16	16	ment of Defense-wide research, development, test, and
17	17	evaluation activities, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Research, Develop-4
22	22	ment, Test and Evaluation Unmet Needs Act of 2023’’. 5

30	30	NGENERAL.—Chapter 9 of title 10, United 4
31	31	States Code, is amended by inserting after section 222d 5
32	32	the following new section: 6
33	33	‘‘§ 222e. Unfunded priorities for research, develop-7
34	34	ment, test, and evaluation activities 8
35	35	‘‘(a) A
36	36	NNUALREPORT.—Not later than 10 days after 9
37	37	the date on which the budget of the President for a fiscal 10
38	38	year is submitted to Congress pursuant to section 1105 11
39	39	of title 31, the Secretary of Defense shall submit to the 12
40	40	congressional defense committees a report on the un-13
41	41	funded priorities of the Department of Defense-wide re-14
42	42	search, development, test, and evaluation activities. 15
43	43	‘‘(b) C
44	44	ONTENTS.— 16
45	45	‘‘(1) I
46	46	N GENERAL.—Except as provided in sub-17
47	47	section (c), each report submitted under subsection 18
48	48	(a) shall specify, for each unfunded priority covered 19
49	49	by such report, the following: 20
50	50	‘‘(A) A summary description of such pri-21
51	51	ority, including the objectives to be achieved if 22
52	52	such priority is funded (whether in whole or in 23
53	53	part). 24

58	58	ommended in connection with the objectives 2
59	59	under subparagraph (A). 3
60	60	‘‘(C) Account information with respect to 4
61	61	such priority, including the following (as appli-5
62	62	cable): 6
63	63	‘‘(i) Line Item Number (LIN) for ap-7
64	64	plicable procurement accounts. 8
65	65	‘‘(ii) Program Element (PE) number 9
66	66	for applicable research, development, test, 10
67	67	and evaluation accounts. 11
68	68	‘‘(2) P
69	69	RIORITIZATION OF PRIORITIES.—The re-12
70	70	port under subsection (a) shall present the unfunded 13
71	71	priorities covered by such report in order of urgency 14
72	72	of priority. 15

76	76	EPORTS.—The report submitted under subsection (a) 17
77	77	shall not include unfunded priorities or requirements cov-18
78	78	ered in reports submitted under— 19
79	79	‘‘(1) section 222a or 222b; or 20
80	80	‘‘(2) section 2806 of the National Defense Au-21
81	81	thorization Act for Fiscal Year 2018 (Public Law 22
82	82	115–91; 10 U.S.C. 222a note). 23

84	84	NFUNDEDPRIORITYDEFINED.—In this sec-24
85	85	tion, the term ‘unfunded priority’, in the case of a fiscal 25

89	89	year, means a program, activity, or mission requirement, 1
90	90	that— 2
91	91	‘‘(1) is not funded in the budget of the Presi-3
92	92	dent for the fiscal year as submitted to Congress 4
93	93	pursuant to section 1105 of title 31; and 5
94	94	‘‘(2) would have been recommended for funding 6
95	95	through that budget if— 7
96	96	‘‘(A) additional resources had been avail-8
97	97	able for the budget to fund the program, activ-9
98	98	ity, or mission requirement; or 10
99	99	‘‘(B) the program, activity, or mission re-11
100	100	quirement has emerged since the budget was 12
101	101	formulated.’’. 13

103	103	LERICALAMENDMENT.—The table of sections 14
104	104	at the beginning of chapter 9 of such title is amended by 15
105	105	inserting after the item relating to section 222d the fol-16
106	106	lowing new item: 17
107	107	‘‘222e. Annual report on unfunded priorities for research, development, test, and
108	108	evaluation activities.’’.
