A BILL
To amend the Federal Crop Insurance Act to require re-
search and development regarding a policy to insure wine
grapes against losses due to smoke exposure, and for
other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Smoke Exposure Crop 4
Insurance Act of 2023’’. 5

SEC. 2. POLICY TO INSURE WINE GRAPES AGAINST LOSSES 1
DUE TO SMOKE EXPOSURE. 2
Section 522(c) of the Federal Crop Insurance Act (7 3
U.S.C. 1522(c)) is amended by adding at the end the fol-4
lowing: 5
‘‘(20) W
INE GRAPES.— 6
‘‘(A) I
N GENERAL.—Not later than 1 year 7
after the date of enactment of this paragraph, 8
the Corporation shall carry out research and 9
development, or offer to enter into 1 or more 10
contracts with 1 or more qualified persons to 11
carry out research and development, regarding 12
a policy to insure wine grapes (including wine 13
grapes produced in the States of California, Or-14
egon, and Washington) against losses due to 15
wildfire smoke exposure. 16
‘‘(B) A
VAILABILITY OF POLICY.—Notwith-17
standing the second sentence of section 18
508(a)(1), and section 508(a)(2), not later than 19
18 months after the date of enactment of this 20
paragraph, the Corporation shall make available 21
a policy described in subparagraph (A) if the 22
requirements of section 508(h) are met with re-23
spect to that policy. 24
‘‘(C) R
EPORT.—Not later than 2 years 25
after the date of enactment of this paragraph, 26

the Corporation shall submit to the Committees 1
on Appropriations and Agriculture of the House 2
of Representatives and the Committees on Ap-3
propriations and Agriculture, Nutrition, and 4
Forestry of the Senate a report that includes— 5
‘‘(i) the results of the research carried 6
out under subparagraph (A); 7
‘‘(ii) a description of the policy made 8
available under subparagraph (B); and 9
‘‘(iii) an evaluation of the feasibility of 10
a policy that allows producers to claim an 11
indemnity through post-harvest, post- 12
vinification testing, if such testing dem-13
onstrates smoke damage that was not de-14
tectable prior to harvest.’’. 15
