1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Fort Belknap Indian 4
2020 Community Water Rights Settlement Act of 2024’’. 5
2121 SEC. 2. PURPOSES. 6
2222 The purposes of this Act are— 7
2323 (1) to achieve a fair, equitable, and final settle-8
2424 ment of claims to water rights in the State of Mon-9

4848 SEC. 3. DEFINITIONS. 20

5151 LLOTTEE.—The term ‘‘allottee’’ means an 22
5252 individual who holds a beneficial real property inter-23
5353 est in an allotment of Indian land that is— 24

350350 N GENERAL.—In implementing the 7
351351 Compact and this Act, the Fort Belknap Indian 8
352352 Community shall prepare any necessary envi-9
353353 ronmental documents, consistent with all appli-10
354354 cable provisions of— 11
355355 (i) the Endangered Species Act of 12
356356 1973 (16 U.S.C. 1531 et seq.); 13
357357 (ii) the National Environmental Policy 14
358358 Act of 1969 (42 U.S.C. 4231 et seq.), in-15
359359 cluding the implementing regulations of 16
360360 that Act; and 17
361361 (iii) all other applicable Federal envi-18
362362 ronmental laws and regulations. 19
363363 (B) A
364364 UTHORIZATIONS.—The Secretary 20
365365 shall— 21
366366 (i) independently evaluate the docu-22
367367 mentation submitted under subparagraph 23
368368 (A); and 24

375375 FFECT OF EXECUTION .—The execution of 3
376376 the Compact by the Secretary under this section 4
377377 shall not constitute a major Federal action for pur-5
378378 poses of the National Environmental Policy Act of 6
379379 1969 (42 U.S.C. 4321 et seq.). 7

381381 OSTS.—Any costs associated with the per-8
382382 formance of the compliance activities under this sub-9
383383 section shall be paid from funds deposited in the 10
384384 Trust Fund, subject to the condition that any costs 11
385385 associated with the performance of Federal approval 12
386386 or other review of such compliance work or costs as-13
387387 sociated with inherently Federal functions shall re-14
388388 main the responsibility of the Secretary. 15
389389 SEC. 5. TRIBAL WATER RIGHTS. 16

391391 ONFIRMATION OFTRIBALWATERRIGHTS.— 17

393393 N GENERAL.—The Tribal water rights are 18
394394 ratified, confirmed, and declared to be valid. 19
395395 (2) U
396396 SE.—Any use of the Tribal water rights 20
397397 shall be subject to the terms and conditions of the 21
398398 Compact and this Act. 22

400400 ONFLICT.—In the event of a conflict be-23
401401 tween the Compact and this Act, this Act shall con-24

406406 (b) INTENT OFCONGRESS.—It is the intent of Con-1
407407 gress to provide to each allottee benefits that are equiva-2
408408 lent to, or exceed, the benefits the allottees possess on the 3
409409 day before the date of enactment of this Act, taking into 4
410410 consideration— 5
411411 (1) the potential risks, cost, and time delay as-6
412412 sociated with litigation that would be resolved by the 7
413413 Compact and this Act; 8
414414 (2) the availability of funding under this Act 9
415415 and from other sources; 10
416416 (3) the availability of water from the Tribal 11
417417 water rights; and 12
418418 (4) the applicability of section 7 of the Act of 13
419419 February 8, 1887 (24 Stat. 390, chapter 119; 25 14
420420 U.S.C. 381), and this Act to protect the interests of 15
421421 allottees. 16

423423 RUSTSTATUS OFTRIBALWATERRIGHTS.— 17
424424 The Tribal water rights— 18
425425 (1) shall be held in trust by the United States 19
426426 for the use and benefit of the Fort Belknap Indian 20
427427 Community and allottees in accordance with this 21
428428 Act; and 22
429429 (2) shall not be subject to loss through non-use, 23
430430 forfeiture, or abandonment. 24

432432 LLOTTEES.— 25

443443 ment to water of an allottee under Federal law shall 7
444444 be satisfied from the Tribal water rights. 8

446446 LLOCATIONS.—An allottee shall be entitled 9
447447 to a just and equitable allocation of water for irriga-10
448448 tion purposes. 11

452452 XHAUSTION OF REMEDIES .—Before 13
453453 asserting any claim against the United States 14
454454 under section 7 of the Act of February 8, 1887 15
455455 (24 Stat. 390, chapter 119; 25 U.S.C. 381), or 16
456456 any other applicable law, an allottee shall ex-17
457457 haust remedies available under the Tribal water 18
458458 code or other applicable Tribal law. 19
459459 (B) A
460460 CTION FOR RELIEF.—After the ex-20
461461 haustion of all remedies available under the 21
462462 Tribal water code or other applicable Tribal 22
463463 law, an allottee may seek relief under section 7 23
464464 of the Act of February 8, 1887 (24 Stat. 390, 24
