14	14	To amend the Agricultural Trade Act of 1978 to preserve
15	15	foreign markets for goods using common names, and
16	16	for other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Safeguarding Amer-4
21	21	ican Value-added Exports Act of 2023’’ or the ‘‘SAVE Act 5
22	22	of 2023’’. 6

29	29	EFINITIONS.—Section 102 of the Agricultural 3
30	30	Trade Act of 1978 (7 U.S.C. 5602) is amended— 4
31	31	(1) in the matter preceding paragraph (1), by 5
32	32	striking ‘‘As used in this Act—’’ and inserting ‘‘In 6
33	33	this Act:’’; 7
34	34	(2) by redesignating paragraphs (2) through 8
35	35	(8) as paragraphs (3), (5), (6), (7), (8), (9), and 9
36	36	(4), respectively, and reordering accordingly; 10
37	37	(3) by inserting after paragraph (1) the fol-11
38	38	lowing: 12
39	39	‘‘(2) C
40	40	OMMON NAME.— 13
41	41	‘‘(A) I
42	42	N GENERAL.—The term ‘common 14
43	43	name’ means a name that, as determined by the 15
44	44	Secretary— 16
45	45	‘‘(i) is ordinarily or customarily used 17
46	46	for an agricultural commodity or food 18
47	47	product; 19
48	48	‘‘(ii) is typically placed on the pack-20
49	49	aging and product label of the agricultural 21
50	50	commodity or food product; 22
51	51	‘‘(iii) with respect to wine— 23
52	52	‘‘(I) is— 24

57	57	arily used for a wine grape vari-2
58	58	etal name; or 3
59	59	‘‘(bb) a traditional term or 4
60	60	expression that is typically placed 5
61	61	on the packaging and label of the 6
62	62	wine; and 7
63	63	‘‘(II) does not mean any appella-8
64	64	tion of origin for wine listed in sub-9
65	65	part C of part 9 of title 27, Code of 10
66	66	Federal Regulations (or successor reg-11
67	67	ulations); and 12
68	68	‘‘(iv) the use of which is consistent 13
69	69	with standards of the Codex Alimentarius 14
70	70	Commission. 15

72	72	ONSIDERATIONS.—In making a de-16
73	73	termination under subparagraph (A), the Sec-17
74	74	retary may take into account— 18
75	75	‘‘(i) competent sources, such as dic-19
76	76	tionaries, newspapers, professional journals 20
77	77	and literature, and information posted on 21
78	78	websites that are determined by the Sec-22
79	79	retary to be reliable in reporting market 23
80	80	information; 24

84	84	‘‘(ii) the use of the common name in 1
85	85	a domestic, regional, or international prod-2
86	86	uct standard, including a standard promul-3
87	87	gated by the Codex Alimentarius Commis-4
88	88	sion, for the agricultural commodity or 5
89	89	food product; and 6
90	90	‘‘(iii) the ordinary and customary use 7
91	91	of the common name in the production or 8
92	92	marketing of the agricultural commodity or 9
93	93	food product in the United States or in 10
94	94	other countries.’’; and 11
95	95	(4) in paragraph (7) (as so redesignated), in 12
96	96	subparagraph (A)— 13
97	97	(A) in clause (v), by striking ‘‘or’’ at the 14
98	98	end; 15
99	99	(B) in clause (vi), by striking the period at 16
100	100	the end and inserting ‘‘; or’’; and 17
101	101	(C) by adding at the end the following: 18
102	102	‘‘(vii) prohibits or disallows the use of 19
103	103	the common name of an agricultural com-20
104	104	modity or food product of the United 21
105	105	States.’’. 22

115	115	‘‘SEC. 303. NEGOTIATIONS TO DEFEND THE USE OF COM-3
116	116	MON NAMES. 4
117	117	‘‘(a) I
118	118	NGENERAL.—The Secretary shall coordinate 5
119	119	efforts with the United States Trade Representative to se-6
120	120	cure the right of United States agricultural producers, 7
121	121	processors, and exporters to use common names for agri-8
122	122	cultural commodities or food products in foreign markets 9
123	123	through the negotiation of bilateral, plurilateral, or multi-10
124	124	lateral agreements, memoranda of understanding, or ex-11
125	125	changes of letters that assure the current and future use 12
126	126	of each common name identified by the Secretary in con-13
127	127	nection with United States agricultural commodities or 14
128	128	food products. 15
129	129	‘‘(b) R
130	130	EPORT.—The Secretary and the United States 16
131	131	Trade Representative shall submit to Congress a report 17
132	132	every 2 years regarding efforts and successes in carrying 18
133	133	out subsection (a).’’. 19
