2929 EFINITIONS.—Section 102 of the Agricultural 3
3030 Trade Act of 1978 (7 U.S.C. 5602) is amended— 4
3131 (1) in the matter preceding paragraph (1), by 5
3232 striking ‘‘As used in this Act—’’ and inserting ‘‘In 6
3333 this Act:’’; 7
3434 (2) by redesignating paragraphs (2) through 8
3535 (8) as paragraphs (3), (5), (6), (7), (8), (9), and 9
3636 (4), respectively, and reordering accordingly; 10
3737 (3) by inserting after paragraph (1) the fol-11
3838 lowing: 12
3939 ‘‘(2) C
4040 OMMON NAME.— 13
4141 ‘‘(A) I
4242 N GENERAL.—The term ‘common 14
4343 name’ means a name that, as determined by the 15
4444 Secretary— 16
4545 ‘‘(i) is ordinarily or customarily used 17
4646 for an agricultural commodity or food 18
4747 product; 19
4848 ‘‘(ii) is typically placed on the pack-20
4949 aging and product label of the agricultural 21
5050 commodity or food product; 22
5151 ‘‘(iii) with respect to wine— 23
5252 ‘‘(I) is— 24

6363 ‘‘(II) does not mean any appella-8
6464 tion of origin for wine listed in sub-9
6565 part C of part 9 of title 27, Code of 10
6666 Federal Regulations (or successor reg-11
6767 ulations); and 12
6868 ‘‘(iv) the use of which is consistent 13
6969 with standards of the Codex Alimentarius 14

7272 ONSIDERATIONS.—In making a de-16
7373 termination under subparagraph (A), the Sec-17
7474 retary may take into account— 18
7575 ‘‘(i) competent sources, such as dic-19
7676 tionaries, newspapers, professional journals 20
7777 and literature, and information posted on 21
7878 websites that are determined by the Sec-22
7979 retary to be reliable in reporting market 23

8585 a domestic, regional, or international prod-2
8686 uct standard, including a standard promul-3
8787 gated by the Codex Alimentarius Commis-4
8888 sion, for the agricultural commodity or 5
8989 food product; and 6
9090 ‘‘(iii) the ordinary and customary use 7
9191 of the common name in the production or 8
9292 marketing of the agricultural commodity or 9
9393 food product in the United States or in 10
9494 other countries.’’; and 11
9595 (4) in paragraph (7) (as so redesignated), in 12
9696 subparagraph (A)— 13
9797 (A) in clause (v), by striking ‘‘or’’ at the 14
9898 end; 15
9999 (B) in clause (vi), by striking the period at 16
100100 the end and inserting ‘‘; or’’; and 17
101101 (C) by adding at the end the following: 18
102102 ‘‘(vii) prohibits or disallows the use of 19
103103 the common name of an agricultural com-20
104104 modity or food product of the United 21

115115 ‘‘SEC. 303. NEGOTIATIONS TO DEFEND THE USE OF COM-3
116116 MON NAMES. 4
117117 ‘‘(a) I
118118 NGENERAL.—The Secretary shall coordinate 5
119119 efforts with the United States Trade Representative to se-6
120120 cure the right of United States agricultural producers, 7
121121 processors, and exporters to use common names for agri-8
122122 cultural commodities or food products in foreign markets 9
123123 through the negotiation of bilateral, plurilateral, or multi-10
124124 lateral agreements, memoranda of understanding, or ex-11
125125 changes of letters that assure the current and future use 12
126126 of each common name identified by the Secretary in con-13
127127 nection with United States agricultural commodities or 14
128128 food products. 15
129129 ‘‘(b) R
130130 EPORT.—The Secretary and the United States 16
131131 Trade Representative shall submit to Congress a report 17
132132 every 2 years regarding efforts and successes in carrying 18
133133 out subsection (a).’’. 19
