16	16	services to detect and prevent certain cancers.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Federal Firefighter 4
21	21	Cancer Detection and Prevention Act of 2023’’. 5

25	25	SEC. 2. MEDICAL TESTING AND RELATED SERVICES FOR 1
26	26	FIREFIGHTERS OF DEPARTMENT OF DE-2
27	27	FENSE. 3
28	28	(a) P
29	29	ROVISION OFSERVICES.—During the annual 4
30	30	periodic health assessment of each firefighter of the De-5
31	31	partment of Defense, or at such other intervals as may 6
32	32	be indicated in subsection (b), the Secretary of Defense 7
33	33	shall provide to the firefighter (at no cost to the fire-8
34	34	fighter) appropriate medical testing and related services 9
35	35	to detect, document the presence or absence of, and pre-10
36	36	vent, certain cancers. 11
37	37	(b) C
38	38	RITERIA.—Services required to be provided 12
39	39	under subsection (a) shall meet, at a minimum, the fol-13
40	40	lowing criteria: 14
41	41	(1) B
42	42	REAST CANCER.—With respect to breast 15
43	43	cancer screening, if the firefighter is a female fire-16
44	44	fighter— 17
45	45	(A) such services shall include the provi-18
46	46	sion of a mammogram to the firefighter— 19
47	47	(i) if the firefighter is 40 years old to 20
48	48	49 years old (inclusive), not less frequently 21
49	49	than twice each year; 22
50	50	(ii) if the firefighter is 50 years old or 23
51	51	older, not less frequently than annually; 24

56	56	(iii) as clinically indicated (without re-1
57	57	gard to age); and 2
58	58	(B) in connection with the provision of a 3
59	59	mammogram under subparagraph (A), a li-4
60	60	censed radiologist shall review the most recent 5
61	61	mammogram provided to the firefighter, as 6
62	62	compared to prior mammograms so provided, 7
63	63	and provide to the firefighter the results of such 8
64	64	review. 9
65	65	(2) C
66	66	OLON CANCER.—With respect to colon 10
67	67	cancer screening— 11
68	68	(A) if the firefighter is 40 years old or 12
69	69	older, or as clinically indicated without regard 13
70	70	to age, such services shall include the commu-14
71	71	nication to the firefighter of the risks and bene-15
72	72	fits of stool-based blood testing; 16
73	73	(B) if the firefighter is 45 years old or 17
74	74	older, or as clinically indicated without regard 18
75	75	to age, such services shall include the provision, 19
76	76	at regular intervals, of visual examinations 20
77	77	(such as a colonoscopy, CT colonoscopy, or 21
78	78	flexible sigmoidoscopy) or stool-based blood 22
79	79	testing; and 23
80	80	(C) in connection with the provision of a 24
81	81	visual examination or stool-based blood testing 25

85	85	under subparagraph (B), a licensed physician 1
86	86	shall review and provide to the firefighter the 2
87	87	results of such examination or testing, as the 3
88	88	case may be. 4
89	89	(3) P
90	90	ROSTATE CANCER.—With respect to pros-5
91	91	tate cancer screening, if the firefighter is a male 6
92	92	firefighter, such services shall include the commu-7
93	93	nication to the firefighter of the risks and benefits 8
94	94	of prostate cancer screenings and the provision to 9
95	95	the firefighter of a prostate-specific antigen test— 10
96	96	(A) not less frequently than annually if the 11
97	97	firefighter— 12
98	98	(i) is 50 years old or older; or 13
99	99	(ii) is 40 years old or older and is a 14
100	100	high-risk individual; and 15
101	101	(B) as clinically indicated (without regard 16
102	102	to age). 17
103	103	(4) O
104	104	THER CANCERS.—Such services shall in-18
105	105	clude routine screenings for any other cancer the 19
106	106	risk or occurrence of which the Director of the Cen-20
107	107	ters for Disease Control and Prevention has identi-21
108	108	fied as higher among firefighters than among the 22
109	109	general public, the provision of which shall be car-23
110	110	ried out during the annual periodic health assess-24
111	111	ment of the firefighter. 25

115	115	(c) OPTIONALNATURE.—A firefighter of the Depart-1
116	116	ment of Defense may opt out of the receipt of medical 2
117	117	testing or a related service provided under subsection (a). 3

119	119	SE OFCONSENSUSTECHNICALSTANDARDS.— 4
120	120	In providing medical testing and related services under 5
121	121	subsection (a), the Secretary shall use consensus technical 6
122	122	standards in accordance with section 12(d) of the National 7
123	123	Technology Transfer and Advancement Act of 1995 (Pub-8
124	124	lic Law 104–113; 15 U.S.C. 272 note). 9

128	128	N GENERAL.—In providing medical testing 11
129	129	and related services under subsection (a), the Sec-12
130	130	retary— 13
131	131	(A) shall document the acceptance rates of 14
132	132	such tests offered and the rates of such tests 15
133	133	performed; 16
134	134	(B) shall document tests results to identify 17
135	135	trends in the rates of cancer occurrences among 18
136	136	firefighters; and 19
137	137	(C) may collect and maintain additional in-20
138	138	formation from the recipients of such tests and 21
139	139	other services to allow for appropriate scientific 22
140	140	analysis. 23

142	142	RIVACY.—In analyzing any information of 24
143	143	an individual documented, collected, or maintained 25

148	148	other applicable privacy laws, the Secretary shall en-2
149	149	sure the name and any other personally identifiable 3
150	150	information of the individual is removed from such 4
151	151	information prior to the analysis. 5

153	153	HARING WITH CENTERS FOR DISEASE 6
154	154	CONTROL AND PREVENTION .—The Secretary may 7
155	155	share data from any tests performed under sub-8
156	156	section (a) with the Director of the Centers for Dis-9
157	157	ease Control and Prevention, as appropriate, to in-10
158	158	crease the knowledge and understanding of cancer 11
159	159	occurrences among firefighters. 12

161	161	EFINITIONS.—In this section: 13
162	162	(1) F
163	163	IREFIGHTER.—The term ‘‘firefighter’’ 14
164	164	means someone whose primary job or military occu-15
165	165	pational specialty is being a firefighter. 16
166	166	(2) H
167	167	IGH-RISK INDIVIDUAL.—The term ‘‘high- 17
168	168	risk individual’’ means an individual who— 18
169	169	(A) is African American; 19
170	170	(B) has at least one first-degree relative 20
171	171	who has been diagnosed with prostate cancer at 21
172	172	an early age; or 22
