20	20	To require U.S. Immigration and Customs Enforcement to
21	21	take into custody certain aliens who have been charged
22	22	in the United States with a crime that resulted in the
23	23	death or serious bodily injury of another person, and
24	24	for other purposes.
25	25	Be it enacted by the Senate and House of Representa-1
26	26	tives of the United States of America in Congress assembled, 2
27	27	SECTION 1. SHORT TITLE. 3
28	28	This Act may be cited as ‘‘Sarah’s Law’’. 4

32	32	SEC. 2. MANDATORY DETENTION OF CERTAIN ALIENS 1
33	33	CHARGED WITH A CRIME RESULTING IN 2
34	34	DEATH OR SERIOUS BODILY INJURY. 3
35	35	Section 236(c) of the Immigration and Nationality 4
36	36	Act (8 U.S.C. 1226(c)) is amended— 5
37	37	(1) in paragraph (1)— 6
38	38	(A) in subparagraph (A), by striking the 7
39	39	comma at the end and inserting a semicolon; 8
40	40	(B) in subparagraph (B), by striking the 9
41	41	comma at the end and inserting a semicolon; 10
42	42	(C) in subparagraph (C)— 11
43	43	(i) by striking ‘‘sentence’’ and insert-12
44	44	ing ‘‘sentenced’’; and 13
45	45	(ii) by striking ‘‘, or’’ and inserting a 14
46	46	semicolon; 15
47	47	(D) in subparagraph (D), by striking the 16
48	48	comma at the end and inserting ‘‘; or’’; and 17
49	49	(E) by inserting after subparagraph (D) 18
50	50	the following: 19
51	51	‘‘(E)(i)(I) was not inspected and admitted 20
52	52	into the United States; 21
53	53	‘‘(II) held a nonimmigrant visa (or other 22
54	54	documentation authorizing admission into the 23
55	55	United States as a nonimmigrant) that has 24
56	56	been revoked under section 221(i); or 25

60	60	‘‘(III) is described in section 1
61	61	237(a)(1)(C)(i); and 2
62	62	‘‘(ii) has been charged by a prosecuting au-3
63	63	thority in the United States with any crime 4
64	64	that resulted in the death or serious bodily in-5
65	65	jury (as defined in section 1365(h)(3) of title 6
66	66	18, United States Code) of another person,’’; 7
67	67	and 8
68	68	(2) by adding at the end the following: 9
69	69	‘‘(3) N
70	70	OTIFICATION REQUIREMENT .—Upon en-10
71	71	countering or gaining knowledge of an alien de-11
72	72	scribed in paragraph (1), the Assistant Secretary of 12
73	73	Homeland Security for Immigration and Customs 13
74	74	Enforcement shall make reasonable efforts— 14
75	75	‘‘(A) to obtain information from law en-15
76	76	forcement agencies and from other available 16
77	77	sources regarding the identity of any victims of 17
78	78	the crimes for which such alien was charged or 18
79	79	convicted; and 19
80	80	‘‘(B) to provide the victim or, if the victim 20
81	81	is deceased, a parent, guardian, spouse, or clos-21
82	82	est living relative of such victim, with informa-22
83	83	tion, on a timely and ongoing basis, including— 23
84	84	‘‘(i) the alien’s full name, aliases, date 24
85	85	of birth, and country of nationality; 25

89	89	‘‘(ii) the alien’s immigration status 1
90	90	and criminal history; 2
91	91	‘‘(iii) the alien’s custody status and 3
92	92	any changes related to the alien’s custody; 4
93	93	and 5
94	94	‘‘(iv) a description of any efforts by 6
95	95	the United States Government to remove 7
96	96	the alien from the United States.’’. 8
97	97	SEC. 3. SAVINGS PROVISION. 9
98	98	Nothing in this Act, or the amendments made by this 10
99	99	Act, may be construed to limit the rights of crime victims 11
100	100	under any other provision of law, including section 3771 12
101	101	of title 18, United States Code. 13
