22	22	To prohibit the award of Federal funds to an institution
23	23	of higher education that hosts or is affiliated with a
24	24	student-based service site that provides abortion drugs
25	25	or abortions to students of the institution or to employ-
26	26	ees of the institution or site, and for other purposes.
27	27	Be it enacted by the Senate and House of Representa-1
28	28	tives of the United States of America in Congress assembled, 2
29	29	SECTION 1. SHORT TITLE. 3
30	30	This Act may be cited as the ‘‘Protecting Life on Col-4
31	31	lege Campus Act of 2023’’. 5

35	35	SEC. 2. PROHIBITION ON AWARD OF FUNDS TO CERTAIN 1
36	36	INSTITUTIONS OF HIGHER EDUCATION. 2
37	37	(a) P
38	38	ROHIBITION.—No Federal funds may be award-3
39	39	ed (directly or indirectly, including through a contract or 4
40	40	subcontract) to any institution of higher education that 5
41	41	hosts or is affiliated with any school-based service site that 6
42	42	provides abortion drugs or abortions to students of such 7
43	43	institution or to employees of such institution or site. 8
44	44	(b) A
45	45	NNUALREPORTING.—To remain eligible for 9
46	46	awards of Federal funds, an institution of higher edu-10
47	47	cation that hosts or is affiliated with one or more school- 11
48	48	based service sites shall submit an annual report to the 12
49	49	Secretary of Education and the Secretary of Health and 13
50	50	Human Services certifying that no such site provides abor-14
51	51	tion drugs or abortions to students of the institution or 15
52	52	to employees of such institution or site. 16

54	54	REEMPTION.—An institution of higher education 17
55	55	that receives Federal funds may not be subject to any pen-18
56	56	alty under State law solely by reason of compliance with 19
57	57	this section. 20

59	59	EFINITIONS.—In this section: 21
60	60	(1) A
61	61	BORTION DRUG .—The term ‘‘abortion 22
62	62	drug’’ means any drug, substance, or combination of 23
63	63	drugs or substances that is intended for use or that 24
64	64	is in fact used (irrespective of how the product is la-25
65	65	beled)— 26

69	69	(A) to intentionally kill the unborn child of 1
70	70	a woman known to be pregnant; or 2
71	71	(B) to intentionally terminate the preg-3
72	72	nancy of a woman known to be pregnant, with 4
73	73	an intention other than— 5
74	74	(i) to produce a live birth; 6
75	75	(ii) to remove a dead unborn child; or 7
76	76	(iii) to treat an ectopic pregnancy. 8

78	78	NSTITUTION OF HIGHER EDUCATION .—The 9
79	79	term ‘‘institution of higher education’’ has the 10
80	80	meaning given such term in section 102 of the High-11
81	81	er Education Act of 1965 (20 U.S.C. 1002). 12

83	83	CHOOL-BASED SERVICE SITE.—The term 13
84	84	‘‘school-based service site’’— 14
85	85	(A) means a clinic providing health care 15
86	86	services (including primary health services, fam-16
87	87	ily planning services, telehealth services, and 17
88	88	pharmaceutical services, without regard to 18
89	89	whether the services are provided by employees 19
90	90	of the clinic or contracted providers) to stu-20
91	91	dents that is located on the campus of an insti-21
92	92	tution of higher education that accepts Federal 22
93	93	funding; and 23
