1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Detain and Deport 4
2020 Gang Members Act of 2024’’. 5
2121 SEC. 2. DETENTION OF CERTAIN ALIENS WHO BELONG TO 6
2222 INTERNATIONAL CRIMINAL GANGS. 7

2424 EFINITION OFGANGMEMBER.—Section 101(a) 8
2525 of the Immigration and Nationality Act (8 U.S.C. 9

3030 ‘‘(53) The term ‘criminal gang’ means an ongoing 1
3131 group, club, organization, or association of 5 or more per-2
3232 sons that has as one of its primary purposes the commis-3
3333 sion of 1 or more of the following criminal offenses and 4
3434 the members of which engage, or have engaged within the 5
3535 past 5 years, in a continuing series of such offenses, or 6
3636 that has been designated as a criminal gang by the Sec-7
3737 retary of Homeland Security, in consultation with the At-8
3838 torney General, as meeting these criteria. The offenses de-9
3939 scribed, whether in violation of Federal or State law or 10
4040 foreign law and regardless of whether the offenses oc-11
4141 curred before, on, or after the date of the enactment of 12
4242 this paragraph, are the following: 13
4343 ‘‘(A) A ‘felony drug offense’ (as defined in sec-14
4444 tion 102 of the Controlled Substances Act (21 15
4545 U.S.C. 802)). 16
4646 ‘‘(B) An offense under section 274 (relating to 17
4747 bringing in and harboring certain aliens), section 18
4848 277 (relating to aiding or assisting certain aliens to 19
4949 enter the United States), or section 278 (relating to 20
5050 importation of alien for immoral purpose). 21
5151 ‘‘(C) A crime of violence (as defined in section 22
5252 16 of title 18, United States Code). 23

6161 lating to fraud and related activity in connection 6
6262 with identification documents or access devices), sec-7
6363 tions 1581 through 1594 of such title (relating to 8
6464 peonage, slavery, and trafficking in persons), section 9
6565 1951 of such title (relating to interference with com-10
6666 merce by threats or violence), section 1952 of such 11
6767 title (relating to interstate and foreign travel or 12
6868 transportation in aid of racketeering enterprises), 13
6969 section 1956 of such title (relating to the laundering 14
7070 of monetary instruments), section 1957 of such title 15
7171 (relating to engaging in monetary transactions in 16
7272 property derived from specified unlawful activity), or 17
7373 sections 2312 through 2315 of such title (relating to 18
7474 interstate transportation of stolen motor vehicles or 19
7575 stolen property). 20
7676 ‘‘(F) A conspiracy to commit an offense de-21
7777 scribed in subparagraphs (A) through (E).’’. 22

7979 NADMISSIBILITY.—Section 212(a)(2) of such Act 23
8080 (8 U.S.C. 1182(a)(2)) is amended by adding at the end 24

8686 GANGS.—Any alien is inadmissible who a con-2
8787 sular officer, the Secretary of Homeland Secu-3
8888 rity, or the Attorney General knows or has rea-4
8989 son to believe— 5
9090 ‘‘(i) to be or to have been a member 6
9191 of a criminal gang (as defined in section 7
9292 101(a)(53)); or 8
9393 ‘‘(ii) to have participated in the activi-9
9494 ties of a criminal gang (as defined in sec-10
9595 tion 101(a)(53)), knowing or having reason 11
9696 to know that such activities will promote, 12
9797 further, aid, or support the illegal activity 13
9898 of the criminal gang.’’. 14

101101 tion and Nationality Act (8 U.S.C. 1226(c)) is amended— 16

105105 ing ‘‘Secretary of Homeland Security’’; 20

162162 NGENERAL.—The Secretary of Homeland Se-16
163163 curity, in consultation with the Attorney General, may 17
164164 designate a group, club, organization, or association of 5 18
165165 or more persons as a criminal gang if the Secretary finds 19
166166 that their conduct is described in section 101(a)(53). 20

171171 ing a designation under this subsection, the Sec-23

219219 view the designation of a criminal gang under 6
220220 the procedures set forth in clauses (iii) and (iv) 7
221221 if the designated group, club, organization, or 8
222222 association of 5 or more persons files a petition 9
223223 for revocation within the petition period de-10
224224 scribed in clause (ii). 11
225225 ‘‘(ii) P
226226 ETITION PERIOD.—For purposes of 12
227227 clause (i)— 13
228228 ‘‘(I) if the designated group, club, or-14
229229 ganization, or association of 5 or more per-15
230230 sons has not previously filed a petition for 16
231231 revocation under this subparagraph, the 17
232232 petition period begins 2 years after the 18
233233 date on which the designation was made; 19
234234 or 20
235235 ‘‘(II) if the designated group, club, or-21
236236 ganization, or association of 5 or more per-22
237237 sons has previously filed a petition for rev-23
238238 ocation under this subparagraph, the peti-24
239239 tion period begins 2 years after the date of 25

248248 that submits a petition for revocation under 5
249249 this subparagraph of its designation as a crimi-6
250250 nal gang must provide evidence in that petition 7
251251 that it is not described in section 101(a)(53). 8
252252 ‘‘(iv) D
253253 ETERMINATION.— 9
254254 ‘‘(I) I
255255 N GENERAL.—Not later than 10
256256 180 days after receiving a petition for rev-11
257257 ocation submitted under this subpara-12
258258 graph, the Secretary shall make a deter-13
259259 mination as to such revocation. 14
260260 ‘‘(II) C
261261 LASSIFIED INFORMATION .— 15
262262 The Secretary may consider classified in-16
263263 formation in making a determination in re-17
264264 sponse to a petition for revocation. Classi-18
265265 fied information shall not be subject to dis-19

267267 fied, except that such information may be 21

283283 THER REVIEW OF DESIGNATION .— 8

285285 N GENERAL.—If in a 5-year period no 9
286286 review has taken place under subparagraph (B), 10
287287 the Secretary shall review the designation of the 11
288288 criminal gang in order to determine whether 12
289289 such designation should be revoked pursuant to 13
290290 paragraph (6). 14

292292 ROCEDURES.—If a review does not 15
293293 take place pursuant to subparagraph (B) in re-16
294294 sponse to a petition for revocation that is filed 17
295295 in accordance with that subparagraph, then the 18
296296 review shall be conducted pursuant to proce-19
297297 dures established by the Secretary. The results 20
298298 of such review and the applicable procedures 21
299299 shall not be reviewable in any court. 22

302302 VIEW.—The Secretary shall publish any deter-24

316316 N GENERAL.—The Secretary may revoke 8
317317 a designation made under paragraph (1) at any 9
318318 time, and shall revoke a designation upon completion 10
319319 of a review conducted pursuant to subparagraphs 11
320320 (B) and (C) of paragraph (4) if the Secretary finds 12
321321 that— 13
322322 ‘‘(i) the group, club, organization, or asso-14
323323 ciation of 5 or more persons that has been des-15
324324 ignated as a criminal gang is no longer de-16
325325 scribed in section 101(a)(53); or 17
326326 ‘‘(ii) the national security or the law en-18
327327 forcement interests of the United States war-19
328328 rants a revocation. 20
329329 ‘‘(B) P
330330 ROCEDURE.—The procedural require-21
331331 ments of paragraphs (2) and (3) shall apply to a 22
332332 revocation under this paragraph. Any revocation 23
333333 shall take effect on the date specified in the revoca-24

341341 designation under paragraph (5) or (6) shall not affect 4
342342 any action or proceeding based on conduct committed 5
343343 prior to the effective date of such revocation. 6

345345 SE OFDESIGNATION INTRIAL ORHEAR-7
346346 ING.—If a designation under this subsection has become 8
347347 effective under paragraph (2) an alien in a removal pro-9
348348 ceeding shall not be permitted to raise any question con-10
349349 cerning the validity of the issuance of such designation 11
350350 as a defense or an objection. 12
351351 ‘‘(b) A
352352 MENDMENTS TO A DESIGNATION.— 13
353353 ‘‘(1) I
354354 N GENERAL.—The Secretary may amend 14
355355 a designation under this subsection if the Secretary 15
356356 finds that the group, club, organization, or associa-16
357357 tion of 5 or more persons has changed its name, 17
358358 adopted a new alias, dissolved and then reconsti-18
359359 tuted itself under a different name or names, or 19
360360 merged with another group, club, organization, or 20
361361 association of 5 or more persons. 21
362362 ‘‘(2) P
363363 ROCEDURE.—Amendments made to a 22
364364 designation in accordance with paragraph (1) shall 23
365365 be effective upon publication in the Federal Register. 24

373373 DMINISTRATIVE RECORD .—The adminis-3
374374 trative record shall be corrected to include the 4
375375 amendments as well as any additional relevant infor-5
376376 mation that supports those amendments. 6

378378 LASSIFIED INFORMATION .—The Sec-7
379379 retary may consider classified information in amend-8
380380 ing a designation in accordance with this subsection. 9
381381 Classified information shall not be subject to disclo-10
382382 sure for such time as it remains classified, except 11
383383 that such information may be disclosed to a court ex 12
384384 parte and in camera for purposes of judicial review 13
385385 under subsection (c) of this section. 14

392392 tion in response to a petition for revocation, the des-19
393393 ignated group, club, organization, or association of 5 20
394394 or more persons may seek judicial review in the 21
395395 United States Court of Appeals for the District of 22
396396 Columbia Circuit. 23

398398 ASIS OF REVIEW.—Review under this 24
399399 subsection shall be based solely upon the administra-25

409409 COPE OF REVIEW.—The Court shall hold 6
410410 unlawful and set aside a designation, amended des-7
411411 ignation, or determination in response to a petition 8
412412 for revocation the court finds to be— 9
413413 ‘‘(A) arbitrary, capricious, an abuse of dis-10
414414 cretion, or otherwise not in accordance with 11
415415 law; 12
416416 ‘‘(B) contrary to constitutional right, 13
417417 power, privilege, or immunity; 14
418418 ‘‘(C) in excess of statutory jurisdiction, au-15
419419 thority, or limitation, or short of statutory 16
420420 right; 17
421421 ‘‘(D) lacking substantial support in the ad-18
422422 ministrative record taken as a whole or in clas-19
423423 sified information submitted to the court under 20
424424 paragraph (2); or 21
425425 ‘‘(E) not in accord with the procedures re-22
426426 quired by law. 23

428428 UDICIAL REVIEW INVOKED .—The pend-24
429429 ency of an action for judicial review of a designation, 25

440440 EFINITIONS.—As used in this section— 7
441441 ‘‘(1) the term ‘classified information’ has the 8
442442 meaning given that term in section 1(a) of the Clas-9
443443 sified Information Procedures Act (18 U.S.C. App.); 10
444444 ‘‘(2) the term ‘national security’ means the na-11
445445 tional defense, foreign relations, or economic inter-12
446446 ests of the United States; 13
447447 ‘‘(3) the term ‘relevant committees’ means the 14
448448 Committees on the Judiciary of the Senate and of 15
449449 the House of Representatives; and 16
450450 ‘‘(4) the term ‘Secretary’ means the Secretary 17
451451 of Homeland Security, in consultation with the At-18
452452 torney General.’’. 19

537537 FFECTIVEDATE.—The amendments made by 14
538538 this section shall take effect on the date of the enactment 15
539539 of this Act and shall apply to acts that occur before, on, 16
540540 or after the date of the enactment of this Act. 17
