REFERENCES. 6 Except as expressly provided otherwise, any reference 7 to ‘‘this Act’’ contained in any division of this Act shall 8 be treated as referring only to the provisions of that divi-9 sion. 10 DIVISION A—CONTINUING 11 APPROPRIATIONS ACT, 2025 12 The following sums are hereby appropriated, out of 13 any money in the Treasury not otherwise appropriated, 14 and out of applicable corporate or other revenues, receipts, 15 and funds, for the several departments, agencies, corpora-16 tions, and other organizational units of Government for 17 fiscal year 2025, and for other purposes, namely: 18 3 •HR 9747 EH SEC. 101. Such amounts as may be necessary, at a 1 rate for operations as provided in the applicable appro-2 priations Acts for fiscal year 2024 and under the authority 3 and conditions provided in such Acts, for continuing 4 projects or activities (including the costs of direct loans 5 and loan guarantees) that are not otherwise specifically 6 provided for in this Act, that were conducted in fiscal year 7 2024, and for which appropriations, funds, or other au-8 thority were made available in the following appropriations 9 Acts: 10 (1) The Agriculture, Rural Development, Food 11 and Drug Administration, and Related Agencies Ap-12 propriations Act, 2024 (division B of Public Law 13 118–42). 14 (2) The Commerce, Justice, Science, and Re-15 lated Agencies Appropriations Act, 2024 (division C 16 of Public Law 118–42). 17 (3) The Department of Defense Appropriations 18 Act, 2024 (division A of Public Law 118–47). 19 (4) The Energy and Water Development and 20 Related Agencies Appropriations Act, 2024 (division 21 D of Public Law 118–42). 22 (5) The Financial Services and General Govern-23 ment Appropriations Act, 2024 (division B of Public 24 Law 118–47), except sections 637 and 638. 25 4 •HR 9747 EH (6) The Department of Homeland Security Ap-1 propriations Act, 2024 (division C of Public Law 2 118–47), except section 546(e), and including sec-3 tions 102 through 105 of title I of division G of 4 Public Law 118–47. 5 (7) The Department of the Interior, Environ-6 ment, and Related Agencies Appropriations Act, 7 2024 (division E of Public Law 118–42), except sec-8 tion 447. 9 (8) The Departments of Labor, Health and 10 Human Services, and Education, and Related Agen-11 cies Appropriations Act, 2024 (division D of Public 12 Law 118–47). 13 (9) The Legislative Branch Appropriations Act, 14 2024 (division E of Public Law 118–47), except the 15 matter under the heading ‘‘Joint Items—Joint Con-16 gressional Committee on Inaugural Ceremonies of 17 2025’’, and including section 7 in the matter pre-18 ceding division A of Public Law 118–47. 19 (10) The Military Construction, Veterans Af-20 fairs, and Related Agencies Appropriations Act, 21 2024 (division A of Public Law 118–42), except sec-22 tion 259. 23 (11) The Department of State, Foreign Oper-24 ations, and Related Programs Appropriations Act, 25 5 •HR 9747 EH 2024 (division F of Public Law 118–47), except sec-1 tion 7075(a). 2 (12) The Transportation, Housing and Urban 3 Development, and Related Agencies Appropriations 4 Act, 2024 (division F of Public Law 118–42). 5 S EC. 102. (a) No appropriation or funds made avail-6 able or authority granted pursuant to section 101 for the 7 Department of Defense shall be used for: 8 (1) the new production of items not funded for pro-9 duction in fiscal year 2024 or prior years; 10 (2) the increase in production rates above those sus-11 tained with fiscal year 2024 funds; or 12 (3) the initiation, resumption, or continuation of any 13 project, activity, operation, or organization (defined as any 14 project, subproject, activity, budget activity, program ele-15 ment, and subprogram within a program element, and for 16 any investment items defined as a P–1 line item in a budg-17 et activity within an appropriation account and an R–1 18 line item that includes a program element and subprogram 19 element within an appropriation account) for which appro-20 priations, funds, or other authority were not available dur-21 ing fiscal year 2024. 22 (b) No appropriation or funds made available or au-23 thority granted pursuant to section 101 for the Depart-24 ment of Defense shall be used to initiate multi-year pro-25 6 •HR 9747 EH curements utilizing advance procurement funding for eco-1 nomic order quantity procurement unless specifically ap-2 propriated later. 3 S EC. 103. Appropriations made by section 101 shall 4 be available to the extent and in the manner that would 5 be provided by the pertinent appropriations Act. 6 S EC. 104. Except as otherwise provided in section 7 102, no appropriation or funds made available or author-8 ity granted pursuant to section 101 shall be used to ini-9 tiate or resume any project or activity for which appro-10 priations, funds, or other authority were not available dur-11 ing fiscal year 2024. 12 S EC. 105. Appropriations made and authority grant-13 ed pursuant to this Act shall cover all obligations or ex-14 penditures incurred for any project or activity during the 15 period for which funds or authority for such project or 16 activity are available under this Act. 17 S EC. 106. Unless otherwise provided for in this Act 18 or in the applicable appropriations Act for fiscal year 19 2025, appropriations and funds made available and au-20 thority granted pursuant to this Act shall be available 21 until whichever of the following first occurs: 22 (1) The enactment into law of an appropriation 23 for any project or activity provided for in this Act. 24 7 •HR 9747 EH (2) The enactment into law of the applicable 1 appropriations Act for fiscal year 2025 without any 2 provision for such project or activity. 3 (3) December 20, 2024. 4 S EC. 107. Expenditures made pursuant to this Act 5 shall be charged to the applicable appropriation, fund, or 6 authorization whenever a bill in which such applicable ap-7 propriation, fund, or authorization is contained is enacted 8 into law. 9 S EC. 108. Appropriations made and funds made 10 available by or authority granted pursuant to this Act may 11 be used without regard to the time limitations for submis-12 sion and approval of apportionments set forth in section 13 1513 of title 31, United States Code, but nothing in this 14 Act may be construed to waive any other provision of law 15 governing the apportionment of funds. 16 S EC. 109. Notwithstanding any other provision of 17 this Act, except section 106, for those programs that 18 would otherwise have high initial rates of operation or 19 complete distribution of appropriations at the beginning 20 of fiscal year 2025 because of distributions of funding to 21 States, foreign countries, grantees, or others, such high 22 initial rates of operation or complete distribution shall not 23 be made, and no grants shall be awarded for such pro-24 8 •HR 9747 EH grams funded by this Act that would impinge on final 1 funding prerogatives. 2 S EC. 110. This Act shall be implemented so that only 3 the most limited funding action of that permitted in the 4 Act shall be taken in order to provide for continuation of 5 projects and activities. 6 S EC. 111. (a) For entitlements and other mandatory 7 payments whose budget authority was provided in appro-8 priations Acts for fiscal year 2024, and for activities under 9 the Food and Nutrition Act of 2008, activities shall be 10 continued at the rate to maintain program levels under 11 current law, under the authority and conditions provided 12 in the applicable appropriations Act for fiscal year 2024, 13 to be continued through the date specified in section 14 106(3). 15 (b) Notwithstanding section 106, obligations for man-16 datory payments due on or about the first day of any 17 month that begins after October 2024 but not later than 18 30 days after the date specified in section 106(3) may con-19 tinue to be made, and funds shall be available for such 20 payments. 21 S EC. 112. Amounts made available under section 101 22 for civilian personnel compensation and benefits in each 23 department and agency may be apportioned up to the rate 24 for operations necessary to avoid furloughs within such de-25 9 •HR 9747 EH partment or agency, consistent with the applicable appro-1 priations Act for fiscal year 2024, except that such author-2 ity provided under this section shall not be used until after 3 the department or agency has taken all necessary actions 4 to reduce or defer non-personnel-related administrative ex-5 penses. 6 S EC. 113. Funds appropriated by this Act may be 7 obligated and expended notwithstanding section 10 of 8 Public Law 91–672 (22 U.S.C. 2412), section 15 of the 9 State Department Basic Authorities Act of 1956 (22 10 U.S.C. 2680), section 313 of the Foreign Relations Au-11 thorization Act, Fiscal Years 1994 and 1995 (22 U.S.C. 12 6212), and section 504(a)(1) of the National Security Act 13 of 1947 (50 U.S.C. 3094(a)(1)). 14 S EC. 114. (a) Each amount incorporated by reference 15 in this Act that was previously designated by the Congress 16 as an emergency requirement pursuant to section 17 251(b)(2)(A)(i) of the Balanced Budget and Emergency 18 Deficit Control Act of 1985 or as being for disaster relief 19 pursuant to section 251(b)(2)(D) of such Act is des-20 ignated by the Congress as an emergency requirement 21 pursuant to section 251(b)(2)(A)(i) of such Act or as 22 being for disaster relief pursuant to section 251(b)(2)(D) 23 of such Act, respectively. 24 10 •HR 9747 EH (b) Section 6 of Public Laws 118–42 and 118–47 1 shall apply to amounts designated in subsection (a) and 2 sections 138, 140, and 151 of this Act as an emergency 3 requirement. 4 (c) Each amount incorporated by reference in this 5 Act that was previously designated in division B of Public 6 Law 117–159, division J of Public Law 117–58, or in sec-7 tion 443(b) of division G of Public Law 117–328 by the 8 Congress as an emergency requirement pursuant to a con-9 current resolution on the budget shall continue to be treat-10 ed as an amount specified in section 103(b) of division 11 A of Public Law 118–5. 12 (d) This section shall become effective immediately 13 upon enactment of this Act, and shall remain in effect 14 through the date in section 106(3). 15 S EC. 115. (a) Rescissions or cancellations of discre-16 tionary budget authority that continue pursuant to section 17 101 in Treasury Appropriations Fund Symbols (TAFS)— 18 (1) to which other appropriations are not provided 19 by this Act, but for which there is a current applicable 20 TAFS that does receive an appropriation in this Act; or 21 (2) which are no-year TAFS and receive other appro-22 priations in this Act, may be continued instead by reduc-23 ing the rate for operations otherwise provided by section 24 101 for such current applicable TAFS, as long as doing 25 11 •HR 9747 EH so does not impinge on the final funding prerogatives of 1 the Congress. 2 (b) Rescissions or cancellations described in sub-3 section (a) shall continue in an amount equal to the lesser 4 of— 5 (1) the amount specified for rescission or cancellation 6 in the applicable appropriations Act referenced in section 7 101 of this Act; or 8 (2) the amount of balances available, as of October 9 1, 2024, from the funds specified for rescission or can-10 cellation in the applicable appropriations Act referenced 11 in section 101 of this Act. 12 (c) No later than November 18, 2024, the Director 13 of the Office of Management and Budget shall provide to 14 the Committees on Appropriations of the House of Rep-15 resentatives and the Senate a comprehensive list of the 16 rescissions or cancellations that will continue pursuant to 17 section 101: Provided, That the information in such com-18 prehensive list shall be periodically updated to reflect any 19 subsequent changes in the amount of balances available, 20 as of October 1, 2024, from the funds specified for rescis-21 sion or cancellation in the applicable appropriations Act 22 referenced in section 101, and such updates shall be trans-23 mitted to the Committees on Appropriations of the House 24 of Representatives and the Senate upon request. 25 12 •HR 9747 EH SEC. 116. Amounts made available by section 101 for 1 ‘‘Farm Service Agency—Agricultural Credit Insurance 2 Fund Program Account’’ may be apportioned up to the 3 rate for operations necessary to accommodate approved 4 applications for direct and guaranteed farm ownership 5 loans, as authorized by 7 U.S.C. 1922 et seq., and direct 6 farm operating loans, as authorized by 7 U.S.C. 1941 et 7 seq. 8 S EC. 117. Amounts made available by section 101 for 9 ‘‘Rural Housing Service—Rural Community Facilities 10 Program Account’’ may be apportioned up to the rate for 11 operations necessary to maintain activities as authorized 12 by section 306 and described in section 381E(d)(1) of the 13 Consolidated Farm and Rural Development Act. 14 S EC. 118. Amounts made available by section 101 for 15 ‘‘Domestic Food Programs—Food and Nutrition Serv-16 ice—Special Supplemental Nutrition Program for Women, 17 Infants, and Children (WIC)’’ may be apportioned at the 18 rate for operations necessary to maintain participation. 19 S EC. 119. Amounts made available by section 101 for 20 ‘‘Domestic Food Programs—Food and Nutrition Serv-21 ice—Commodity Assistance Program’’ may be appor-22 tioned up to the rate for operations necessary to maintain 23 current program caseload in the Commodity Supplemental 24 Food Program. 25 13 •HR 9747 EH SEC. 120. Section 260 of the Agricultural Marketing 1 Act of 1946 (7 U.S.C. 1636i) and section 942 of the Live-2 stock Mandatory Reporting Act of 1999 (7 U.S.C. 1635 3 note; Public Law 106–78) shall be applied by substituting 4 the date specified in section 106(3) of this Act for ‘‘Sep-5 tember 30, 2024’’. 6 S EC. 121. During the period covered by this Act, sec-7 tion 235(b) of the Sentencing Reform Act of 1984 (18 8 U.S.C. 3551 note; Public Law 98–473; 98 Stat. 2032), 9 as such section relates to chapter 311 of title 18, United 10 States Code, and the United States Parole Commission, 11 shall be applied by substituting ‘‘37’’ for ‘‘36’’ each place 12 it appears. 13 S EC. 122. Notwithstanding section 104, amounts 14 made available by section 101 for ‘‘Corps of Engineers— 15 Civil—Operation and Maintenance’’ may be used up to an 16 amount not to exceed $37,600,000, adjusted for inflation 17 beginning August 1, 2024, to provide compensation for re-18 serving and operating 3.6 million acre-feet of pre-planned 19 flood storage at Hugh Keenleyside Dam to minimize the 20 flood risk in the Columbia River Basin in the United 21 States. 22 S EC. 123. During the period covered by this Act, sec-23 tion 3 of Public Law 106–392 shall be applied by sub-24 stituting ‘‘2025’’ for ‘‘2024’’ each place it appears. 25 14 •HR 9747 EH SEC. 124. Notwithstanding section 106, for the dura-1 tion of fiscal year 2025, amounts made available under 2 section 601(f)(3) of the Social Security Act (42 U.S.C. 3 801(f)(3)) shall be available for any necessary expenses 4 of the Department of the Treasury Office of Inspector 5 General with respect to section 601 of such Act, subtitle 6 A of title V of division N of the Consolidated Appropria-7 tions Act of 2021, or section 3201 of the American Rescue 8 Plan Act of 2021, in addition to amounts otherwise avail-9 able for such purposes. 10 S EC. 125. Notwithstanding section 101, for ‘‘Execu-11 tive Office of the President—Office of Administration— 12 Presidential Transition Administrative Support’’, there is 13 appropriated $25,000,000 for an additional amount for 14 fiscal year 2025, to remain available until September 30, 15 2025, to carry out the Presidential Transition Act of 1963 16 (3 U.S.C. 102 note) and similar expenses, in addition to 17 amounts otherwise available for such purposes: Provided, 18 That such funds may be transferred to other accounts (in-19 cluding other agencies) that provide support to offices 20 within the Executive Office of the President and the Office 21 of the Vice President, to carry out such purposes, includ-22 ing to reimburse obligations incurred prior to the enact-23 ment of this Act for such purposes. 24 15 •HR 9747 EH SEC. 126. In addition to amounts otherwise provided 1 by section 101, amounts are provided for ‘‘District of Co-2 lumbia—Federal Payment for Emergency Planning and 3 Security Costs in the District of Columbia’’ at a rate for 4 operations of $47,000,000, for an additional amount for 5 costs associated with the Presidential Inauguration to be 6 held in January 2025: Provided, That such amounts may 7 be apportioned up to the rate for operations necessary to 8 maintain emergency planning and security activities relat-9 ing to such Presidential Inauguration. 10 S EC. 127. (a) The matter preceding the first proviso 11 under the heading ‘‘Federal Payment to the District of 12 Columbia Public Defender Service’’ in division B of Public 13 Law 118–47 is amended by striking ‘‘, for costs associated 14 with relocation under a replacement lease for headquarters 15 offices, field offices, and related facilities’’. 16 (b)(1) Subject to paragraph (2), subsection (a) shall 17 become effective immediately upon enactment of this Act. 18 (2) If this Act is enacted after September 30, 2024, 19 subsection (a) shall be applied as if it were in effect on 20 September 30, 2024. 21 (c) Notwithstanding section 101, the matter pre-22 ceding the first proviso under the heading ‘‘Federal Pay-23 ment to the District of Columbia Public Defender Service’’ 24 in division B of Public Law 118–47, as amended by sub-25 16 •HR 9747 EH section (a), shall be applied as if ‘‘, of which $3,000,000 1 shall remain available until September 30, 2026’’ were 2 struck. 3 S EC. 128. Notwithstanding any other provision of 4 this Act, except section 106, the District of Columbia may 5 expend local funds made available under the heading ‘‘Dis-6 trict of Columbia—District of Columbia Funds’’ for such 7 programs and activities under the District of Columbia 8 Appropriations Act, 2024 (title IV of division B of Public 9 Law 118–47) at the rate set forth in the Fiscal Year 2025 10 Local Budget Act of 2024 (D.C. Act 25–501), as modified 11 as of the date of enactment of this Act. 12 S EC. 129. (a) Notwithstanding section 101, for ‘‘Gen-13 eral Services Administration—Expenses, Presidential 14 Transition’’, there is appropriated $19,424,177, for an ad-15 ditional amount for fiscal year 2025, to remain available 16 until September 30, 2025, for necessary expenses to carry 17 out the Presidential Transition Act of 1963 (3 U.S.C. 102 18 note), of which $14,443,726 is available for activities au-19 thorized by sections 3(a)(1) through 3(a)(7) and 3(a)(10) 20 of such Act; $2,980,451 is available for activities author-21 ized by section 5 of such Act; and $2,000,000 is available 22 for activities authorized by sections 3(a)(8) and 3(a)(9) 23 of such Act: Provided, That if there are two or more pos-24 sible apparent successful candidates, each such candidate, 25 17 •HR 9747 EH with the exception of the incumbent President, is entitled 1 to a proportional share of the appropriations made avail-2 able for activities authorized by sections 3(a)(1) through 3 3(a)(7) and 3(a)(10) and sections 3(a)(8) and 3(a)(9) of 4 such Act: Provided further, That no apparent successful 5 candidate shall receive more than $7,221,863 for activities 6 authorized by sections 3(a)(1) through 3(a)(7) and 7 3(a)(10) of such Act and $1,000,000 for activities author-8 ized by sections 3(a)(8) and 3(a)(9) of such Act: Provided 9 further, That such amounts may be transferred and cred-10 ited to the ‘‘Acquisition Services Fund’’ or the ‘‘Federal 11 Buildings Fund’’ to reimburse obligations incurred prior 12 to enactment of this Act for the purposes provided herein 13 related to the Presidential election in 2024: Provided fur-14 ther, That in the case of two or more possible apparent 15 successful candidates, after a sole apparent successful can-16 didate is determined, the remaining funds allotted to any 17 unsuccessful candidate shall be permanently rescinded: 18 Provided further, That amounts available under this sec-19 tion shall be in addition to any other amounts available 20 for such purposes. 21 (b) Notwithstanding section 101, no funds are pro-22 vided by this Act for ‘‘General Services Administration— 23 Pre-Election Presidential Transition’’. 24 18 •HR 9747 EH SEC. 130. In addition to amounts otherwise provided 1 by section 101, for ‘‘National Archives and Records Ad-2 ministration—Operating Expenses’’, there is appropriated 3 $23,000,000, for an additional amount for fiscal year 4 2025, to remain available until September 30, 2025, to 5 carry out transition responsibilities of the Archivist of the 6 United States under sections 2201 through 2209 of title 7 44, United States Code (commonly known as the ‘‘Presi-8 dential Records Act of 1978’’), in addition to amounts oth-9 erwise available for such purposes. 10 S EC. 131. Notwithstanding section 101, the matter 11 preceding the first proviso under the heading ‘‘Office of 12 Personnel Management—Salaries and Expenses’’ in divi-13 sion B of Public Law 118–47 shall be applied by sub-14 stituting ‘‘$190,784,000’’ for ‘‘$219,076,000’’ and the 15 second proviso under such heading in such division of such 16 Act shall be applied by substituting ‘‘$245,267,000’’ for 17 ‘‘$192,975,000’’. 18 S EC. 132. Notwithstanding section 104, amounts 19 made available by section 101 to the Department of 20 Homeland Security for ‘‘Coast Guard—Procurement, 21 Construction, and Improvements’’ may be used for close-22 out costs relating to the C–27J missionization program. 23 S EC. 133. During the period covered by this Act, sec-24 tion 11223(b)(2) of division K of Public Law 117–263 25 19 •HR 9747 EH shall be applied by substituting ‘‘shall not apply’’ for 1 ‘‘shall apply’’. 2 S EC. 134. Amounts made available by section 101 to 3 the Department of Homeland Security under the heading 4 ‘‘Federal Emergency Management Agency—Disaster Re-5 lief Fund’’ may be apportioned up to the rate for oper-6 ations necessary to carry out response and recovery activi-7 ties under the Robert T. Stafford Disaster Relief and 8 Emergency Assistance Act (42 U.S.C. 5121 et seq.). 9 S EC. 135. Amounts made available by section 101 to 10 the Department of Homeland Security for ‘‘United States 11 Secret Service—Operations and Support’’ may be appor-12 tioned up to the rate for operations necessary to carry out 13 protective operations, including activities related to Na-14 tional Special Security Events and the 2024 Presidential 15 Campaign. 16 S EC. 136. In addition to amounts otherwise provided 17 by section 101, there is appropriated to the Department 18 of Homeland Security for ‘‘United States Secret Service— 19 Operations and Support’’, $231,000,000, for an additional 20 amount for fiscal year 2025, to remain available until Sep-21 tember 30, 2025, for operations necessary to carry out 22 protective operations including the 2024 Presidential 23 Campaign and National Special Security Events: Pro-24 vided, That not later than 30 days after the date of enact-25 20 •HR 9747 EH ment of this Act, the Director of the United States Secret 1 Service shall provide to the Committees on Appropriations 2 of the House of Representatives and the Senate an ex-3 penditure plan that identifies, by program, project, and 4 activity, the funding obligated for the purposes specified 5 in this section with amounts for ‘‘Operations and Sup-6 port’’ in this Act and shall provide to the Committees 7 monthly reports on the execution of such expenditure plan: 8 Provided further, That such amounts may not be obligated 9 until the Secretary of the Department of Homeland Secu-10 rity transmits to the House of Representatives Task Force 11 on the Attempted Assassination of Donald J. Trump and 12 the Senate Committee on Homeland Security and Govern-13 mental Affairs the Mission Assurance Report: Provided 14 further, That within 15 days of enactment of this Act, the 15 Secretary of the Department of Homeland Security shall 16 provide to the House of Representatives Task Force on 17 the Attempted Assassination of Donald J. Trump all ma-18 terials responsive to such Task Force’s letters transmitted 19 on August 12, 2024, and August 28, 2024: Provided fur-20 ther, That the Director of the Secret Service shall respond 21 in a timely manner to oversight inquiries (including re-22 quests for documents, information, and testimony from 23 any Secret Service personnel) on protective operations 24 funded in this Act or in Public Law 118–47 from the 25 21 •HR 9747 EH House of Representatives Task Force on the Attempted 1 Assassination of Donald J. Trump; the Committees on 2 Appropriations, Homeland Security, Oversight and Ac-3 countability, and Judiciary of the House of Representa-4 tives; and the Committees on Appropriations, Judiciary, 5 and Homeland Security and Governmental Affairs of the 6 Senate, or any subcommittees thereof: Provided further, 7 That responses shall be considered timely if provided on 8 or before the deadline specified by the requesting com-9 mittee or subcommittee. 10 S EC. 137. (a) Sections 1309(a) and 1319 of the Na-11 tional Flood Insurance Act of 1968 (42 U.S.C. 4016(a) 12 and 4026) shall be applied by substituting the date speci-13 fied in section 106(3) of this Act for ‘‘September 30, 14 2023’’. 15 (b)(1) Subject to paragraph (2), this section shall be-16 come effective immediately upon enactment of this Act. 17 (2) If this Act is enacted after September 30, 2024, 18 this section shall be applied as if it were in effect on Sep-19 tember 30, 2024. 20 S EC. 138. (a) During the period covered by this Act, 21 section 104 of the Hermit’s Peak/Calf Canyon Fire Assist-22 ance Act (division G of Public Law 117–180) shall be ap-23 plied by substituting the date specified in section 106(3) 24 of this Act for ‘‘2 years after the date on which regulations 25 22 •HR 9747 EH are first promulgated under subsection (f)’’, and ‘‘May 31, 1 2024’’. 2 (b) Amounts repurposed pursuant to this section that 3 were previously designated by the Congress as an emer-4 gency requirement pursuant to the Balanced Budget and 5 Emergency Deficit Control Act of 1985 or a concurrent 6 resolution on the budget are designated as an emergency 7 requirement pursuant to section 251(b)(2)(A)(i) of the 8 Balanced Budget and Emergency Deficit Control Act of 9 1985. 10 S EC. 139. In addition to amounts otherwise provided 11 by section 101, amounts are provided for ‘‘Department of 12 the Interior—National Park Service—Operation of the 13 National Park System’’ at a rate for operations of 14 $5,000,000, for an additional amount for security and vis-15 itor safety activities related to the Presidential Inaugural 16 Ceremonies. 17 S EC. 140. (a) Funds previously made available in the 18 Further Additional Supplemental Appropriations for Dis-19 aster Relief Requirements Act, 2018 (subdivision 1 of divi-20 sion B of Public Law 115–123) for the ‘‘National Park 21 Service—Historic Preservation Fund’’ that were available 22 for obligation through fiscal year 2019 are to remain avail-23 able through fiscal year 2026 for the liquidation of valid 24 obligations incurred in fiscal years 2018 and 2019: Pro-25 23 •HR 9747 EH vided, That amounts repurposed pursuant to this section 1 that were previously designated by the Congress as an 2 emergency requirement pursuant to the Balanced Budget 3 and Emergency Deficit Control Act of 1985 are des-4 ignated as an emergency requirement pursuant to section 5 251(b)(2)(A)(i) of the Balanced Budget and Emergency 6 Deficit Control Act of 1985. 7 (b)(1) Subject to paragraph (2), this section shall be-8 come effective immediately upon enactment of this Act. 9 (2) If this Act is enacted after September 30, 2024, 10 this section shall be applied as if it were in effect on Sep-11 tember 30, 2024. 12 S EC. 141. Amounts made available by section 101 for 13 ‘‘Department of Agriculture—Forest Service—Wildland 14 Fire Management’’ may be apportioned up to the rate for 15 operations necessary for wildfire suppression activities. 16 S EC. 142. (a) In addition to amounts otherwise pro-17 vided by section 101, amounts are provided for ‘‘Depart-18 ment of Health and Human Services—Indian Health 19 Service—Indian Health Services’’ at a rate for operations 20 of $24,262,000, for an additional amount for costs of 21 staffing and operating facilities that were opened, ren-22 ovated, or expanded in fiscal years 2024 and 2025, and 23 such amounts may be apportioned up to the rate for oper-24 ations necessary to staff and operate such facilities. 25 24 •HR 9747 EH (b) In addition to amounts otherwise provided by sec-1 tion 101, amounts are provided for ‘‘Department of 2 Health and Human Services—Indian Health Service—In-3 dian Health Facilities’’ at a rate for operations of 4 $2,060,000, for an additional amount for costs of staffing 5 and operating facilities that were opened, renovated, or ex-6 panded in fiscal years 2024 and 2025, and such amounts 7 may be apportioned up to the rate for operations necessary 8 to staff and operate such facilities. 9 S EC. 143. During the period covered by this Act, sec-10 tion 113 of division G of Public Law 113–76, as amended 11 by Public Law 116–6, shall be applied by substituting 12 ‘‘2025’’ for ‘‘2024’’. 13 S EC. 144. In addition to amounts otherwise provided 14 by section 101, amounts are provided for ‘‘Department of 15 Labor—Bureau of Labor Statistics—Salaries and Ex-16 penses’’ at a rate for operations of $6,000,000, for an ad-17 ditional amount for the Current Population Survey. 18 S EC. 145. Activities authorized by part A of title IV 19 (other than under section 403(c) or 418) and section 20 1108(b) of the Social Security Act shall continue through 21 the date specified in section 106(3), in the manner author-22 ized for fiscal year 2024, and out of any money in the 23 Treasury of the United States not otherwise appropriated, 24 25 •HR 9747 EH there are hereby appropriated such sums as may be nec-1 essary for such purpose. 2 S EC. 146. Notwithstanding any other provision of 3 this Act, there is appropriated— 4 (1) for payment to the heirs at law of Sheila 5 Jackson Lee, late a Representative from the State of 6 Texas, $174,000; 7 (2) for payment to Elsie M. Pascrell, widow of 8 William Pascrell, Jr., late a Representative from the 9 State of New Jersey, $174,000; and 10 (3) for payment to Beatrice Y. Payne, widow of 11 Donald M. Payne, Jr., late a Representative from 12 the State of New Jersey, $174,000. 13 S EC. 147. Notwithstanding sections 102 and 104, 14 amounts made available by section 101 to the Department 15 of Defense for ‘‘Military Construction, Navy’’ may be used 16 by the Secretary of the Navy to carry out military con-17 struction not otherwise authorized by law for a Trident 18 Refit Facility project at Naval Submarine Base Kings 19 Bay. 20 S EC. 148. Notwithstanding section 101, section 126 21 of division A of Public Law 118–42 shall be applied by 22 substituting ‘‘fiscal year 2017, 2018, 2019, and 2020’’ for 23 ‘‘fiscal year 2017, 2018, and 2019’’. 24 26 •HR 9747 EH SEC. 149. (a) The remaining unobligated balances as 1 of September 30, 2024, from amounts made available 2 until September 30, 2024, for ‘‘Departmental Administra-3 tion—Construction, Major Projects’’ in title II of division 4 F of the Further Consolidated Appropriations Act, 2020 5 (Public Law 116–94) are hereby rescinded, and in addi-6 tion to amounts otherwise provided by section 101, an 7 amount of additional new budget authority equivalent to 8 the amount rescinded pursuant to this section is hereby 9 appropriated on September 30, 2024, for an additional 10 amount for fiscal year 2024, to remain available until Sep-11 tember 30, 2029, and shall be available for the same pur-12 poses and under the same authorities provided under such 13 heading in Public Law 116–94, in addition to other funds 14 as may be available for such purposes. 15 (b)(1) Subject to paragraph (2), this section shall be-16 come effective immediately upon enactment of this Act. 17 (2) If this Act is enacted after September 30, 2024, 18 this section shall be applied as if it were in effect on Sep-19 tember 30, 2024. 20 S EC. 150. Amounts made available by section 101 for 21 ‘‘Department of Transportation—Office of the Sec-22 retary—Payments to Air Carriers’’ may be apportioned up 23 to the rate for operations necessary to maintain Essential 24 Air Service program operations. 25 27 •HR 9747 EH SEC. 151. During the period covered by this Act, the 1 Secretary of Housing and Urban Development may use 2 the unobligated balances of amounts made available in 3 prior fiscal years in the second paragraph under the head-4 ing ‘‘Department of Housing and Urban Development— 5 Public and Indian Housing—Tenant-Based Rental Assist-6 ance’’ to support additional allocations under subpara-7 graph (D) of paragraph (1) and subparagraph (B) of 8 paragraph (4) of such heading to prevent the termination 9 of rental assistance for families as a result of insufficient 10 funding in the calendar year 2024 funding cycle: Provided, 11 That amounts repurposed pursuant to this section that 12 were previously designated by the Congress as an emer-13 gency requirement pursuant to a concurrent resolution on 14 the budget or the Balanced Budget and Emergency Def-15 icit Control Act of 1985 are designated by the Congress 16 as being for an emergency requirement pursuant to sec-17 tion 251(b)(2)(A)(i) of the Balanced Budget and Emer-18 gency Deficit Control Act of 1985. 19 S EC. 152. During the period covered by this Act, sec-20 tion 517 of title 10, United States Code, shall not apply 21 with respect to the Coast Guard. 22 This division may be cited as the ‘‘Continuing Appro-23 priations Act, 2025’’. 24 28 •HR 9747 EH DIVISION B—EXTENSIONS 1 TITLE I—MISCELLANEOUS 2 EXTENSIONS 3 SEC. 101. NATIONAL CYBERSECURITY PROTECTION SYS-14 TEM AUTHORIZATION. 15 Section 227(a) of the Federal Cybersecurity En-16 hancement Act of 2015 (6 U.S.C. 1525(a)) is amended 17 by striking ‘‘September 30, 2024’’ and inserting ‘‘Decem-18 ber 20, 2024’’. 19 SEC. 104. CHESAPEAKE AND OHIO CANAL NATIONAL HIS-20 TORICAL PARK COMMISSION. 21 Section 6(g) of the Chesapeake and Ohio Canal De-22 velopment Act (16 U.S.C. 410y–4(g)) is amended by strik-23 ing ‘‘40’’ and all that follows through the period at the 24 end and inserting ‘‘on December 20, 2024.’’. 25 29 •HR 9747 EH SEC. 105. EBT BENEFIT FRAUD PREVENTION. 1 Section 501 of division HH of the Consolidated Ap-2 propriations Act, 2023 (7 U.S.C. 2016a), is amended— 3 (1) in subsection (a)— 4 (A) in paragraph (4)(A)(iii), by striking 5 ‘‘to the maximum extent practicable,’’; and 6 (B) in paragraph (5)— 7 (i) in the matter preceding subpara-8 graph (A), by striking ‘‘October’’ and in-9 serting ‘‘December’’; 10 (ii) in subparagraph (A), by striking 11 ‘‘to the maximum extent practicable,’’; 12 (iii) in subparagraph (C), by striking 13 ‘‘and’’ at the end; 14 (iv) by redesignating subparagraph 15 (D) as subparagraph (E); 16 (v) by inserting after subparagraph 17 (C) the following: 18 ‘‘(D) a comparison of State plans related 19 to reimbursement, prevention, and other rel-20 evant procedures approved in accordance with 21 subsection (b)(1)(A); and’’; and 22 (vi) in subparagraph (E) (as so redes-23 ignated), by inserting ‘‘and proactively’’ 24 after ‘‘consistently’’; 25 30 •HR 9747 EH (2) in subsection (b)(2)(C), by striking ‘‘Sep-1 tember 30, 2024’’ and inserting ‘‘December 20, 2 2024’’; and 3 (3) by adding at the end the following: 4 ‘‘(e) C OMPTROLLERGENERAL.— 5 ‘‘(1) I N GENERAL.—Not later than 1 year after 6 the date of enactment of this subsection, the Comp-7 troller General of the United States shall submit to 8 the Committee on Agriculture of the House of Rep-9 resentatives and the Committee on Agriculture, Nu-10 trition, and Forestry of the Senate a report that ex-11 amines risks related to supplemental nutrition as-12 sistance program electronic benefit transfer payment 13 system security, including the risk of stolen benefits 14 through card skimming, card cloning, and other 15 similar methods. 16 ‘‘(2) C ONTENTS.—The report under paragraph 17 (1) shall include an assessment of— 18 ‘‘(A) the extent to which the Department 19 of Agriculture manages payment system secu-20 rity, including risks related to stolen benefits, 21 compared to leading industry practices; 22 ‘‘(B) the manner in which States, retailers, 23 and other relevant entities manage risks related 24 to stolen benefits; 25 31 •HR 9747 EH ‘‘(C) the oversight of and guidance pro-1 vided by the Secretary to States regarding sto-2 len benefits; and 3 ‘‘(D) recommendations and policy options 4 for— 5 ‘‘(i) improving how the Department of 6 Agriculture and other relevant entities 7 manage payment system security risks, in-8 cluding those related to stolen benefits; 9 and 10 ‘‘(ii) how the Department of Agri-11 culture may best share those improvements 12 with States, retailers, and other relevant 13 entities.’’. 14 SEC. 106. EXTENSION OF FOREST SERVICE PARTICIPATION 15 IN ACES PROGRAM. 16 Section 8302(b) of the Agricultural Act of 2014 (16 17 U.S.C. 3851a(b)) shall be applied by substituting ‘‘1 day 18 after December 20, 2024’’ for ‘‘October 1, 2023’’. 19 SEC. 107. EXTENSION OF GOOD NEIGHBOR AUTHORITY. 20 Section 8206(b)(2)(C)(ii) of the Agricultural Act of 21 2014 (16 U.S.C. 2113a(b)(2)(C)(ii)) shall be applied by 22 substituting ‘‘1 day after December 20, 2024’’ for ‘‘Octo-23 ber 1, 2024’’. 24 32 •HR 9747 EH SEC. 108. TEMPORARY EXTENSION OF FOOD FOR PEACE 1 ACT. 2 The authorities provided by each provision of the 3 Food for Peace Act (7 U.S.C. 1691 et seq.), as in effect 4 on September 30, 2024, shall remain in effect through De-5 cember 20, 2024. 6 SEC. 109. OVERSEAS PAY COMPARABILITY AND LIMITA-7 TION. 8 (a) I NGENERAL.—The authority provided under sec-9 tion 1113 of the Supplemental Appropriations Act, 2009 10 (Public Law 111–32; 123 Stat. 1904) shall remain in ef-11 fect through December 20, 2024. 12 (b) L IMITATION.—The authority described in sub-13 section (a) may not be used to pay an eligible member 14 of the Foreign Service (as defined in section 1113(b) of 15 the Supplemental Appropriations Act, 2009 (Public Law 16 111–32; 123 Stat. 1904)) a locality-based comparability 17 payment (stated as a percentage) that exceeds two-thirds 18 of the amount of the locality-based comparability payment 19 (stated as a percentage) that would be payable to such 20 member under section 5304 of title 5, United States Code, 21 if such member’s official duty station were in the District 22 of Columbia. 23 33 •HR 9747 EH SEC. 110. NO SURPRISES ACT IMPLEMENTATION FUNDING. 14 Section 118(a) of title I of division BB of the Consoli-15 dated Appropriations Act, 2021 (Public Law 116–260) is 16 amended by striking ‘‘through 2024’’ and inserting 17 ‘‘through September 30, 2025’’. 18 Subtitle B—Medicaid 19 SEC. 211.
