4646 Condemning the actions of Governor of New Mexico, Michelle
4747 Lujan Grisham, for subverting the Second Amendment
4848 to the Constitution and depriving the citizens of New
4949 Mexico of their right to bear arms.

5353 Whereas, on September 8, 2023, Governor Lujan Grisham
5454 issued an emergency public health order that suspended
5555 New Mexicans’ right to open and conceal carry firearms
5656 for at least 30 days;
5757 Whereas under this emergency order, citizens could be fined
5858 up to $5,000 and face civil penalties for exercising their
5959 Second Amendment rights and directs State agencies and
6060 local law enforcement to coordinate to apprehend any vio-
6161 lator of the order;
6262 Whereas the Second Amendment to the Constitution states
6363 that the citizens right to bear arms shall not be in-
6464 fringed;
6565 Whereas all rights secured by the Constitution are absolute,
6666 and a direct attempt from a Governor to take away the
6767 rights of citizens warrants the condemnation from the
6868 Congress;
6969 Whereas New Mexico Attorney General Raul Torrez stated he
7070 will not defend this emergency order as it violates the
7171 Constitution;
7272 Whereas United States District Court Judge David Urias for
7373 the District of New Mexico blocked the portion of the
7474 emergency order that prohibits lawful firearm owners
7575 from carrying their guns in public for 30 days;
7676 Whereas in District of Columbia v. Heller, 554 U.S. 570, 595
7777 (2008), the Supreme Court confirmed that ‘‘[t]here
7878 seems to us no doubt, on the basis of both text and his-
7979 tory, that the Second Amendment conferred an individual
8080 right to keep and bear arms.’’;
8181 Whereas in McDonald v. City of Chicago, 561 U.S.742
8282 (2010), the Supreme Court reaffirmed that ‘‘[s]elf-de-

8787 from ancient times to the present day.’’;
8888 Whereas Justice Thomas concurred by pointing out that ‘‘the
8989 right to keep and bear arms is a privilege of American
9090 citizenship.’’;
9191 Whereas the Supreme Court further held in New York State
9292 Rifle & Pistol Association v. Bruen, 142 S. Ct. 2111,
9393 2126 (2022), that the Second Amendment requires the
9494 government to demonstrate that a law regulating fire-
9595 arms ‘‘is consistent with this Nation’s historical tradition
9696 of firearm regulation’’;
9797 Whereas the Governor stated ‘‘No Constitutional right in my
9898 view, including my oath, is intended to be absolute’’ at
9999 a press conference announcing the emergency public
100100 order; and
101101 Whereas the oath of office for the Governor of New Mexico
102102 states ‘‘Every person elected or appointed to any office
103103 shall, before entering upon his duties take and subscribe
104104 to an oath or affirmation that he will support the con-
105105 stitution of the United States and the constitution and
106106 laws of this state, and that he will faithfully and impar-
107107 tially discharge the duties of his office to the best of his
108108 ability.’’: Now, therefore, be it
109109 Resolved, That the House of Representatives con-1
110110 demns the actions of Governor Michelle Lujan Grisham 2
111111 for blatantly violating the Second Amendment to the Con-3
112112 stitution and depriving the citizens of New Mexico of their 4
113113 right to bear arms. 5
