2828 of Energy Resources Act of 2023’’ or the ‘‘POWER Act 5

4242 N GENERAL.—The term ‘‘Federal 7
4343 land’’ means— 8
4444 (i) National Forest System land; 9
4545 (ii) public lands (as defined in section 10
4646 103 of the Federal Land Policy and Man-11
4747 agement Act of 1976 (43 U.S.C. 1702)); 12
4848 (iii) the outer Continental Shelf (as 13
4949 defined in section 2 of the Outer Conti-14
5050 nental Shelf Lands Act (43 U.S.C. 1331)); 15
5151 and 16
5252 (iv) land managed by the Secretary of 17
5353 Energy. 18

5555 NCLUSION.—The term ‘‘Federal 19
5656 land’’ includes land described in clauses (i) 20
5757 through (iv) of subparagraph (A) for which the 21
5858 rights to the surface estate or subsurface estate 22
5959 are owned by a non-Federal entity. 23

6161 INERAL.—The term ‘‘mineral’’ means any 24
6262 mineral subject to sections 2319 through 2344 of 25
6363 the Revised Statutes (commonly known as the ‘‘Min-26

7272 RESIDENT.—The term ‘‘President’’ means 5
7373 the President or any designee, including— 6
7474 (A) the Secretary of Agriculture; 7
7575 (B) the Secretary of Energy; and 8
7676 (C) the Secretary of the Interior. 9

7878 ROHIBITIONS.— 10

8080 N GENERAL.—Notwithstanding any other 11
8181 provision of law, the President shall not carry out 12
8282 any action that would prohibit or substantially delay 13
8383 the issuance of any of the following on Federal land, 14
8484 unless such an action has been authorized by an Act 15
8585 of Congress: 16
8686 (A) New oil and gas leases, drill permits, 17
8787 approvals, or authorizations. 18
8888 (B) New coal leases, permits, approvals, or 19
8989 authorizations. 20
9090 (C) New mineral patents, leases, permits, 21
9191 approvals, or authorizations. 22

9393 ROHIBITION ON WITHDRAWAL .—Notwith-23
9494 standing any other provision of law, the President 24
9595 may not withdraw any Federal land from forms of 25

9999 entry, appropriation, or disposal under the public 1
100100 land laws, location, entry, and patent under the min-2
101101 ing laws, or disposition under laws pertaining to 3
102102 mineral and geothermal leasing or mineral materials 4
103103 unless the withdrawal has been authorized by an Act 5
