14	14	To amend the Federal Water Pollution Control Act to make
15	15	certain projects and activities eligible for financial assist-
16	16	ance under a State water pollution control revolving
17	17	fund, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Clean Water SRF Par-4
22	22	ity Act of 2024’’. 5

27	27	ANCE. 2
28	28	Section 603 of the Federal Water Pollution Control 3
29	29	Act (33 U.S.C. 1383) is amended— 4
30	30	(1) in subsection (c)— 5
31	31	(A) in paragraph (11)(B) by striking 6
32	32	‘‘and’’ at the end; 7
33	33	(B) in paragraph (12)(B) by striking the 8
34	34	period at the end and inserting ‘‘; and’’; and 9
35	35	(C) by adding at the end the following: 10
36	36	‘‘(13) to any qualified nonprofit entity, as de-11
37	37	termined by the Administrator, to provide assistance 12
38	38	for the construction or acquisition of, or improve-13
39	39	ments to, a treatment works, or for any other activ-14
40	40	ity described in paragraphs (1) through (10).’’; 15
41	41	(2) in subsection (i)(3), by adding at the end 16
42	42	the following: 17
43	43	‘‘(E) C
44	44	ERTAIN ACTIVITIES INELIGIBLE.—A 18
45	45	State may not provide additional subsidization 19
46	46	under this subsection to a qualified nonprofit 20
47	47	entity for assistance described in subsection 21
48	48	(c)(13) or to the owner or operator of a pri-22
49	49	vately owned treatment works for assistance de-23
50	50	scribed in subsection (k).’’; and 24
51	51	(3) by adding at the end the following: 25

55	55	‘‘(k) SPECIALRULE FORPRIVATELYOWNEDTREAT-1
56	56	MENTWORKS.— 2
57	57	‘‘(1) I
58	58	N GENERAL.—In any fiscal year for which 3
59	59	the total amount appropriated to carry out this title 4
60	60	exceeds $1,638,861,000, any such amounts appro-5
61	61	priated in excess of $1,638,861,000 for such fiscal 6
62	62	year may be used to provide financial assistance 7
63	63	under this section to the owner or operator of a pri-8
64	64	vately owned treatment works for— 9
65	65	‘‘(A) improvements to such privately owned 10
66	66	treatment works; 11
67	67	‘‘(B) the construction of, or improvements 12
68	68	to, another privately owned treatment works; 13
69	69	‘‘(C) measures to reduce the demand for 14
70	70	privately owned treatment works capacity 15
71	71	through water conservation, efficiency, or reuse; 16
72	72	‘‘(D) measures to reduce the energy con-17
73	73	sumption needs for privately owned treatment 18
74	74	works; 19
75	75	‘‘(E) measures to increase the security of 20
76	76	privately owned treatment works; and 21
77	77	‘‘(F) any other activity described in para-22
78	78	graphs (1) through (10) of subsection (c). 23
79	79	‘‘(2) L
80	80	IMITATION.—Financial assistance may 24
81	81	only be provided under this subsection to the owner 25

85	85	or operator of a privately owned treatment works for 1
86	86	activities described in paragraph (1) that primarily 2
87	87	and directly benefit the individuals or entities served 3
88	88	by the privately owned treatment works, and not the 4
89	89	shareholders or owners of the treatment works, as 5
90	90	determined by the instrumentality of the State re-6
91	91	sponsible for administering the water pollution con-7
92	92	trol revolving fund through which such financial as-8
93	93	sistance is provided.’’. 9
