16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Defense Support for 4
20	20	Cyber Emergencies Response Act’’. 5
21	21	SEC. 2. SELECTED RESERVE AND READY RESERVE ORDER 6
22	22	TO ACTIVE DUTY TO RESPOND TO A SIGNIFI-7
23	23	CANT CYBER INCIDENT. 8
24	24	Section 12304 of title 10, United States Code, is 9
25	25	amended— 10

40	40	member affected, order any unit, and any member not as-10
41	41	signed to a unit organized to serve as a unit, of the Se-11
42	42	lected Reserve or Individual Ready Reserve to active duty 12
43	43	for a continuous period of not more than 365 days when 13
44	44	the Secretary of Defense determines it is necessary to aug-14
45	45	ment the active forces for a Department of Defense re-15
46	46	sponse to a covered incident.’’; 16
47	47	(4) in paragraph (1) of subsection (d), as redes-17
48	48	ignated by paragraph (2) of this section, by insert-18
49	49	ing ‘‘or subsection (c)’’ after ‘‘subsection (b)’’; 19
50	50	(5) in subsection (h) (as so redesignated)— 20
51	51	(A) by redesignating paragraphs (1) and 21
52	52	(2) as subparagraphs (A) and (B), respectively; 22
53	53	(B) by striking ‘‘Whenever any’’ and in-23
54	54	serting ‘‘(1) Whenever any’’; and 24

59	59	paragraph: 2
60	60	‘‘(2) Whenever any unit of the Selected Reserve or 3
61	61	any member of the Selected Reserve not assigned to a unit 4
62	62	organized to serve as a unit, or any member of the Indi-5
63	63	vidual Ready Reserve, is ordered to active duty under au-6
64	64	thority of subsection (c), the service of all units or mem-7
65	65	bers so ordered to active duty may be terminated by— 8
66	66	‘‘(A) order of the Secretary of Defense; or 9
67	67	‘‘(B) law.’’; and 10
68	68	(6) in subsection (k) (as so redesignated)— 11
69	69	(A) by redesignating paragraph (2) as 12
70	70	paragraph (3); and 13
71	71	(B) by inserting after paragraph (1) the 14
72	72	following new paragraph: 15
73	73	‘‘(2) The term ‘covered incident’ means— 16
74	74	‘‘(A) a cyber incident involving a Depart-17
75	75	ment of Defense information system, or a 18
76	76	breach of a Department of Defense system that 19
77	77	involves personally identifiable information, that 20
78	78	the Secretary of Defense determines is likely to 21
79	79	result in demonstrable harm to the national se-22
80	80	curity interests, foreign relations, or the econ-23
81	81	omy of the United States, or to the public con-24

86	86	ty of the people of the United States; 2
87	87	‘‘(B) a cyber incident or collection of re-3
88	88	lated cyber incidents that the President deter-4
89	89	mines is likely to result in demonstrable harm 5
90	90	to the national security interests, foreign rela-6
91	91	tions, or economy of the United States or to the 7
92	92	public confidence, civil liberties, or public health 8
93	93	and safety of the people of the United States; 9
94	94	or 10
95	95	‘‘(C) a significant incident declared pursu-11
96	96	ant to section 2233 of the Homeland Security 12
97	97	Act of 2002 (6 U.S.C. 677b).’’. 13
