33	33	Be it enacted by the Senate and House of Representa-1
34	34	tives of the United States of America in Congress assembled, 2

39	39	This Act may be cited as the ‘‘Retired Pay Restora-2
40	40	tion Act’’. 3
41	41	SEC. 2. ELIGIBILITY FOR PAYMENT OF BOTH RETIRED PAY 4
42	42	AND VETERANS’ DISABILITY COMPENSATION 5
43	43	FOR MILITARY RETIREES WITH COMPEN-6
44	44	SABLE SERVICE-CONNECTED DISABILITIES. 7
45	45	(a) I
46	46	NGENERAL.—Subsection (a) of 1414 of title 10, 8
47	47	United States Code, is amended— 9
48	48	(1) in paragraph (1), by striking ‘‘Subject to 10
49	49	subsection (b)’’ and all that follows through ‘‘paid 11
50	50	both for that month’’ and inserting ‘‘A qualified re-12
51	51	tiree is entitled to be paid both retired pay and vet-13
52	52	erans’ disability compensation for a month’’; and 14
53	53	(2) by amending paragraph (2) to read as fol-15
54	54	lows: 16
55	55	‘‘(2) Q
56	56	UALIFIED RETIREES.—For purposes 17
57	57	of this section, a qualified retiree, with respect 18
58	58	to any month, is a member or former member 19
59	59	of the uniformed services who— 20
60	60	‘‘(A) is entitled to retired pay (other 21
61	61	than by reason of section 12731b of this 22
62	62	title); and 23
63	63	‘‘(B) is also entitled for that month to 24
64	64	veterans’ disability compensation.’’. 25

76	76	(A) in subsection (a)(1), by striking ‘‘Dur-7
77	77	ing the period’’ and all that follows through 8
78	78	‘‘unemployability.’’; 9
79	79	(B) by striking subsection (c); 10
80	80	(C) by redesignating subsections (d) and 11
81	81	(e) as subsections (b) and (c), respectively; and 12
82	82	(D) in subsection (c), as so redesignated, 13
83	83	by striking paragraphs (3) and (4). 14

85	85	ECTION HEADING.—The heading of such 15
86	86	section is amended to read as follows: 16
87	87	‘‘§ 1414. Members eligible for retired pay who are also 17
88	88	eligible for veterans’ disability compensa-18
89	89	tion: concurrent payment of retired pay 19
90	90	and disability compensation’’. 20

92	92	ABLE OF SECTIONS.—The item relating to 21
93	93	such section in the table of sections at the beginning 22
94	94	of chapter 71 of title 10, United States Code, is 23
95	95	amended to read as follows: 24
96	96	‘‘1414. Members eligible for retired pay who are also eligible for veterans’ dis-
97	97	ability compensation: concurrent payment of retired pay and
98	98	disability compensation.’’.

103	103	1413a(f) of such title is amended by striking ‘‘Sub-2
104	104	section (d)’’ and inserting ‘‘Subsection (b)’’. 3

106	106	FFECTIVEDATE.—The amendments made by 4
107	107	this section shall take effect on January 1, 2024, and shall 5
108	108	apply to payments for months beginning on or after that 6
109	109	date. 7
