2121 This Act may be cited as the ‘‘Clean Water SRF Par-4

2828 Section 603 of the Federal Water Pollution Control 3
2929 Act (33 U.S.C. 1383) is amended— 4
3030 (1) in subsection (c)— 5
3131 (A) in paragraph (11)(B) by striking 6
3232 ‘‘and’’ at the end; 7
3333 (B) in paragraph (12)(B) by striking the 8
3434 period at the end and inserting ‘‘; and’’; and 9
3535 (C) by adding at the end the following: 10
3636 ‘‘(13) to any qualified nonprofit entity, as de-11
3737 termined by the Administrator, to provide assistance 12
3838 for the construction or acquisition of, or improve-13
3939 ments to, a treatment works, or for any other activ-14
4040 ity described in paragraphs (1) through (10).’’; 15
4141 (2) in subsection (i)(3), by adding at the end 16
4242 the following: 17
4343 ‘‘(E) C
4444 ERTAIN ACTIVITIES INELIGIBLE.—A 18
4545 State may not provide additional subsidization 19
4646 under this subsection to a qualified nonprofit 20
4747 entity for assistance described in subsection 21
4848 (c)(13) or to the owner or operator of a pri-22
4949 vately owned treatment works for assistance de-23
5050 scribed in subsection (k).’’; and 24
5151 (3) by adding at the end the following: 25

5757 ‘‘(1) I
5858 N GENERAL.—In any fiscal year for which 3
5959 the total amount appropriated to carry out this title 4
6060 exceeds $1,638,861,000, any such amounts appro-5
6161 priated in excess of $1,638,861,000 for such fiscal 6
6262 year may be used to provide financial assistance 7
6363 under this section to the owner or operator of a pri-8
6464 vately owned treatment works for— 9
6565 ‘‘(A) improvements to such privately owned 10
6666 treatment works; 11
6767 ‘‘(B) the construction of, or improvements 12
6868 to, another privately owned treatment works; 13
6969 ‘‘(C) measures to reduce the demand for 14
7070 privately owned treatment works capacity 15
7171 through water conservation, efficiency, or reuse; 16
7272 ‘‘(D) measures to reduce the energy con-17
7373 sumption needs for privately owned treatment 18
7474 works; 19
7575 ‘‘(E) measures to increase the security of 20
7676 privately owned treatment works; and 21
7777 ‘‘(F) any other activity described in para-22
7878 graphs (1) through (10) of subsection (c). 23

8080 IMITATION.—Financial assistance may 24
8181 only be provided under this subsection to the owner 25

8585 or operator of a privately owned treatment works for 1
8686 activities described in paragraph (1) that primarily 2
8787 and directly benefit the individuals or entities served 3
8888 by the privately owned treatment works, and not the 4
8989 shareholders or owners of the treatment works, as 5
9090 determined by the instrumentality of the State re-6
9191 sponsible for administering the water pollution con-7
9292 trol revolving fund through which such financial as-8
9393 sistance is provided.’’. 9
