 | 124 | | LEMENTS.—The elements described in 7 |
---|
125 | 125 | | this paragraph are those providing that— 8 |
---|
126 | 126 | | ‘‘(A) an individual shall have a firearms li-9 |
---|
127 | 127 | | cense— 10 |
---|
128 | 128 | | ‘‘(i) at the time of the purchase, rent-11 |
---|
129 | 129 | | al, or lease of a firearm or purchase of am-12 |
---|
130 | 130 | | munition; and 13 |
---|
131 | 131 | | ‘‘(ii) during the entire period of own-14 |
---|
132 | 132 | | ership or possession of a firearm or ammu-15 |
---|
133 | 133 | | nition; 16 |
---|
134 | 134 | | ‘‘(B)(i) an individual who (including the 17 |
---|
135 | 135 | | owner or operator of a business that) sells, 18 |
---|
136 | 136 | | rents, or leases a minimum number of firearms, 19 |
---|
137 | 137 | | or sells ammunition, during a calendar year 20 |
---|
138 | 138 | | shall obtain a firearms dealer license; and 21 |
---|
139 | 139 | | ‘‘(ii) the State shall establish the minimum 22 |
---|
140 | 140 | | number of firearms for purposes of clause (i), 23 |
---|
141 | 141 | | which may not be higher than 10 per calendar 24 |

154 | 154 | | ‘‘(i) conduct a thorough background 9 |

155 | 155 | | check, which may include— 10 |
---|
156 | 156 | | ‘‘(I) conducting an interview with 11 |
---|
157 | 157 | | the applicant; 12 |
---|
158 | 158 | | ‘‘(II) requiring the submission of 13 |
---|
159 | 159 | | letters of reference stating that the 14 |
---|
160 | 160 | | applicant is of sound mind and char-15 |
---|
161 | 161 | | acter; and 16 |
---|
162 | 162 | | ‘‘(III) any other requirements the 17 |
---|
163 | 163 | | State determines relevant; and 18 |
---|
164 | 164 | | ‘‘(ii) make a determination of suit-19 |
---|
165 | 165 | | ability; 20 |
---|
166 | 166 | | ‘‘(E) a first-time firearms license applicant 21 |
---|
167 | 167 | | shall complete safety training; 22 |
---|
168 | 168 | | ‘‘(F) for an application for issuance or re-23 |

169 | 169 | | newal of a firearms dealer license, the licensing 24 |
---|
170 | 170 | | authority shall conduct an investigation into the 25 |

194 | 194 | | holder of a covered license may, within a rea-21 |

195 | 195 | | sonable time period, petition to obtain judicial 22 |

196 | 196 | | review of a revocation, suspension, or denial of 23 |

---|
296 | 296 | | ‘‘(R) a dealer of firearms or ammunition 13 |

297 | 297 | | shall notify the licensing authority when pre-14 |
---|
298 | 298 | | sented with an invalid or expired firearms li-15 |
---|
299 | 299 | | cense; 16 |

300 | 300 | | ‘‘(S) any firearms licensee whose firearm 17 |

301 | 301 | | or ammunition is lost or stolen shall report the 18 |

324 | 324 | | tamper-resistant mechanical lock or other safety 14 |
---|
325 | 325 | | device, properly engaged so as to render the 15 |
---|
326 | 326 | | firearm inoperable by any individual other than 16 |
---|
327 | 327 | | the owner or other lawfully authorized user; and 17 |

328 | 328 | | ‘‘(ii) for purposes of clause (i), a firearm 18 |
---|
