16	16	zona, by the International Boundary and Water Commis-
17	17	sion, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Nogales Wastewater 4
22	22	Improvement Act of 2023’’. 5
23	23	SEC. 2. NOGALES WASTEWATER IMPROVEMENT. 6
24	24	(a) A
25	25	MENDMENT TO THE ACT OFJULY27, 1953.— 7
26	26	The first section of the Act of July 27, 1953 (67 Stat. 8

31	31	striking the period at the end and inserting ‘‘: Provided 2
32	32	further, That the equitable portion of the Nogales sanita-3
33	33	tion project for the city of Nogales, Arizona, shall be lim-4
34	34	ited to the costs directly associated with the treatment and 5
35	35	conveyance of the wastewater of the city and, to the extent 6
36	36	practicable, shall not include any costs directly associated 7
37	37	with the quality or quantity of wastewater originating in 8
38	38	Mexico.’’. 9

44	44	ITY.—The term ‘‘City’’ means the 12
45	45	City of Nogales, Arizona. 13

47	47	OMMISSION.—The term ‘‘Commis-14
48	48	sion’’ means the United States Section of the 15
49	49	International Boundary and Water Commission. 16

53	53	terceptor’’ means the pipeline that conveys 19
54	54	wastewater from the United States-Mexico bor-20
55	55	der to the Nogales International Wastewater 21

66	66	(i) is operated by the Commission; 3
67	67	(ii) is located in Rio Rico, Santa Cruz 4
68	68	County, Arizona, after manhole 99; and 5
69	69	(iii) treats sewage and wastewater 6
70	70	originating from— 7
71	71	(I) Nogales, Sonora, Mexico; and 8
72	72	(II) Nogales, Arizona. 9

74	74	WNERSHIP AND CONTROL .— 10
75	75	(A) I
76	76	N GENERAL.—Subject to subpara-11
77	77	graph (B) and in accordance with authority 12
78	78	under the Act of July 27, 1953 (67 Stat. 195, 13
79	79	chapter 242; 22 U.S.C. 277d–10 et seq.), on 14
80	80	transfer by donation from the City of the cur-15
81	81	rent stake of the City in the International Out-16
82	82	fall Interceptor to the Commission, the Com-17
83	83	mission shall enter into such agreements as are 18
84	84	necessary to assume full ownership and control 19
85	85	over the International Outfall Interceptor. 20

87	87	GREEMENTS REQUIRED .—The Com-21
88	88	mission shall assume full ownership and control 22
89	89	over the International Outfall Interceptor under 23
90	90	subparagraph (A) after all applicable governing 24

95	95	City, have— 2
96	96	(i) signed memoranda of under-3
97	97	standing granting to the Commission ac-4
98	98	cess to existing easements for a right of 5
99	99	entry to the International Outfall Inter-6
100	100	ceptor for the life of the International Out-7
101	101	fall Interceptor; 8
102	102	(ii) entered into an agreement with re-9
103	103	spect to the flows entering the Inter-10
104	104	national Outfall Interceptor that are con-11
105	105	trolled by the City; and 12
106	106	(iii) agreed to work in good faith to 13
107	107	expeditiously enter into such other agree-14
108	108	ments as are necessary for the Commission 15
109	109	to operate and maintain the International 16
110	110	Outfall Interceptor. 17

112	112	PERATIONS AND MAINTENANCE .— 18

114	114	N GENERAL.—Beginning on the date 19
115	115	on which the Commission assumes full owner-20
116	116	ship and control of the International Outfall In-21
117	117	terceptor under paragraph (2)(A), but subject 22
118	118	to paragraph (5), the Commission shall be re-23
119	119	sponsible for the operations and maintenance of 24
120	120	the International Outfall Interceptor. 25

126	126	priated to the Commission to carry out this 3
127	127	paragraph, to remain available until ex-4

129	129	(i) $6,500,000 for fiscal year 2025; 6
130	130	and 7
131	131	(ii) not less than $2,500,000 for fiscal 8
132	132	year 2026 and each fiscal year thereafter. 9

141	141	national Outfall Interceptor for inter-15
142	142	cepting debris and drug bundles coming to 16
143	143	the United States from Nogales, Sonora, 17
144	144	Mexico. 18

146	146	EQUIREMENT.—In constructing 19
147	147	and operating the debris screen under 20
148	148	clause (i), the Commission and the Com-21
149	149	missioner of U.S. Customs and Border 22
150	150	Protection shall coordinate— 23

162	162	TIONS.—There are authorized to be appro-8
163	163	priated to the Commission, to remain available 9
164	164	until expended— 10
165	165	(i) for fiscal year 2025— 11
166	166	(I) $8,000,000 for construction 12
167	167	of the debris screen described in sub-13
168	168	paragraph (A)(i); and 14
169	169	(II) not less than $1,000,000 for 15
170	170	the operations and maintenance of the 16
171	171	debris screen described in subpara-17
172	172	graph (A)(i); and 18
173	173	(ii) not less than $1,000,000 for fiscal 19
174	174	year 2026 and each fiscal year thereafter 20
175	175	for the operations and maintenance of the 21
176	176	debris screen described in subparagraph 22

179	179	IMITATION OF CLAIMS.—Chapter 171 and 24
180	180	section 1346(b) of title 28, United States Code 25

189	189	Outfall Interceptor due to excess inflow to the Inter-6
190	190	national Outfall Interceptor originating from 7
191	191	Nogales, Sonora, Mexico. 8

193	193	FFECTIVEDATE.—This section (including the 9
194	194	amendments made by this section) takes effect on October 10
195	195	1, 2024. 11
