4343 eral Power Act (16 U.S.C. 824o(a)). 13

7272 N GENERAL.—Except as provided in para-9
7373 graph (3) and subsection (e), no person may con-10
7474 struct, connect, operate, or maintain a border-cross-11
7575 ing facility for the import or export of oil or natural 12
7676 gas, or the transmission of electricity, across an 13
7777 international border of the United States without 14
7878 obtaining a certificate of crossing for the border- 15
7979 crossing facility under this subsection. 16

8181 ERTIFICATE OF CROSSING.— 17

8383 EQUIREMENT.—Not later than 120 18
8484 days after the date on which final action is 19
8585 taken by the relevant official or agency de-20
8686 scribed in subparagraph (B) under the National 21
8787 Environmental Policy Act of 1969 (42 U.S.C. 22
8888 4321 et seq.) with respect to a border-crossing 23
8989 facility for which a person requests a certificate 24
9090 of crossing under this subsection, the relevant 25

103103 SCRIBED.—The relevant official or agency re-9
104104 ferred to in subparagraph (A) is— 10
105105 (i) the Federal Energy Regulatory 11
106106 Commission with respect to border-cross-12
107107 ing facilities consisting of oil or natural 13
108108 gas pipelines; and 14
109109 (ii) the Secretary of Energy, with re-15
110110 spect to border-crossing facilities consisting 16
111111 of electric transmission facilities. 17

113113 DDITIONAL REQUIREMENT FOR 18
114114 ELECTRIC TRANSMISSION FACILITIES .—In the 19
115115 case of a request for a certificate of crossing for 20
116116 a border-crossing facility consisting of an elec-21
117117 tric transmission facility, the Secretary of En-22
118118 ergy shall require, as a condition of issuing the 23
119119 certificate of crossing under subparagraph (A), 24
120120 that the border-crossing facility be constructed, 25

128128 (ii) any Regional Transmission Orga-5

130130 with operational or functional control over 7
131131 the border-crossing facility. 8

133133 XCLUSIONS.— 9
134134 (A) I
135135 N GENERAL.—This subsection shall 10
136136 not apply to any construction, connection, oper-11
137137 ation, or maintenance of a border-crossing facil-12
138138 ity for the import or export of oil or natural 13
139139 gas, or the transmission of electricity if— 14
140140 (i) the border-crossing facility is oper-15
141141 ating for such import, export, or trans-16
142142 mission as of the date of enactment of this 17
143143 Act; 18
144144 (ii) a permit described in subsection 19
145145 (e) for the construction, connection, oper-20
146146 ation, or maintenance has been issued; or 21
147147 (iii) subject to subparagraph (B), an 22
148148 application for a permit described in sub-23
149149 section (e) for the construction, connection, 24

157157 spect to an application described in clause (iii) 4
158158 of subparagraph (A), the exclusion described in 5
159159 that subparagraph shall apply until the earlier 6
160160 of— 7
161161 (i) the date on which the application 8
162162 is denied; or 9
163163 (ii) that date that is 2 years after the 10
164164 date of enactment of this Act, if the permit 11
165165 described in that clause has not been 12
166166 issued by that date. 13

168168 FFECT OF OTHER LAWS .— 14

170170 PPLICATION TO PROJECTS .—Nothing 15
171171 in this subsection or subsection (f) shall affect 16
172172 the application of any other Federal statute to 17
173173 a project for which a certificate of crossing for 18
174174 a border-crossing facility is requested under 19
175175 this subsection. 20

177177 ATURAL GAS ACT.—Nothing in this 21
178178 subsection or subsection (f) shall affect the re-22
179179 quirement to obtain approval or authorization 23
180180 under sections 3 and 7 of the Natural Gas Act 24
181181 (15 U.S.C. 717b, 717f) for the siting, construc-25

197197 ural Gas Act (15 U.S.C. 717b(c)) is amended by adding 10
198198 at the end the following: ‘‘In the case of an application 11
199199 for the importation of natural gas from, or the exportation 12
200200 of natural gas to, Canada or Mexico, the Commission shall 13
201201 grant the application not later than 30 days after the date 14
202202 on which the Commission receives the complete applica-15

230230 Federal Power Act’’ in the first sentence and 10
231231 all that follows through the period at the end 11
232232 of the second sentence and inserting ‘‘the Sec-12

245245 tofore performed by the President with respect to electric 24
246246 power and natural gas facilities located on the borders of 25

253253 an oil or natural gas pipeline or electric transmission facil-4
254254 ity, or any border-crossing facility thereof. 5

256256 ODIFICATIONS TO EXISTINGPROJECTS.—No 6
257257 certificate of crossing under subsection (b), or permit de-7
258258 scribed in subsection (e), shall be required for a modifica-8
259259 tion to— 9
260260 (1) an oil or natural gas pipeline or electric 10
261261 transmission facility that is operating for the import 11
262262 or export of oil or natural gas or the transmission 12
263263 of electricity as of the date of enactment of this Act; 13
264264 (2) an oil or natural gas pipeline or electric 14
265265 transmission facility for which a permit described in 15
266266 subsection (e) has been issued; or 16
267267 (3) a border-crossing facility for which a certifi-17
268268 cate of crossing has previously been issued under 18
269269 subsection (b). 19

271271 FFECTIVEDATE; RULEMAKINGDEADLINES.— 20

273273 FFECTIVE DATE .—Subsections (b) 21
274274 through (f), and the amendments made by those 22
275275 subsections, shall take effect on the date that is 1 23
276276 year after the date of enactment of this Act. 24

281281 official or agency described in subsection (b)(2)(B) 2

283283 (A) not later than 180 days after the date 4
284284 of enactment of this Act, publish in the Federal 5
285285 Register a notice of proposed rulemaking to 6
286286 carry out the applicable requirements of sub-7
287287 section (b); and 8
288288 (B) not later than 1 year after the date of 9
289289 enactment of this Act, publish in the Federal 10
290290 Register a final rule to carry out the applicable 11
291291 requirements of subsection (b). 12
