	77	+	rity, after consultation with the Secretary of Labor, 14
	78	+	and upon determining that the needs of American 15
	79	+	businesses cannot be satisfied during fiscal year 16
	80	+	2024 with United States workers who are willing, 17
	81	+	qualified, and able to perform temporary non-18
	82	+	agricultural labor, may increase the total number of 19
	83	+	aliens who may receive a visa under section 20
	84	+	101(a)(15)(H)(ii)(b) of such Act (8 U.S.C. 21
	85	+	1101(a)(15)(H)(ii)(b)) in such fiscal year above such 22
	86	+	limitation by not more than the highest number of 23
	87	+	H–2B nonimmigrants who participated in the H–2B 24
	88	+	returning worker program in any fiscal year in 25
