79	79	support or resources’’ in section 2339A of title 18, 6

82	82	ERSON.—The term ‘‘person’’ means an in-8
83	83	dividual or entity. 9

85	85	NITED STATES PERSON .—The term 10
86	86	‘‘United States person’’ means— 11
87	87	(A) a United States citizen or an alien law-12
88	88	fully admitted for permanent residence to the 13
89	89	United States; 14
90	90	(B) an entity organized under the laws of 15
91	91	the United States or of any jurisdiction within 16
92	92	the United States, including a foreign branch of 17
93	93	such an entity; or 18
94	94	(C) a person in the United States. 19
95	95	SEC. 3. STATEMENT OF POLICY. 20
96	96	It is the policy of the United States— 21
97	97	(1) to prevent Hamas, the Palestinian Islamic 22
98	98	Jihad, or any affiliate or successor thereof from ac-23
99	99	cessing its international support networks; and 24

104	104	Jihad, or any affiliate or successor thereof from at-2
105	105	tempting to use goods, including medicine and dual- 3
106	106	use items, to smuggle weapons and other materials 4
107	107	to further acts of terrorism. 5
108	108	SEC. 4. IMPOSITION OF SANCTIONS WITH RESPECT TO FOR-6
109	109	EIGN PERSONS AND AGENCIES AND INSTRU-7
110	110	MENTALITIES OF FOREIGN STATES SUP-8
111	111	PORTING HAMAS, THE PALESTINIAN ISLAMIC 9
112	112	JIHAD, OR ANY AFFILIATE OR SUCCESSOR 10
113	113	THEREOF. 11

115	115	NGENERAL.—Not later than 180 days after the 12
116	116	date of the enactment of this Act, the President shall im-13
117	117	pose the sanctions required under subsection (c) with re-14
118	118	spect to any foreign person and any agency or instrumen-15
119	119	tality of a foreign state that the President determines 16
120	120	knowingly— 17
121	121	(1) assists in, sponsors, or provides significant 18
122	122	financial or material support for, or financial or 19
123	123	other services to or in support of any person de-20
124	124	scribed in subsection (b); or 21
125	125	(2) directly or indirectly, materially engages in 22
126	126	a significant transaction with any person described 23
127	127	in subsection (b). 24

133	133	(1) IN GENERAL.—A person described in this 1
134	134	subsection is a foreign person that the President de-2
135	135	termines— 3
136	136	(A) is a senior member of Hamas, the Pal-4
137	137	estinian Islamic Jihad, or any affiliate or suc-5
138	138	cessor thereof; 6
139	139	(B) is a senior member of the Al-Aqsa 7
140	140	Martyr’s Brigade, Lion’s Den, or any other en-8
141	141	tity that the President determines is part of the 9
142	142	terrorist infrastructure in the West Bank and 10
143	143	Gaza; 11
144	144	(C) is a senior member of a foreign ter-12
145	145	rorist organization designated pursuant to sec-13
146	146	tion 219 of the Immigration and Nationality 14
147	147	Act (8 U.S.C. 1189) whose members directly or 15
148	148	indirectly support any of the activities of, know-16
149	149	ingly engage in a significant transaction with, 17
150	150	or provide financial or material support for 18
151	151	Hamas, the Palestinian Islamic Jihad, any affil-19
152	152	iate or successor thereof, or any person de-20
153	153	scribed in subparagraph (A) or (B); or 21
154	154	(D) knowingly provides or has provided 22
155	155	material assistance, financial or material sup-23
156	156	port, or goods or services that directly or indi-24
157	157	rectly supports the terrorist activities of any 25

164	164	EQUIREMENT TO ISSUE GUIDANCE .—Not 3
165	165	later than 60 days after the date of the enactment 4
166	166	of this Act, and not later than 180 days thereafter, 5
167	167	the President shall issue regulations or other guid-6
168	168	ance to identify the persons described in this sub-7
169	169	section. 8

171	171	ANCTIONSREQUIRED.— 9
172	172	(1) F
173	173	OREIGN PERSONS.—With respect to a for-10
174	174	eign person subject to sanctions under subsection 11
175	175	(a), the President shall exercise all powers granted 12
176	176	to the President by the International Emergency 13
177	177	Economic Powers Act (50 U.S.C. 1701 et seq.) (ex-14
178	178	cept that the requirements of section 202 of such 15
179	179	Act (50 U.S.C. 1701) shall not apply) to the extent 16
180	180	necessary to block and prohibit all transactions in all 17
181	181	property and interests in property of the foreign per-18
182	182	son if such property and interests in property are in 19
183	183	the United States, come within the United States, or 20
184	184	are or come within the possession or control of a 21
185	185	United States person. 22
186	186	(2) A
187	187	GENCIES OR INSTRUMENTALITIES OF A 23
188	188	FOREIGN STATE.—With respect to an agency or in-24
189	189	strumentality of a foreign state subject to sanctions 25

193	193	under subsection (a), the President shall impose 2 or 1
194	194	more of the following: 2
195	195	(A) The President may direct the Export- 3
196	196	Import Bank of the United States not to give 4
197	197	approval to the issuance of any guarantee, in-5
198	198	surance, extension of credit, or participation in 6
199	199	the extension of credit in connection with the 7
200	200	export of any goods or services to the agency or 8
201	201	instrumentality, and the Export-Import Bank 9
202	202	of the United States shall comply with any such 10
203	203	direction. 11
204	204	(B) The President may prohibit the sale of 12
205	205	any defense articles, defense services, or design 13
206	206	and construction services under the Arms Ex-14
207	207	port Control Act (22 U.S.C. 2751 et seq.) to 15
208	208	the agency or instrumentality. 16
209	209	(C) The President may prohibit the 17
210	210	issuance of licenses for export of any item on 18
211	211	the United States Munitions List under section 19
212	212	38(a)(1) of the Arms Export Control Act (22 20
213	213	U.S.C. 2778(a)(1)) that include the agency or 21
214	214	instrumentality as a party to the license. 22
215	215	(D) The President may prohibit the export 23
216	216	of any goods or technologies controlled for na-24
217	217	tional security reasons under the Export Ad-25

222	222	chapter VII of title 15, Code of Federal Regula-2
223	223	tions, or successor regulations, to the agency or 3
224	224	instrumentality, except that such prohibition 4
225	225	shall not apply to any transaction subject to the 5
226	226	reporting requirements of title V of the Na-6
227	227	tional Security Act of 1947 (50 U.S.C. 3091 et 7
228	228	seq.). 8
229	229	(E) The President may prohibit any 9
230	230	United States financial institution from making 10
231	231	loans or providing any credit or financing total-11
232	232	ing more than $10,000,000 to the agency or in-12
233	233	strumentality, except that this subparagraph 13
234	234	shall not apply to— 14
235	235	(i) any transaction subject to the re-15
236	236	porting requirements of title V of the Na-16
237	237	tional Security Act of 1947 (50 U.S.C. 17
238	238	3091 et seq.); 18
239	239	(ii) the provision of medicines, medical 19
240	240	equipment, and humanitarian assistance; 20
241	241	or 21
242	242	(iii) any credit, credit guarantee, or fi-22
243	243	nancial assistance provided by the Depart-23
244	244	ment of Agriculture to support the pur-24

254	254	section 202 of such Act (50 U.S.C. 1701) shall 7
255	255	not apply) to the extent necessary to block and 8
256	256	prohibit all transactions in all property and in-9
257	257	terests in property of the agency or instrumen-10
258	258	tality if such property and interests in property 11
259	259	are in the United States, come within the 12
260	260	United States, or are or come within the pos-13
261	261	session or control of a United States person. 14

267	267	ANCTIONS.—Not later than 60 days after receiving a re-17
268	268	quest from the chairman and ranking member of one of 18
269	269	the appropriate congressional committees with respect to 19
270	270	whether a foreign person is subject to sanctions under sub-20
271	271	section (a) pursuant to the criteria set forth in that sub-21
272	272	section, the President shall— 22
273	273	(1) determine if the person meets those criteria; 23
274	274	and 24

279	279	such chairman and ranking member with respect to 2
280	280	the determination under paragraph (1) that includes 3
281	281	a statement of whether or not the President has im-4
282	282	posed or intends to impose sanctions with respect to 5
283	283	that person. 6

285	285	ENALTIES.— 7
286	286	(1) I
287	287	N GENERAL.—The penalties provided for in 8
288	288	subsections (b) and (c) of section 206 of the Inter-9
289	289	national Emergency Economic Powers Act (50 10
290	290	U.S.C. 1705) shall apply to a person that knowingly 11
291	291	violates, attempts to violate, conspires to violate, or 12
292	292	causes a violation of regulations prescribed under 13
293	293	section 7(b) to carry out paragraph (1) or (2)(F) of 14
294	294	subsection (c) to the same extent that such penalties 15
295	295	apply to a person that knowingly commits an unlaw-16
296	296	ful act described in section 206(a) of that Act. 17
297	297	(2) A
298	298	UTHORITIES.—The President may exercise 18
299	299	all authorities provided to the President under sec-19
300	300	tions 203 and 205 of the International Emergency 20
301	301	Economic Powers Act (50 U.S.C. 1702 and 1704) 21
302	302	for purposes of carrying out paragraphs (1) and 22
303	303	(2)(F) of subsection (c). 23

305	305	XCEPTION.—The President shall not be required 24
306	306	to impose sanctions under this section with respect to a 25

311	311	state if the President certifies in writing to the appropriate 2
312	312	congressional committees that— 3
313	313	(1) the foreign person or agency or instrumen-4
314	314	tality (as the case may be)— 5
315	315	(A) is no longer carrying out activities or 6
316	316	transactions subject to sanctions under this sec-7
317	317	tion; or 8
318	318	(B) has taken and is continuing to take 9
319	319	significant verifiable steps toward terminating 10
320	320	activities or transactions subject to sanctions 11
321	321	under this section; and 12
322	322	(2) the President has received reliable assur-13
323	323	ances from the foreign person or agency or instru-14
324	324	mentality (as the case may be) that it will not carry 15
325	325	out any activities or transactions subject to sanc-16
326	326	tions under this section in the future. 17

328	328	AIVER.— 18
329	329	(1) I
330	330	N GENERAL.—The President may waive, 19
331	331	on a case-by-case basis and for a period of not more 20
332	332	than 180 days, a requirement under this section to 21
333	333	impose or maintain sanctions with respect to a for-22
334	334	eign person or agency or instrumentality of a foreign 23
335	335	state if the President— 24

340	340	national security interest of the United States; 2
341	341	and 3
342	342	(B) not less than 30 days before the waiv-4
343	343	er takes effect, submits to the appropriate con-5
344	344	gressional committees a report on the waiver 6
345	345	and the justification for the waiver. 7
346	346	(2) R
347	347	ENEWAL OF WAIVER .—The President 8
348	348	may, on a case-by-case basis, renew a waiver under 9
349	349	paragraph (1) for additional periods of not more 10
350	350	than 180 days if the President— 11
351	351	(A) determines that the renewal of the 12
352	352	waiver is in the national security interest of the 13
353	353	United States; and 14
354	354	(B) not less than 15 days before the waiv-15
355	355	er expires, submits to the appropriate congres-16
356	356	sional committees a report on the renewal of 17
357	357	the waiver and the justification for the renewal 18
358	358	of the waiver. 19

360	360	ULE OFCONSTRUCTION.—The authority to im-20
361	361	pose sanctions under this section with respect to a foreign 21
362	362	person or an agency or instrumentality of a foreign state 22
363	363	is in addition to the authority to impose sanctions under 23
364	364	any other provision of law with respect to foreign persons 24

371	371	FFECTIVEDATE.—This section shall take effect 3
372	372	on the date of the enactment of this Act and apply with 4
373	373	respect to activities and transactions described in sub-5
374	374	section (a) that are carried out on or after such date of 6
375	375	enactment. 7
376	376	SEC. 5. IMPOSITION OF SANCTIONS WITH RESPECT TO FOR-8
377	377	EIGN GOVERNMENTS THAT PROVIDE MATE-9
378	378	RIAL SUPPORT FOR THE TERRORIST ACTIVI-10
379	379	TIES OF HAMAS, THE PALESTINIAN ISLAMIC 11
380	380	JIHAD, OR ANY AFFILIATE OR SUCCESSOR 12
381	381	THEREOF. 13
382	382	(a) I
383	383	DENTIFICATION.— 14
384	384	(1) I
385	385	N GENERAL.—Not later than 180 days 15
386	386	after the date of the enactment of this Act, and 16
387	387	every 180 days thereafter, the President shall sub-17
388	388	mit to the appropriate congressional committees a 18
389	389	report that identifies the following: 19
390	390	(A) Each government of a foreign country 20
391	391	that— 21
392	392	(i) the Secretary of State determines 22
393	393	has repeatedly provided support for acts of 23
394	394	international terrorism pursuant to section 24
395	395	1754(c) of the Export Control Reform Act 25

400	400	the Arms Export Control Act (22 U.S.C. 2
401	401	2780), section 620A of the Foreign Assist-3
402	402	ance Act of 1961 (22 U.S.C. 2371), or any 4
403	403	other provision of law; and 5
404	404	(ii) the President determines has pro-6
405	405	vided direct or indirect material support 7
406	406	for the terrorist activities of Hamas, the 8
407	407	Palestinian Islamic Jihad, or any affiliate 9
408	408	or successor thereof. 10
409	409	(B) Each government of a foreign country 11
410	410	that— 12
411	411	(i) is not identified under subpara-13
412	412	graph (A); and 14
413	413	(ii) the President determines know-15
414	414	ingly engaged in a significant transaction 16
415	415	that contributes to the efforts by the gov-17
416	416	ernment of a foreign country described in 18
417	417	subparagraph (A)(i) to provide direct or 19
418	418	indirect material support for the terrorist 20
419	419	activities of Hamas, the Palestinian Is-21
420	420	lamic Jihad, or any affiliate or successor 22
421	421	thereof. 23

425	425	(2) FORM OF REPORT.—Each report submitted 1
426	426	under paragraph (1) shall be submitted in unclassi-2
427	427	fied form but may contain a classified annex. 3
428	428	(b) I
429	429	MPOSITION OFSANCTIONS.—The President shall 4
430	430	impose the following sanctions with respect to each gov-5
431	431	ernment of a foreign country identified under subpara-6
432	432	graph (A) or (B) of subsection (a)(1): 7
433	433	(1) The United States Government shall sus-8
434	434	pend, for a period of one year, United States assist-9
435	435	ance to the government of the foreign country. 10
436	436	(2) The Secretary of the Treasury shall instruct 11
437	437	the United States Executive Director to each appro-12
438	438	priate international financial institution to oppose, 13
439	439	and vote against, for a period of one year, the exten-14
440	440	sion by that institution of any loan or financial or 15
441	441	technical assistance to the government of the foreign 16
442	442	country. 17
443	443	(3) No item on the United States Munitions 18
444	444	List under section 38(a)(1) of the Arms Export 19
445	445	Control Act (22 U.S.C. 2778(a)(1)) or the Com-20
446	446	merce Control List set forth in Supplement No. 1 to 21
447	447	part 774 of title 15, Code of Federal Regulations (or 22
448	448	any successor list), may be exported to the govern-23
449	449	ment of the foreign country for a period of one year. 24

466	466	lations as the President may prescribe, prohibit any 13
467	467	transfers of credit or payments between one or more 14
468	468	financial institutions or by, through, or to any finan-15
469	469	cial institution, to the extent that such transfers or 16
470	470	payments are subject to the jurisdiction of the 17
471	471	United States and involve any interest of the govern-18
472	472	ment of the foreign country. 19

507	507	out operations relating to humanitarian assist-24

554	554	tion to the authority to impose sanctions under any other 11
555	555	provision of law with respect to governments of foreign 12
556	556	countries that provide material support to foreign terrorist 13
557	557	organizations designated pursuant to section 219 of the 14
558	558	Immigration and Nationality Act (8 U.S.C. 1189). 15

560	560	ERMINATION.—The President may terminate 16
561	561	any sanctions imposed with respect to the government of 17
562	562	a foreign country under subsection (b) or (c) if the Presi-18
563	563	dent determines and notifies the appropriate congressional 19
564	564	committees that the government of the foreign country is 20
565	565	no longer carrying out activities or transactions for which 21
566	566	the sanctions were imposed and has provided assurances 22
567	567	to the United States Government that it will not carry 23
568	568	out those activities or transactions in the future. 24

615	615	ernment to encourage that govern-14

619	619	affiliate or successor thereof, conducts signifi-18
620	620	cant fundraising, financing, or money laun-19
