E-Access Act Access to Consumer Energy Information Act

Impact

The legislation is expected to significantly impact state laws governing the access and sharing of energy data. Specifically, it mandates the creation of model data sharing standards that electric and gas utilities must comply with. These standards are aimed at ensuring that consumers have easy access to their energy usage data, enabling them to make informed decisions regarding their energy consumption. Additionally, the bill's provisions for third-party applications emphasize the importance of competition in the energy sector, potentially leading to enhanced services and consumer options in energy management solutions.

Summary

SB1936, also known as the Access to Consumer Energy Information Act, aims to enhance consumer access to electric energy and natural gas information while promoting competition in the area of digital energy management tools. The bill outlines the responsibilities of electric and gas utilities to provide consumers with accurate and timely access to their energy usage data. By facilitating the sharing of this data through standardized platforms, the bill seeks to empower consumers to manage their energy consumption and expenditures more effectively. Furthermore, it includes the establishment of guidelines for third-party applications that can leverage this data to create innovative energy management solutions.

Contention

While the bill has garnered support for its consumer-friendly approach, there are notable points of contention regarding data privacy and security. Critics have raised concerns about how consumer data will be protected in the digital environment, particularly when shared with third-party entities. Ensuring that consumer information remains confidential and secure while promoting data sharing is a delicate balance that the bill must address. Furthermore, some stakeholders worry that the rapid adoption of digital tools could lead to a mismatch between utility services and consumer needs, especially among vulnerable populations who may not be as adept at utilizing digital platforms.

Regulatory Accountability Act This bill expands and provides statutory authority for notice-and-comment rulemaking procedures to require federal agencies to consider (1) whether a rulemaking is required by statute or is within the discretion of the agency, (2) whether existing laws or rules could be amended or rescinded to address the problem, and (3) reasonable alternatives to a new rule. For proposed major or high-impact rules that have a specified significant economic impact or adverse effect on the public health or safety, an agency must publish notice of such rulemaking to invite interested parties to propose alternatives and ideas to accomplish the agency's objectives; allow persons interested in high-impact or certain major rules to petition for a public hearing with oral presentation, cross-examination, and the burden of proof on the proponent of the rule; adopt the rule that maximizes net benefits within the scope of the statutory provision authorizing the rule, unless the agency explains the costs and benefits that justify adopting an alternative rule and such rule is approved by the Office of Information and Regulatory Affairs (OIRA); and publish a framework and metrics for measuring the ongoing effectiveness of the rule. Agencies must notify OIRA with certain information about a proposed rulemaking, including specified discussion and preliminary explanations concerning a major or high-impact rule. Further, OIRA must establish certain rulemaking guidelines. Additionally, the bill (1) revises the scope of judicial review of agency actions, and (2) establishes requirements for agencies issuing guidance.
