17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Fort Belknap Indian 4
20	20	Community Water Rights Settlement Act of 2024’’. 5
21	21	SEC. 2. PURPOSES. 6
22	22	The purposes of this Act are— 7
23	23	(1) to achieve a fair, equitable, and final settle-8
24	24	ment of claims to water rights in the State of Mon-9
25	25	tana for— 10

41	41	(B) to take any other actions necessary to 13
42	42	carry out the Compact in accordance with this 14

44	44	(4) to authorize funds necessary for the imple-16
45	45	mentation of the Compact and this Act; and 17
46	46	(5) to authorize the exchange and transfer of 18
47	47	certain Federal and State land. 19
48	48	SEC. 3. DEFINITIONS. 20
49	49	In this Act: 21
50	50	(1) A
51	51	LLOTTEE.—The term ‘‘allottee’’ means an 22
52	52	individual who holds a beneficial real property inter-23
53	53	est in an allotment of Indian land that is— 24
54	54	(A) located within the Reservation; and 25

78	78	pact that is executed to make the Compact con-18

319	319	shall execute the Compact, including all appendices 8

321	321	of the Secretary. 10

323	323	ODIFICATIONS.—Nothing in this Act pre-11
324	324	cludes the Secretary from approving any modifica-12
325	325	tion to an appendix to the Compact that is con-13
326	326	sistent with this Act, to the extent that the modifica-14
327	327	tion does not otherwise require congressional ap-15
328	328	proval under section 2116 of the Revised Statutes 16
329	329	(25 U.S.C. 177) or any other applicable provision of 17
330	330	Federal law. 18

332	332	NVIRONMENTAL COMPLIANCE.— 19

334	334	N GENERAL.—In implementing the Com-20
335	335	pact and this Act, the Secretary shall comply with 21
336	336	all applicable provisions of— 22
337	337	(A) the Endangered Species Act of 1973 23
338	338	(16 U.S.C. 1531 et seq.); 24

351	351	Compact and this Act, the Fort Belknap Indian 8
352	352	Community shall prepare any necessary envi-9
353	353	ronmental documents, consistent with all appli-10
354	354	cable provisions of— 11
355	355	(i) the Endangered Species Act of 12
356	356	1973 (16 U.S.C. 1531 et seq.); 13
357	357	(ii) the National Environmental Policy 14
358	358	Act of 1969 (42 U.S.C. 4231 et seq.), in-15
359	359	cluding the implementing regulations of 16
360	360	that Act; and 17
361	361	(iii) all other applicable Federal envi-18
362	362	ronmental laws and regulations. 19
363	363	(B) A
364	364	UTHORIZATIONS.—The Secretary 20
365	365	shall— 21
366	366	(i) independently evaluate the docu-22
367	367	mentation submitted under subparagraph 23
368	368	(A); and 24

375	375	FFECT OF EXECUTION .—The execution of 3
376	376	the Compact by the Secretary under this section 4
377	377	shall not constitute a major Federal action for pur-5
378	378	poses of the National Environmental Policy Act of 6
379	379	1969 (42 U.S.C. 4321 et seq.). 7
380	380	(4) C
381	381	OSTS.—Any costs associated with the per-8
382	382	formance of the compliance activities under this sub-9
383	383	section shall be paid from funds deposited in the 10
384	384	Trust Fund, subject to the condition that any costs 11
385	385	associated with the performance of Federal approval 12
386	386	or other review of such compliance work or costs as-13
387	387	sociated with inherently Federal functions shall re-14
388	388	main the responsibility of the Secretary. 15
389	389	SEC. 5. TRIBAL WATER RIGHTS. 16

391	391	ONFIRMATION OFTRIBALWATERRIGHTS.— 17

393	393	N GENERAL.—The Tribal water rights are 18
394	394	ratified, confirmed, and declared to be valid. 19
395	395	(2) U
396	396	SE.—Any use of the Tribal water rights 20
397	397	shall be subject to the terms and conditions of the 21
398	398	Compact and this Act. 22

400	400	ONFLICT.—In the event of a conflict be-23
401	401	tween the Compact and this Act, this Act shall con-24

406	406	(b) INTENT OFCONGRESS.—It is the intent of Con-1
407	407	gress to provide to each allottee benefits that are equiva-2
408	408	lent to, or exceed, the benefits the allottees possess on the 3
409	409	day before the date of enactment of this Act, taking into 4
410	410	consideration— 5
411	411	(1) the potential risks, cost, and time delay as-6
412	412	sociated with litigation that would be resolved by the 7
413	413	Compact and this Act; 8
414	414	(2) the availability of funding under this Act 9
415	415	and from other sources; 10
416	416	(3) the availability of water from the Tribal 11
417	417	water rights; and 12
418	418	(4) the applicability of section 7 of the Act of 13
419	419	February 8, 1887 (24 Stat. 390, chapter 119; 25 14
420	420	U.S.C. 381), and this Act to protect the interests of 15
421	421	allottees. 16
422	422	(c) T
423	423	RUSTSTATUS OFTRIBALWATERRIGHTS.— 17
424	424	The Tribal water rights— 18
425	425	(1) shall be held in trust by the United States 19
426	426	for the use and benefit of the Fort Belknap Indian 20
427	427	Community and allottees in accordance with this 21
428	428	Act; and 22
429	429	(2) shall not be subject to loss through non-use, 23
430	430	forfeiture, or abandonment. 24

440	440	tion purposes, shall apply to the Tribal water rights. 5

442	442	NTITLEMENT TO WATER .—Any entitle-6
443	443	ment to water of an allottee under Federal law shall 7
444	444	be satisfied from the Tribal water rights. 8

670	670	(ii) resolution of any contested admin-19

673	673	ing a claim relating to the enforcement of rights 22
674	674	of the allottee under the Tribal water code, in-23
675	675	cluding to the quantity of water allocated to 24

2190	2190	Indian Community shall enter into an agreement 15
2191	2191	with the Secretary to establish the terms and condi-16
2192	2192	tions of the allocation, in accordance with the Com-17
2193	2193	pact and this Act. 18

2195	2195	NCLUSIONS.—The agreement under para-19
2196	2196	graph (1) shall include provisions establishing that— 20

2222	2222	dian Community shall have the same storage 18
2223	2223	rights as other storage contractors with respect 19
2224	2224	to the allocation under this section; 20
2225	2225	(E) the costs associated with the construc-21
2226	2226	tion of the storage facilities at Tiber Dam allo-22
2227	2227	cable to the Fort Belknap Indian Community 23
2228	2228	shall be nonreimbursable; 24

2272	2272	for the use of the water allocated to the Fort Belknap 12
2273	2273	Indian Community under subsection (a) if— 13
2274	2274	(1) the use of water that is the subject of such 14
2275	2275	an agreement occurs within the Missouri River 15
2276	2276	Basin; and 16
2277	2277	(2) the agreement does not permanently alien-17
2278	2278	ate any water allocated to the Fort Belknap Indian 18
2279	2279	Community under that subsection. 19

2281	2281	FFECTIVEDATE.—The allocation under sub-20
2282	2282	section (a) takes effect on the enforceability date. 21

2301	2301	Blackfeet Tribe, shall carry out appropriate activi-11
2302	2302	ties concerning the restoration of the St. Mary 12
2303	2303	Canal and associated facilities, including activities 13
2304	2304	relating to the— 14
2305	2305	(A) planning and design to restore the St. 15
2306	2306	Mary Canal and appurtenances to convey 850 16
2307	2307	cubic-feet per second; and 17
2308	2308	(B) rehabilitating, constructing, and re-18
2309	2309	pairing of the St. Mary Canal and appur-19
2310	2310	tenances; and 20
2311	2311	(2) in cooperation with the State and the Fort 21
2312	2312	Belknap Indian Community, shall carry out appro-22
2313	2313	priate activities concerning the enlargement of 23
2314	2314	Dodson South Canal and associated facilities, includ-24
2315	2315	ing activities relating to the— 25

2366	2366	which shall include— 16
2367	2367	(1) planning, studies, and designing of the ex-17
2368	2368	isting and expanded Milk River unit, including the 18
2369	2369	Pumping Plant, delivery pipe and canal, Fort 19
2370	2370	Belknap Dam and Reservoir, and Peoples Creek 20
2371	2371	Flood Protection Project; 21
2372	2372	(2) the rehabilitation, modernization, and con-22
2373	2373	struction of the existing Milk River unit; and 23
2374	2374	(3) construction of the expanded Milk River 24
2375	2375	Project, including the Pumping Plant, delivery pipe 25
