32-The following sums are hereby appropriated, out of any money
33-in the Treasury not otherwise appropriated, and out of applicable
34-corporate or other revenues, receipts, and funds, for the several
35-departments, agencies, corporations, and other organizational units
36-of Government for fiscal year 2025, and for other purposes, namely:

40+rate for operations as provided in the applicable appro-2
41+priations Acts for fiscal year 2024 and under the authority 3
42+and conditions provided in such Acts, for continuing 4
43+projects or activities (including the costs of direct loans 5
44+and loan guarantees) that are not otherwise specifically 6
45+provided for in this Act, that were conducted in fiscal year 7
46+2024, and for which appropriations, funds, or other au-8
47+thority were made available in the following appropriations 9

43-specifically provided for in this Act, that were conducted in fiscal
44-year 2024, and for which appropriations, funds, or other authority

97+EC. 102. (a) No appropriation or funds made avail-6
98+able or authority granted pursuant to section 101 for the 7
99+Department of Defense shall be used for: 8
100+(1) the new production of items not funded for pro-9
101+duction in fiscal year 2024 or prior years; 10
102+(2) the increase in production rates above those sus-11
103+tained with fiscal year 2024 funds; or 12
104+(3) the initiation, resumption, or continuation of any 13
105+project, activity, operation, or organization (defined as any 14
106+project, subproject, activity, budget activity, program ele-15
107+ment, and subprogram within a program element, and for 16
108+any investment items defined as a P–1 line item in a budg-17
109+et activity within an appropriation account and an R–1 18
110+line item that includes a program element and subprogram 19
111+element within an appropriation account) for which appro-20
112+priations, funds, or other authority were not available dur-21
113+ing fiscal year 2024. 22
114+(b) No appropriation or funds made available or au-23
115+thority granted pursuant to section 101 for the Depart-24
116+ment of Defense shall be used to initiate multi-year pro-25 6

118+curements utilizing advance procurement funding for eco-1
119+nomic order quantity procurement unless specifically ap-2
120+propriated later. 3

84-EC. 102. (a) No appropriation or funds made available or
85-authority granted pursuant to section 101 for the Department of
86-Defense shall be used for:
87-(1) the new production of items not funded for production
88-in fiscal year 2024 or prior years;
89-(2) the increase in production rates above those sustained with
90-fiscal year 2024 funds; or
91-(3) the initiation, resumption, or continuation of any project,
92-activity, operation, or organization (defined as any project, sub-
93-project, activity, budget activity, program element, and subprogram
94-within a program element, and for any investment items defined
95-as a P–1 line item in a budget activity within an appropriation
96-account and an R–1 line item that includes a program element
97-and subprogram element within an appropriation account) for which
98-appropriations, funds, or other authority were not available during
99-fiscal year 2024.
100-(b) No appropriation or funds made available or authority
101-granted pursuant to section 101 for the Department of Defense
102-shall be used to initiate multi-year procurements utilizing advance H. R. 9747—3
103-procurement funding for economic order quantity procurement
104-unless specifically appropriated later.
122+EC. 103. Appropriations made by section 101 shall 4
123+be available to the extent and in the manner that would 5
124+be provided by the pertinent appropriations Act. 6

106-EC. 103. Appropriations made by section 101 shall be available
107-to the extent and in the manner that would be provided by the
108-pertinent appropriations Act.
126+EC. 104. Except as otherwise provided in section 7
127+102, no appropriation or funds made available or author-8
128+ity granted pursuant to section 101 shall be used to ini-9
129+tiate or resume any project or activity for which appro-10
130+priations, funds, or other authority were not available dur-11
131+ing fiscal year 2024. 12

110-EC. 104. Except as otherwise provided in section 102, no
111-appropriation or funds made available or authority granted pursu-
112-ant to section 101 shall be used to initiate or resume any project
113-or activity for which appropriations, funds, or other authority were
114-not available during fiscal year 2024.
133+EC. 105. Appropriations made and authority grant-13
134+ed pursuant to this Act shall cover all obligations or ex-14
135+penditures incurred for any project or activity during the 15
136+period for which funds or authority for such project or 16
137+activity are available under this Act. 17

116-EC. 105. Appropriations made and authority granted pursuant
117-to this Act shall cover all obligations or expenditures incurred
118-for any project or activity during the period for which funds or
119-authority for such project or activity are available under this Act.
139+EC. 106. Unless otherwise provided for in this Act 18
140+or in the applicable appropriations Act for fiscal year 19
141+2025, appropriations and funds made available and au-20
142+thority granted pursuant to this Act shall be available 21
143+until whichever of the following first occurs: 22
144+(1) The enactment into law of an appropriation 23
145+for any project or activity provided for in this Act. 24 7

148+appropriations Act for fiscal year 2025 without any 2
149+provision for such project or activity. 3

121-EC. 106. Unless otherwise provided for in this Act or in the
122-applicable appropriations Act for fiscal year 2025, appropriations
123-and funds made available and authority granted pursuant to this
124-Act shall be available until whichever of the following first occurs:
125-(1) The enactment into law of an appropriation for any
126-project or activity provided for in this Act.
127-(2) The enactment into law of the applicable appropriations
128-Act for fiscal year 2025 without any provision for such project
129-or activity.
130-(3) December 20, 2024.
152+EC. 107. Expenditures made pursuant to this Act 5
153+shall be charged to the applicable appropriation, fund, or 6
154+authorization whenever a bill in which such applicable ap-7
155+propriation, fund, or authorization is contained is enacted 8
156+into law. 9

132-EC. 107. Expenditures made pursuant to this Act shall be

158+EC. 108. Appropriations made and funds made 10
159+available by or authority granted pursuant to this Act may 11
160+be used without regard to the time limitations for submis-12
161+sion and approval of apportionments set forth in section 13
162+1513 of title 31, United States Code, but nothing in this 14
163+Act may be construed to waive any other provision of law 15
164+governing the apportionment of funds. 16

137-EC. 108. Appropriations made and funds made available by
138-or authority granted pursuant to this Act may be used without
139-regard to the time limitations for submission and approval of appor-
140-tionments set forth in section 1513 of title 31, United States Code,
141-but nothing in this Act may be construed to waive any other
142-provision of law governing the apportionment of funds.
166+EC. 109. Notwithstanding any other provision of 17
167+this Act, except section 106, for those programs that 18
168+would otherwise have high initial rates of operation or 19
169+complete distribution of appropriations at the beginning 20
170+of fiscal year 2025 because of distributions of funding to 21
171+States, foreign countries, grantees, or others, such high 22
172+initial rates of operation or complete distribution shall not 23
173+be made, and no grants shall be awarded for such pro-24 8

175+grams funded by this Act that would impinge on final 1
176+funding prerogatives. 2

144-EC. 109. Notwithstanding any other provision of this Act,
145-except section 106, for those programs that would otherwise have
146-high initial rates of operation or complete distribution of appropria-
147-tions at the beginning of fiscal year 2025 because of distributions
148-of funding to States, foreign countries, grantees, or others, such
149-high initial rates of operation or complete distribution shall not
150-be made, and no grants shall be awarded for such programs funded
151-by this Act that would impinge on final funding prerogatives.
178+EC. 110. This Act shall be implemented so that only 3
179+the most limited funding action of that permitted in the 4
180+Act shall be taken in order to provide for continuation of 5
181+projects and activities. 6

183+EC. 111. (a) For entitlements and other mandatory 7
184+payments whose budget authority was provided in appro-8
185+priations Acts for fiscal year 2024, and for activities under 9
186+the Food and Nutrition Act of 2008, activities shall be 10
187+continued at the rate to maintain program levels under 11
188+current law, under the authority and conditions provided 12
189+in the applicable appropriations Act for fiscal year 2024, 13
190+to be continued through the date specified in section 14
191+106(3). 15
192+(b) Notwithstanding section 106, obligations for man-16
193+datory payments due on or about the first day of any 17
194+month that begins after October 2024 but not later than 18
195+30 days after the date specified in section 106(3) may con-19
196+tinue to be made, and funds shall be available for such 20
197+payments. 21

158-EC. 111. (a) For entitlements and other mandatory payments
159-whose budget authority was provided in appropriations Acts for
160-fiscal year 2024, and for activities under the Food and Nutrition
161-Act of 2008, activities shall be continued at the rate to maintain
162-program levels under current law, under the authority and condi-
163-tions provided in the applicable appropriations Act for fiscal year
164-2024, to be continued through the date specified in section 106(3).
165-(b) Notwithstanding section 106, obligations for mandatory pay-
166-ments due on or about the first day of any month that begins
167-after October 2024 but not later than 30 days after the date specified H. R. 9747—4
168-in section 106(3) may continue to be made, and funds shall be
169-available for such payments.
199+EC. 112. Amounts made available under section 101 22
200+for civilian personnel compensation and benefits in each 23
201+department and agency may be apportioned up to the rate 24
202+for operations necessary to avoid furloughs within such de-25 9

204+partment or agency, consistent with the applicable appro-1
205+priations Act for fiscal year 2024, except that such author-2
206+ity provided under this section shall not be used until after 3
207+the department or agency has taken all necessary actions 4
208+to reduce or defer non-personnel-related administrative ex-5

217+6212), and section 504(a)(1) of the National Security Act 13

180-EC. 113. Funds appropriated by this Act may be obligated
181-and expended notwithstanding section 10 of Public Law 91–672
182-(22 U.S.C. 2412), section 15 of the State Department Basic Authori-
183-ties Act of 1956 (22 U.S.C. 2680), section 313 of the Foreign Rela-
184-tions Authorization Act, Fiscal Years 1994 and 1995 (22 U.S.C.
185-6212), and section 504(a)(1) of the National Security Act of 1947
186-(50 U.S.C. 3094(a)(1)).
220+EC. 114. (a) Each amount incorporated by reference 15
221+in this Act that was previously designated by the Congress 16
222+as an emergency requirement pursuant to section 17
223+251(b)(2)(A)(i) of the Balanced Budget and Emergency 18
224+Deficit Control Act of 1985 or as being for disaster relief 19
225+pursuant to section 251(b)(2)(D) of such Act is des-20
226+ignated by the Congress as an emergency requirement 21
227+pursuant to section 251(b)(2)(A)(i) of such Act or as 22
228+being for disaster relief pursuant to section 251(b)(2)(D) 23
229+of such Act, respectively. 24 10

231+(b) Section 6 of Public Laws 118–42 and 118–47 1
232+shall apply to amounts designated in subsection (a) and 2
233+sections 138, 140, and 151 of this Act as an emergency 3
234+requirement. 4
235+(c) Each amount incorporated by reference in this 5
236+Act that was previously designated in division B of Public 6
237+Law 117–159, division J of Public Law 117–58, or in sec-7
238+tion 443(b) of division G of Public Law 117–328 by the 8
239+Congress as an emergency requirement pursuant to a con-9
240+current resolution on the budget shall continue to be treat-10
241+ed as an amount specified in section 103(b) of division 11
242+A of Public Law 118–5. 12
243+(d) This section shall become effective immediately 13
244+upon enactment of this Act, and shall remain in effect 14
245+through the date in section 106(3). 15

188-EC. 114. (a) Each amount incorporated by reference in this
189-Act that was previously designated by the Congress as an emer-
190-gency requirement pursuant to section 251(b)(2)(A)(i) of the Bal-
191-anced Budget and Emergency Deficit Control Act of 1985 or as
192-being for disaster relief pursuant to section 251(b)(2)(D) of such
193-Act is designated by the Congress as an emergency requirement
194-pursuant to section 251(b)(2)(A)(i) of such Act or as being for dis-
195-aster relief pursuant to section 251(b)(2)(D) of such Act, respectively.
196-(b) Section 6 of Public Laws 118–42 and 118–47 shall apply
197-to amounts designated in subsection (a) and sections 138, 140,
198-and 151 of this Act as an emergency requirement.
199-(c) Each amount incorporated by reference in this Act that
200-was previously designated in division B of Public Law 117–159,
201-division J of Public Law 117–58, or in section 443(b) of division
202-G of Public Law 117–328 by the Congress as an emergency require-
203-ment pursuant to a concurrent resolution on the budget shall con-
204-tinue to be treated as an amount specified in section 103(b) of
205-division A of Public Law 118–5.
206-(d) This section shall become effective immediately upon enact-
207-ment of this Act, and shall remain in effect through the date
208-in section 106(3).
247+EC. 115. (a) Rescissions or cancellations of discre-16
248+tionary budget authority that continue pursuant to section 17
249+101 in Treasury Appropriations Fund Symbols (TAFS)— 18
250+(1) to which other appropriations are not provided 19
251+by this Act, but for which there is a current applicable 20
252+TAFS that does receive an appropriation in this Act; or 21
253+(2) which are no-year TAFS and receive other appro-22
254+priations in this Act, may be continued instead by reduc-23
255+ing the rate for operations otherwise provided by section 24
256+101 for such current applicable TAFS, as long as doing 25 11
257+•HR 9747 EH
258+so does not impinge on the final funding prerogatives of 1
259+the Congress. 2
260+(b) Rescissions or cancellations described in sub-3
261+section (a) shall continue in an amount equal to the lesser 4
262+of— 5
263+(1) the amount specified for rescission or cancellation 6
264+in the applicable appropriations Act referenced in section 7
265+101 of this Act; or 8
266+(2) the amount of balances available, as of October 9
267+1, 2024, from the funds specified for rescission or can-10
268+cellation in the applicable appropriations Act referenced 11
269+in section 101 of this Act. 12
270+(c) No later than November 18, 2024, the Director 13
271+of the Office of Management and Budget shall provide to 14
272+the Committees on Appropriations of the House of Rep-15
273+resentatives and the Senate a comprehensive list of the 16
274+rescissions or cancellations that will continue pursuant to 17
275+section 101: Provided, That the information in such com-18
276+prehensive list shall be periodically updated to reflect any 19
277+subsequent changes in the amount of balances available, 20
278+as of October 1, 2024, from the funds specified for rescis-21
279+sion or cancellation in the applicable appropriations Act 22
280+referenced in section 101, and such updates shall be trans-23
281+mitted to the Committees on Appropriations of the House 24
282+of Representatives and the Senate upon request. 25 12

284+SEC. 116. Amounts made available by section 101 for 1
285+‘‘Farm Service Agency—Agricultural Credit Insurance 2
286+Fund Program Account’’ may be apportioned up to the 3
287+rate for operations necessary to accommodate approved 4
288+applications for direct and guaranteed farm ownership 5
289+loans, as authorized by 7 U.S.C. 1922 et seq., and direct 6
290+farm operating loans, as authorized by 7 U.S.C. 1941 et 7
291+seq. 8

210-EC. 115. (a) Rescissions or cancellations of discretionary budget
211-authority that continue pursuant to section 101 in Treasury Appro-
212-priations Fund Symbols (TAFS)—
213-(1) to which other appropriations are not provided by this
214-Act, but for which there is a current applicable TAFS that does
215-receive an appropriation in this Act; or
216-(2) which are no-year TAFS and receive other appropriations
217-in this Act, may be continued instead by reducing the rate for
218-operations otherwise provided by section 101 for such current
219-applicable TAFS, as long as doing so does not impinge on the
220-final funding prerogatives of the Congress.
221-(b) Rescissions or cancellations described in subsection (a) shall
222-continue in an amount equal to the lesser of—
223-(1) the amount specified for rescission or cancellation in the
224-applicable appropriations Act referenced in section 101 of this Act;
225-or
226-(2) the amount of balances available, as of October 1, 2024,
227-from the funds specified for rescission or cancellation in the
228-applicable appropriations Act referenced in section 101 of this Act. H. R. 9747—5
229-(c) No later than November 18, 2024, the Director of the Office
230-of Management and Budget shall provide to the Committees on
231-Appropriations of the House of Representatives and the Senate
232-a comprehensive list of the rescissions or cancellations that will

1014-Section 322 of title 38, United States Code, is amended—
1015-(1) by striking ‘‘the United States Olympic Committee’’

1018-(2) in subsection (a), by striking ‘‘Veterans Benefits
1019-Administration’’ and inserting ‘‘Veterans Health Administra-

1021-(3) in subsection (d), by amending paragraph (4) to read
1022-as follows:
1023-‘‘(4) There is authorized to be appropriated to carry out this

1034-The loan fee table in section 3729(b)(2) of title 38, United

1042-SEC. 338. EXTENSION OF REQUIREMENTS RELATING TO CHIEF FINAN-

1044-Section 7103 of the Johnny Isakson and David P. Roe, M.D.
1045-Veterans Health Care and Benefits Improvement Act of 2020 (Public
1046-Law 116–315) is amended by striking ‘‘for fiscal year 2022 and
1047-each of the next three subsequent fiscal years’’ and inserting ‘‘for
1048-each of fiscal years 2026 through 2029’’.

1051-(a) STATUTORY PAYGO SCORECARDS.—The budgetary effects
1052-of this division shall not be entered on either PAYGO scorecard
1053-maintained pursuant to section 4(d) of the Statutory Pay-As-You-
1054-Go Act of 2010.

1056-ENATEPAYGO SCORECARDS.—The budgetary effects of this
1057-division shall not be entered on any PAYGO scorecard maintained
1058-for purposes of section 4106 of H. Con. Res. 71 (115th Congress).

1060-LASSIFICATION OF BUDGETARYEFFECTS.—Notwithstanding
1061-Rule 3 of the Budget Scorekeeping Guidelines set forth in the
1062-joint explanatory statement of the committee of conference accom-
1063-panying Conference Report 105–217 and section 250(c)(8) of the
1064-Balanced Budget and Emergency Deficit Control Act of 1985, the
1065-budgetary effects of this division shall not be estimated—
1066-(1) for purposes of section 251 of such Act;
1067-(2) for purposes of an allocation to the Committee on Appro-
1068-priations pursuant to section 302(a) of the Congressional
1069-Budget Act of 1974; and H. R. 9747—20
