Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘FAFSA Deadline Act’’. 4
SEC. 2. ESTABLISHMENT OF EARLIER APPLICATION PROC-5
ESSING CYCLE. 6
Section 483(d)(4) of the Higher Education Act of 1965 7
(20 U.S.C. 1090(d)(4)) is amended by striking ‘‘not later 8
than January 1 of the applicant’s planned year of enroll-9
ment, to the maximum extent practicable, on or around Oc-10
tober 1 prior to the applicant’s planned year of enrollment’’ 11
and inserting ‘‘not later than October 1 prior to the appli-12
cant’s planned year of enrollment’’. 13
SEC. 3. CERTIFICATION AND TESTIMONY REQUIREMENTS. 14
Section 483(d)(4) of the Higher Education Act of 1965 15
(20 U.S.C. 1090(d)(4)) is further amended— 16
(1) by striking ‘‘The Secretary’’ and inserting 17
the following: 18
‘‘(A) I
N GENERAL.—The Secretary’’; and 19
(2) by adding at the end the following: 20
‘‘(B) C
ERTIFICATION AND TESTIMONY RE -21
QUIREMENTS.—The Secretary shall, with respect 22
to each application processing cycle, prior to the 23
initiation of such processing cycle— 24

‘‘(i) on a date that is not later than 1
September 1— 2
‘‘(I) certify to the authorizing 3
committees that the Department will 4
meet the October 1 deadline specified 5
in subparagraph (A) for such proc-6
essing cycle; or 7
‘‘(II) certify to such committees 8
that the Department will not meet such 9
deadline; and 10
‘‘(ii) in the case of a certification de-11
scribed in clause (i)(II), on a date that is 12
not later than September 30, testify before 13
the authorizing committees on— 14
‘‘(I) the anticipated failure to 15
meet such deadline; and 16
‘‘(II) the financial impact such 17
failure will have on students and fami-18
lies.’’. 19
