125125 retary shall immediately resume quarterly onshore 6
126126 oil and gas lease sales in accordance with section 7
127127 17(b)(1)(A) of the Mineral Leasing Act (30 U.S.C. 8
128128 226(b)(1)(A)). 9

130130 TATUTORY LEASE TERMS .—During the 5- 10
131131 year period beginning on the date of enactment of 11
132132 this Act, in order to promote increased production 12
133133 on Federal land, the Secretary may, on a determina-13
134134 tion that it is in the national interest, reduce the ap-14
135135 plicable royalty rate on individual leases issued 15
136136 under an onshore oil and gas lease sale to not less 16
137137 than 12.5 percent. 17

139139 PPROVED RESOURCE MANAGEMENT PLAN 18
140140 REQUIREMENT.—In conducting a quarterly onshore 19
141141 oil and gas lease sale in a State described in section 20
142142 17(b)(1)(A) of the Mineral Leasing Act (30 U.S.C. 21
143143 226(b)(1)(A)), the Secretary— 22
144144 (A) shall offer not less than 25 percent of 23
145145 available parcels nominated for oil and gas de-24
146146 velopment under the applicable resource man-25

163163 4321 note; relating to tackling the climate crisis at 13
164164 home and abroad), the Secretary shall conduct a re-14
165165 placement sale by not later than 180 days after the 15
166166 date of the cancellation, delay, deferral, or pause, as 16
167167 applicable. 17

186186 N GENERAL.—Any parcel of land subject 3
187187 to disposition under this Act that is known or be-4
188188 lieved to contain oil or gas deposits shall be made 5
189189 available for leasing, subject to paragraphs (2) and 6
190190 (3), by the Secretary of the Interior, or for National 7
191191 Forest System land, the Secretary of Agriculture, as 8
192192 applicable (referred to in this subsection as the ‘Sec-9
193193 retary concerned’), not later than 18 months after 10
194194 the date of receipt by the Secretary concerned of an 11
195195 expression of interest in leasing the applicable parcel 12
196196 of land available for disposition under this section, 13
197197 in accordance with procedures established under 14
198198 subsection (q) and for which the applicable fee was 15
199199 paid under that subsection, if the Secretary con-16
200200 cerned determines that the parcel of land is open to 17
201201 oil or gas leasing under the approved resource man-18
202202 agement plan applicable to the planning area in 19
203203 which the parcel of land is located that is in effect 20
204204 on the date on which the expression of interest was 21
205205 submitted to the Secretary concerned (referred to in 22
206206 this subsection as the ‘approved resource manage-23
207207 ment plan’). 24

214214 lease issued by the Secretary concerned under 2
215215 this section with respect to an applicable parcel 3
216216 of land made available for leasing under para-4
217217 graph (1)— 5
218218 ‘‘(i) shall be subject to the terms and 6
219219 conditions of the approved resource man-7
220220 agement plan; and 8
221221 ‘‘(ii) may not require any stipulations 9
222222 or mitigation requirements not included in 10
223223 the approved resource management plan. 11
224224 ‘‘(B) E
225225 FFECT OF AMENDMENT .—The fact 12
226226 that the approved resource management plan is 13
227227 being amended shall not prevent or delay the 14
228228 Secretary concerned from making the applicable 15
229229 parcel of land available for leasing if the other 16
230230 requirements of this section have been met, as 17
231231 determined by the Secretary concerned. 18
232232 ‘‘(C) E
233233 FFECT OF LEASING DECISION .—A 19
234234 lease sale conducted under the terms of an ap-20
235235 proved resource management plan shall not be 21
236236 considered to be an action that limits the choice 22
237237 of reasonable alternatives for an environmental 23
238238 review conducted pursuant to the National En-24
239239 vironmental Policy Act of 1969 (42 U.S.C. 25

247247 EST FEE.—Section 17(q) of the Mineral Leas-4
248248 ing Act (30 U.S.C. 226(q)) is amended— 5
249249 (i) by striking ‘‘Secretary’’ each place 6
250250 it appears and inserting ‘‘Secretary of the 7
251251 Interior’’; 8
252252 (ii) in paragraph (1), by striking 9
253253 ‘‘nonrefundable’’; and 10
254254 (iii) by adding at the end the fol-11

257257 EFUND FOR NONWINNING BID .—If a per-13
258258 son other than the person who submitted the expres-14
259259 sion of interest is the highest responsible qualified 15
260260 bidder for a parcel of land covered by the applicable 16
261261 expression of interest in a lease sale conducted 17

263263 ‘‘(A) as a condition of the issuance of the 19
264264 lease, the person who is the highest responsible 20
265265 qualified bidder shall pay to the Secretary of 21
266266 the Interior an amount equal to the applicable 22
267267 fee paid by the person who submitted the ex-23
268268 pression of interest; and 24

274274 shall refund to the person who submitted the 3
275275 expression of interest an amount equal to the 4
276276 amount of the initial fee paid.’’. 5

278278 ROTESTED LEASE SALES .—Section 6
279279 17(b)(1)(A) of the Mineral Leasing Act (30 U.S.C. 7
280280 226(b)(1)(A)) is amended by inserting after the sev-8
281281 enth sentence the following: ‘‘The Secretary of the 9
282282 Interior shall resolve any protest to a lease sale 10
283283 within 60 days following such payment. Notwith-11
284284 standing any other provision of law, if the Secretary 12
285285 of the Interior denies a protest to a lease sale, any 13
286286 lease subject to the protest shall not be subject to 14
287287 further environmental review by the Secretary of the 15
288288 Interior pursuant to the National Environmental 16
289289 Policy Act of 1969 (42 U.S.C. 4321 et seq.).’’. 17

309309 ‘‘(A) affect the validity of a lease issued 6
310310 under the lease sale that is the subject of the 7
311311 civil action; or 8
312312 ‘‘(B) except as provided in paragraph 9
313313 (3)(B), cause a delay in the timelines estab-10
314314 lished under subsection (p)(2) for the consider-11
315315 ation of an application for permit to drill with 12
316316 respect to a lease issued under the lease sale 13
317317 that is the subject of the civil action. 14
318318 ‘‘(2) R
319319 EMAND; PROCESSING OF APPLICATIONS 15
320320 FOR PERMIT TO DRILL .—If, in a civil action de-16
321321 scribed in paragraph (1), the environmental review 17
322322 for a lease sale is found by the applicable court to 18
323323 violate the National Environmental Policy Act of 19
324324 1969 (42 U.S.C. 4321 et seq.)— 20
325325 ‘‘(A) notwithstanding chapter 5 or 7 of 21
326326 title 5, United States Code (commonly referred 22
327327 to as the ‘Administrative Procedure Act’), the 23
328328 applicable court shall not set aside the lease 24
329329 sale and vacate the leases issued pursuant to 25

336336 ‘‘(B) the Secretary of the Interior shall 4
337337 continue to process all applicable applications 5
338338 for permit to drill pursuant to subsection 6
339339 (p)(2). 7

341341 OTICE.— 8
342342 ‘‘(A) I
343343 N GENERAL.—Not later than 60 9
344344 days after the date on which a civil action de-10
345345 scribed in paragraph (1) is filed, the Secretary 11
346346 of the Interior shall notify the holder of any 12
347347 lease issued under the lease sale that is the sub-13
348348 ject of the civil action of the filing of the civil 14
349349 action. 15
350350 ‘‘(B) T
351351 IMELINE.—Not later than 90 days 16
352352 after the date of receipt of a notice under sub-17
353353 paragraph (A), the leaseholder may file with the 18
354354 Secretary of the Interior a request to pause the 19
355355 timeline under subsection (e)(1) with respect to 20
356356 the term of the lease during any period in 21
357357 which the civil action is pending.’’. 22

359359 EASE CANCELLATION .—Section 17 of the 23
360360 Mineral Leasing Act (30 U.S.C. 226) (as amended 24

367367 EASECANCELLATION.—A lease issued under 3
368368 this section shall be considered to be valid and not subject 4
369369 to cancellation by the Secretary of the Interior for any 5
370370 reason, except for— 6
371371 ‘‘(1) the express written agreement to the can-7
372372 cellation by the lessee; or 8
373373 ‘‘(2) a determination by the Secretary of the In-9
374374 terior that cancellation is appropriate in accordance 10
375375 with section 3108.3 of title 43, Code of Federal Reg-11
376376 ulations (as in effect on the date of enactment of 12
377377 this subsection), subject to the limitation that a 13
378378 lease may not be determined to be improperly issued 14
379379 under that section based on a finding by a Federal 15
380380 court that the environmental review for the lease 16
381381 sale pursuant to which the lease was issued was in 17
382382 violation of the Federal Land Policy and Manage-18
383383 ment Act of 1976 (43 U.S.C. 1701 et seq.), division 19
384384 A of subtitle III of title 54, United States Code (for-20
385385 merly known as the ‘National Historic Preservation 21
386386 Act’), or the National Environmental Policy Act of 22
387387 1969 (42 U.S.C. 4321 et seq.).’’. 23

390390 CONTESTS.—Section 42 of the Mineral Leasing Act 25

398398 ‘‘SEC. 42. LIMITATIONS FOR FILING OIL AND GAS CON-5
399399 TESTS. 6
400400 ‘‘(a) I
401401 NGENERAL.—Notwithstanding chapter 5 or 7 7
402402 of title 5, United States Code (commonly referred to as 8
403403 the ‘Administrative Procedure Act’), no action contesting 9
404404 a decision of the Secretary involving any oil and gas lease 10
405405 sale, individual lease, or individual permit shall be main-11
406406 tained unless the action is commenced or taken by not 12
407407 later than 60 days after the date on which the final deci-13
408408 sion of the Secretary relating to the action was made. 14
409409 ‘‘(b) J
410410 URISDICTION.—An action contesting a decision 15
411411 of the Secretary may only be commenced— 16
412412 ‘‘(1) for an individual lease or permit, in the 17
413413 district court of the United States for the district in 18
414414 which the property, or some part thereof, is located; 19
415415 and 20
416416 ‘‘(2) for a lease sale, in a district court of the 21
417417 United States in the State in which the sale oc-22
418418 curred. 23

420420 EMOVAL.—A defendant or defendant inter-24
421421 venor in an action challenging a lease sale, lease, or permit 25

429429 SEC. 1102. OFFSHORE OIL AND GAS LEASING. 5

434434 N GENERAL.—Notwithstanding any other 8
435435 provision of law, not later than September 30, 2023, 9
436436 the Secretary of the Interior (referred to in this sec-10
437437 tion as the ‘‘Secretary’’) shall approve a final 2023– 11
438438 2028 oil and gas leasing program under section 18 12
439439 of the Outer Continental Shelf Lands Act (43 13
440440 U.S.C. 1344). 14
441441 (2) W
442442 AIVER.—In order to meet the deadline de-15
443443 scribed in paragraph (1), the Secretary may— 16
444444 (A) limit any comment periods required 17
445445 under subsections (c) and (d) of section 18 of 18
446446 the Outer Continental Shelf Lands Act (43 19
447447 U.S.C. 1344); and 20
448448 (B) waive any other requirements under 21
