1919 This Act may be cited as the ‘‘Global Technology 4
2020 Leadership Act’’. 5
2121 SEC. 2. OFFICE OF GLOBAL COMPETITION ANALYSIS. 6

2323 EFINITIONS.—In this Act: 7

2525 XECUTIVE AGENCY.—The term ‘‘Executive 8
2626 agency’’ has the meaning given such term in section 9
2727 105 of title 5, United States Code. 10

3131 (2) OFFICE.—The term ‘‘Office’’ means the Of-1

3535 STABLISHMENT.— 4

3737 N GENERAL.—The President shall establish 5
3838 an office for analysis of global competition. 6

4040 URPOSES.—The purposes of the Office are 7
4141 as follows: 8
4242 (A) To carry out a program of analysis rel-9
4343 evant to United States leadership in science, 10
4444 technology, and innovation sectors critical to 11
4545 national security and economic prosperity rel-12
4646 ative to other countries, particularly those coun-13
4747 tries that are strategic competitors of the 14
4848 United States. 15
4949 (B) To support policy development and de-16
5050 cision making across the Federal Government 17
5151 to ensure United States leadership in science, 18
5252 technology, and innovation sectors critical to 19
5353 national security and economic prosperity rel-20
5454 ative to other countries, particularly those coun-21
5555 tries that are strategic competitors of the 22
5656 United States. 23

6060 (3) DESIGNATION.—The office established 1
6161 under paragraph (1) shall be known as the ‘‘Office 2
6262 of Global Competition Analysis’’. 3
6363 (c) A
6464 CTIVITIES.—In accordance with the priorities 4
6565 determined under subsection (d), the Office shall— 5
6666 (1) subject to subsection (f), acquire, access, 6
6767 use, and handle data or other information relating 7
6868 to the purposes of the Office under subsection 8
6969 (b)(2); 9
7070 (2) conduct long- and short-term analyses re-10
7171 garding— 11
7272 (A) United States policies that enable tech-12
7373 nological competitiveness relative to those of 13
7474 other countries, particularly with respect to 14
7575 countries that are strategic competitors of the 15
7676 United States; 16
7777 (B) United States science and technology 17
7878 ecosystem elements, including regional and na-18
7979 tional research development and capacity, tech-19
8080 nology innovation, and science and engineering 20
8181 education and research workforce, relative to 21
8282 those of other countries, particularly with re-22
8383 spect to countries that are strategic competitors 23
8484 of the United States; 24

8989 commercialization, and advanced manufacturing 2
9090 ecosystem elements, including supply chain re-3
9191 siliency, scale-up manufacturing testbeds, ac-4
9292 cess to venture capital and financing, technical 5
9393 and entrepreneurial workforce, and production, 6
9494 relative to those of other countries, particularly 7
9595 with respect to countries that are strategic com-8
9696 petitors of the United States; 9
9797 (D) United States competitiveness in tech-10
9898 nology and innovation sectors critical to na-11
9999 tional security and economic prosperity relative 12
100100 to other countries, including the availability and 13
101101 scalability of United States technology in such 14
102102 sectors abroad, particularly with respect to 15
103103 countries that are strategic competitors of the 16
104104 United States; 17
105105 (E) trends and trajectories, including rate 18
106106 of change in technologies, related to technology 19
107107 and innovation sectors critical to national secu-20
108108 rity and economic prosperity; 21
109109 (F) threats to United States national secu-22
110110 rity interests as a result of any foreign coun-23
111111 try’s dependence on technologies of strategic 24
112112 competitors of the United States; and 25

117117 based on dependencies on foreign technologies 2
118118 critical to national security and economic pros-3
119119 perity; 4
120120 (3) solicit input on technology and economic 5
121121 trends, data, and metrics from relevant private sec-6
122122 tor stakeholders, including entities involved in fi-7
123123 nancing technology development and commercializa-8
124124 tion, and engage with academia to inform the anal-9
125125 yses under paragraph (2); and 10
126126 (4) to the greatest extent practicable and as 11
127127 may be appropriate, ensure that versions of the 12
128128 analyses under paragraph (2) are unclassified and 13
129129 available to relevant Federal agencies and offices. 14

131131 ETERMINATION OF PRIORITIES.—On a periodic 15
132132 basis, the Director of the Office of Science and Technology 16
133133 Policy, the Assistant to the President for Economic Policy, 17
134134 and the Assistant to the President for National Security 18
135135 Affairs shall, in coordination with such heads of Executive 19
136136 agencies as the Director of the Office of Science and Tech-20
137137 nology Policy and such Assistants jointly consider appro-21
138138 priate, jointly determine the priorities of the Office with 22
139139 respect to subsection (b)(2)(A), considering, as may be ap-23
140140 propriate, the strategies and reports under subtitle B of 24

145145 and Innovation Act (Public Law 117–167). 2
146146 (e) A
147147 DMINISTRATION.—Subject to the availability of 3
148148 appropriations, to carry out the purposes set forth under 4
149149 subsection (b)(2), the Office shall enter into an agreement 5
150150 with a federally funded research and development center, 6
151151 a university affiliated research center, or a consortium of 7
152152 federally funded research and development centers and 8
153153 university-affiliated research centers. 9

155155 CQUISITION, ACCESS, USE, ANDHANDLING OF 10
156156 D
157157 ATA ORINFORMATION.—In carrying out the activities 11
158158 under subsection (c), the Office— 12
159159 (1) shall acquire, access, use, and handle data 13
160160 or information in a manner consistent with applica-14
161161 ble provisions of law and policy, including laws and 15
162162 policies providing for the protection of privacy and 16
163163 civil liberties, and subject to any restrictions re-17
164164 quired by the source of the information; 18
165165 (2) shall have access, upon written request, to 19
166166 all information, data, or reports of any Executive 20
167167 agency that the Office determines necessary to carry 21
168168 out the activities under subsection (c), provided that 22
169169 such access is— 23
170170 (A) conducted in a manner consistent with 24
171171 applicable provisions of law and policy of the 25

175175 originating agency, including laws and policies 1
176176 providing for the protection of privacy and civil 2
177177 liberties; and 3
178178 (B) consistent with due regard for the pro-4
179179 tection from unauthorized disclosure of classi-5
180180 fied information relating to sensitive intelligence 6
181181 sources and methods or other exceptionally sen-7
182182 sitive matters; and 8
183183 (3) may obtain commercially available informa-9
184184 tion that may not be publicly available. 10
185185 (g) D
186186 ETAILEESUPPORT.—Consistent with applicable 11
187187 law, including sections 1341, 1517, and 1535 of title 31, 12
188188 United States Code, and section 112 of title 3, United 13
189189 States Code, the head of a department or agency within 14
190190 the executive branch of the Federal Government may de-15
191191 tail personnel to the Office in order to assist the Office 16
192192 in carrying out any activity under subsection (c), con-17
193193 sistent with the priorities determined under subsection (d). 18
194194 (h) A
195195 NNUALREPORT.—Not less frequently than once 19
196196 each year, the Office shall submit to Congress a report 20
197197 on the activities of the Office under this section, including 21
198198 a description of the priorities under subsection (d) and any 22
199199 support, disaggregated by Executive agency, provided to 23
200200 the Office consistent with subsection (g) in order to ad-24
201201 vance those priorities. 25

205205 (i) PLANS.—Before establishing the Office under 1
206206 subsection (b)(1), the President shall submit to Congress 2
207207 a report detailing plans for— 3
208208 (1) the administrative structure of the Office, 4
209209 including— 5
210210 (A) a detailed spending plan that includes 6
211211 administrative costs; and 7
212212 (B) a disaggregation of costs associated 8
213213 with carrying out subsection (e); 9
214214 (2) ensuring consistent and sufficient funding 10
215215 for the Office; and 11
216216 (3) coordination between the Office and rel-12
217217 evant Executive agencies and offices. 13
218218 (j) A
219219 UTHORIZATION OF APPROPRIATIONS.—There is 14
220220 authorized to be appropriated to carry out this Act 15
221221 $20,000,000 for fiscal year 2024. 16

223223 UNDING.—This Act shall be carried out using 17
224224 amounts appropriated on or after the date of the enact-18
225225 ment of this Act. 19
