4040 STABLISHMENT OF SYSTEM .—Not 5
4141 later than 4 years after the date of enactment 6
4242 of the College Transparency Act, the Commis-7
4343 sioner of the National Center for Education 8
4444 Statistics (referred to in this subsection as the 9
4545 ‘Commissioner’) shall develop and maintain a 10
4646 secure and privacy-protected postsecondary stu-11
4747 dent-level data system in order to— 12
4848 ‘‘(i) accurately evaluate student en-13
4949 rollment patterns, progression, completion, 14
5050 and postcollegiate outcomes, and higher 15
5151 education costs and financial aid; 16
5252 ‘‘(ii) assist with transparency, institu-17
5353 tional improvement, and analysis of Fed-18
5454 eral aid programs; 19
5555 ‘‘(iii) provide accurate, complete, and 20
5656 customizable information for students and 21
5757 families making decisions about postsec-22
5858 ondary education; and 23
5959 ‘‘(iv) reduce the reporting burden on 24

7373 or the Secretary or Commissioner, shall use the 9
7474 reporting or data required for the postsec-10
7575 ondary student data system under this sub-11

186186 ‘‘(I) the Chief Privacy Officer of 7
187187 the Department or an official of the 8
188188 Department delegated the duties of 9
189189 overseeing data privacy at the Depart-10
190190 ment; 11
191191 ‘‘(II) the Chief Security Officer 12
192192 of the Department or an official of 13
193193 the Department delegated the duties 14
194194 of overseeing data security at the De-15
195195 partment; 16
196196 ‘‘(III) representatives of diverse 17
197197 institutions of higher education, which 18
198198 shall include equal representation be-19
199199 tween 2-year and 4-year institutions 20
200200 of higher education, and from public, 21
201201 nonprofit, and proprietary institutions 22
202202 of higher education, including minor-23
203203 ity-serving institutions; 24

212212 ‘‘(VI) representatives from rel-6
213213 evant Federal agencies; 7
214214 ‘‘(VII) individuals with expertise 8
215215 in data privacy and security; and 9
216216 ‘‘(VIII) other stakeholders (in-10
217217 cluding individuals with consumer 11
218218 protection and postsecondary edu-12
219219 cation research). 13
220220 ‘‘(ii) R
221221 EQUIREMENTS.—The Commis-14
222222 sioner shall ensure that the Advisory Com-15
223223 mittee— 16
224224 ‘‘(I) adheres to all requirements 17
225225 under chapter 10 of title 5, United 18
226226 States Code (commonly known as the 19
227227 ‘Federal Advisory Committee Act’); 20
228228 ‘‘(II) establishes operating and 21
229229 meeting procedures and guidelines 22
230230 necessary to execute its advisory du-23
231231 ties; and 24

239239 EQUIRED DATA ELEMENTS .—The 4
240240 data elements in the postsecondary student 5
241241 data system shall include, at a minimum, the 6
242242 following: 7
243243 ‘‘(i) Student-level data elements nec-8
244244 essary to calculate the information within 9
245245 the surveys designated by the Commis-10
246246 sioner as ‘student-related surveys’ in the 11
247247 Integrated Postsecondary Education Data 12
248248 System (IPEDS), as such surveys are in 13
249249 effect on the day before the date of enact-14
250250 ment of the College Transparency Act, ex-15
251251 cept that in the case that collection of such 16
252252 elements would conflict with subparagraph 17
253253 (F), such elements in conflict with sub-18
254254 paragraph (F) shall be included in the ag-19
255255 gregate instead of at the student level. 20
256256 ‘‘(ii) Student-level data elements nec-21
257257 essary to allow for reporting student en-22
258258 rollment, persistence, retention, transfer, 23
259259 and completion measures for all credential 24
260260 levels separately (including certificate, as-25

267267 categories of institution level, control, and 4
268268 predominant degree awarded). The data 5
269269 elements shall allow for reporting about all 6
270270 such data disaggregated by the following 7
271271 categories: 8
272272 ‘‘(I) Enrollment status as a first- 9
273273 time student, recent transfer student, 10
274274 or other non-first-time student. 11
275275 ‘‘(II) Attendance intensity, 12
276276 whether full-time or part-time. 13
277277 ‘‘(III) Credential-seeking status, 14
278278 by credential level. 15
279279 ‘‘(IV) Race or ethnicity, in a 16
280280 manner that captures all the racial 17
281281 groups specified in the most recent 18
282282 American Community Survey of the 19
283283 Bureau of the Census. 20
284284 ‘‘(V) Age intervals. 21
285285 ‘‘(VI) Gender. 22
286286 ‘‘(VII) Program of study (as ap-23
287287 plicable). 24

297297 partially enrolled in distance edu-7
298298 cation. 8
299299 ‘‘(X) Federal Pell Grant recipient 9
300300 status under section 401 and Federal 10
301301 loan recipient status under title IV, 11
302302 provided that the collection of such in-12
303303 formation complies with paragraph 13
304304 (1)(B). 14

308308 N GENERAL.—The Commissioner 16
309309 may, after consultation with the Advisory 17
310310 Committee and provision of a public com-18
311311 ment period, include additional data ele-19
312312 ments in the postsecondary student data 20
313313 system, such as those described in clause 21
314314 (ii), if those data elements— 22
315315 ‘‘(I) are necessary to ensure that 23
316316 the postsecondary data system fulfills 24

329329 ments described in clause (i) may in-9
330330 clude— 10
331331 ‘‘(I) status as a first generation 11
332332 college student, as defined in section 12
333333 402A(h); 13
334334 ‘‘(II) economic status; 14
335335 ‘‘(III) participation in postsec-15
336336 ondary remedial coursework or gate-16
337337 way course completion; or 17
338338 ‘‘(IV) other data elements that 18
339339 are necessary in accordance with 19
340340 clause (i). 20

342342 EEVALUATION.—Not less than once 21
343343 every 3 years after the implementation of the 22
344344 postsecondary student data system described in 23
345345 this subsection, the Commissioner, in consulta-24
346346 tion with the Advisory Committee described in 25

355355 ROHIBITIONS.—The Commissioner 5
356356 shall not include individual health data (includ-6
357357 ing data relating to physical health or mental 7
358358 health), student discipline records or data, ele-8
359359 mentary and secondary education data, an 9
360360 exact address, citizenship status, migrant sta-10
361361 tus, or national origin status for students or 11
362362 their families, course grades, postsecondary en-12
363363 trance examination results, political affiliation, 13
364364 or religion in the postsecondary student data 14
365365 system under this subsection. 15

367367 ERIODIC MATCHING WITH OTHER FED -16
368368 ERAL DATA SYSTEMS.— 17

370370 ATA SHARING AGREEMENTS .— 18
371371 ‘‘(i) The Commissioner shall ensure 19
372372 secure and privacy-protected periodic data 20
373373 matches by entering into data sharing 21
374374 agreements with each of the following Fed-22
375375 eral agencies and offices: 23
376376 ‘‘(I) The Secretary of the Treas-24
377377 ury and the Commissioner of the In-25

388388 outcomes of servicemembers. 8
389389 ‘‘(III) The Secretary of Veterans 9
390390 Affairs, in order to assess the use of 10
391391 postsecondary educational benefits 11
392392 and outcomes of veterans. 12
393393 ‘‘(IV) The Director of the Bu-13
394394 reau of the Census, in order to assess 14
395395 the earnings outcomes of former post-15
396396 secondary education students. 16
397397 ‘‘(V) The Chief Operating Officer 17
398398 of the Office of Federal Student Aid, 18
399399 in order to analyze the use of postsec-19
400400 ondary educational benefits provided 20
401401 under this Act. 21
402402 ‘‘(VI) The Commissioner of the 22
403403 Social Security Administration, in 23
404404 order to evaluate labor market out-24

414414 ‘‘(ii) The heads of Federal agencies 7
415415 and offices described under clause (i) shall 8
416416 enter into data sharing agreements with 9
417417 the Commissioner to ensure secure and 10
418418 privacy-protected periodic data matches as 11
419419 described in this paragraph. 12
420420 ‘‘(B) C
421421 ATEGORIES OF DATA .—The Com-13
422422 missioner shall, at a minimum, seek to ensure 14
423423 that the secure and privacy-protected periodic 15
424424 data matches described in subparagraph (A) 16
425425 permit consistent reporting of the following cat-17
426426 egories of data for all postsecondary students: 18
427427 ‘‘(i) Enrollment, retention, transfer, 19
428428 and completion outcomes for all postsec-20
429429 ondary students. 21
430430 ‘‘(ii) Financial indicators for postsec-22
431431 ondary students receiving Federal grants 23
432432 and loans, including grant and loan aid by 24

442442 as measured— 7
443443 ‘‘(I) immediately after leaving 8
444444 postsecondary education; and 9
445445 ‘‘(II) at time intervals appro-10
446446 priate to the credential sought and 11
447447 earned. 12

449449 ERIODIC DATA MATCH STREAM -13
450450 LINING AND CONFIDENTIALITY .— 14
451451 ‘‘(i) S
452452 TREAMLINING.—In carrying out 15
453453 the secure and privacy-protected periodic 16
454454 data matches under this paragraph, the 17
455455 Commissioner shall— 18
456456 ‘‘(I) ensure that such matches 19
457457 are not continuous, but occur only pe-20
458458 riodically at appropriate intervals, as 21
459459 determined by the Commissioner to 22
460460 meet the goals of subparagraph (A); 23
461461 and 24
462462 ‘‘(II) seek to— 25

489489 EVIEW.—Not less often than 23
490490 once every 3 years after the establishment 24
491491 of the postsecondary student data system 25

504504 ONFIDENTIALITY.—The Com-9
505505 missioner shall ensure that any periodic 10

929929 tion, in accordance with the most recent Fed-17
930930 eral standards developed by the National Insti-18
