110110 (2)(A) since 2019, more than 60,000,000 poul-9
111111 try and 10,000,000 swine have been depopulated; 10

113113 (B) those massive cullings are often conducted 12
114114 using incredibly inhumane practices including ven-13
115115 tilation shutdown, ventilation shutdown plus, sodium 14
116116 nitrite poisoning, and water-based foaming (as those 15
117117 terms are defined in section 114(a)); 16
118118 (3) since 2019, industrial operators put slaugh-17
119119 terhouse workers in jeopardy and cost taxpayers mil-18
120120 lions of dollars; 19
121121 (4) industrial operators continue to experience 20
122122 record profits, including a 300-percent growth in 21
123123 profits during the COVID–19 pandemic; 22
124124 (5) industrial operators have created a system 23
125125 that allows for the inhumane handling of non-24
126126 ambulatory livestock (as defined in section 3(a) of 25

132132 causes needless suffering, unsafe working conditions, 3
133133 and the spread of foodborne and zoonotic diseases; 4
134134 (6) industrial operators have abused the use of 5
135135 certain drugs that increase the risk of livestock be-6
136136 coming nonambulatory livestock (as so defined); 7
137137 (7) slaughterhouse deregulation and decreased 8
138138 Federal oversight of meat and poultry slaughter pose 9
139139 significant risks to workers, consumers, and animals; 10
140140 (8) Federal humane slaughter laws currently 11
141141 exempt 98 percent of animals slaughtered for food; 12
142142 (9) current Federal animal transport laws are 13
143143 ineffective and inherently cruel; and 14
144144 (10) Federal support is needed to create a level 15
145145 playing field for farmers engaged in higher-welfare 16
146146 practices who are struggling to compete in a highly 17
147147 monopolized market controlled by industrial opera-18
148148 tors. 19

160160 ing operation’’ or ‘‘AFO’’ means a single lot or 2
161161 facility at which— 3
162162 (i) for not less than a total of 45 days 4
163163 in any 12-month period, animals (other 5
164164 than aquatic animals) are— 6
165165 (I) stabled or confined; and 7
166166 (II) fed or maintained; and 8
167167 (ii) crops, vegetation, forage growth, 9
168168 or postharvest residues are not sustained 10
169169 in the normal growing season over any por-11
170170 tion of the lot or facility. 12

172172 ULTIPLE LOTS.—For purposes of 13
173173 subparagraph (A), 2 or more lots or facilities 14
174174 described in that subparagraph shall be consid-15
175175 ered to be a single animal feeding operation if 16
176176 the lots or facilities— 17
177177 (i) are located within 3 miles of each 18
178178 other; and 19
179179 (ii) are under common ownership or 20
180180 control. 21

182182 XCLUSION.—The term ‘‘animal feed-22
183183 ing operation’’ or ‘‘AFO’’ does not include a 23
184184 pasture-based livestock or poultry production 24
185185 system in which animals— 25

199199 term ‘‘covered industrial operator’’ means an indi-10
200200 vidual or entity that owns or controls not less than 11
201201 the following number of livestock or poultry, as ap-12
202202 plicable, that are housed in an AFO at a single point 13
203203 in time: 14
204204 (A) 2,500 swine. 15
205205 (B) 30,000 turkeys or ducks. 16
206206 (C) 82,000 laying hens or broilers. 17

208208 EPOPULATION.—The term ‘‘depopulation’’ 18
209209 means the rapid destruction of a population of ani-19
210210 mals in response to urgent circumstances. 20

212212 ISASTER EVENT.—The term ‘‘disaster 21
213213 event’’ means— 22
214214 (A) a public health emergency declared by 23
215215 the Secretary of Health and Human Services 24

230230 U.S.C. 7701 et seq.) or animal quarantine laws. 12

232232 IGH-RISK AFO.—The term ‘‘high-risk 13
233233 AFO’’ means an AFO that houses livestock or poul-14
234234 try owned or controlled by a covered industrial oper-15
235235 ator. 16

237237 FFICE.—The term ‘‘Office’’ means the Of-17
238238 fice of High-Risk AFO Disaster Mitigation and En-18
239239 forcement established under section 111. 19

244244 The Secretary shall establish an office within the De-24
245245 partment of Agriculture, to be known as the ‘‘Office of 25

252252 SEC. 112. REGISTRATION OF HIGH-RISK AFOS. 4

254254 EGISTRATIONREQUIREMENT.— 5

256256 N GENERAL.—A covered industrial oper-6
257257 ator shall be required to register with the Office 7
258258 prior to selling, buying, or transferring livestock, 8
259259 poultry, or any product derived from livestock or 9
260260 poultry across State lines. 10
261261 (2) I
262262 NFORMATION.—In registering with the Of-11
263263 fice under paragraph (1), a covered industrial oper-12
264264 ator shall submit to the Office— 13
265265 (A) identifying information about the cov-14
266266 ered industrial operator, including the location, 15
267267 animal type, and peak inventory animal totals 16
268268 for all high-risk AFOs owned or controlled by 17
269269 the covered industrial operator; and 18
270270 (B) a standard disaster mitigation plan 19
271271 that includes— 20
272272 (i) a description of the type, location, 21
273273 and extent of all potential disaster events 22
274274 that can affect livestock or poultry housed 23
275275 in a high-risk AFO, including information 24
276276 on previous occurrences of disaster events 25

282282 (ii) a plan to ensure that animals do 3
283283 not go without necessary resources such as 4
284284 shelter, food, and water during an extreme 5
285285 weather event; 6
286286 (iii) a plan to increase flexibility and 7
287287 resiliency, including— 8
288288 (I) identifying ways to house ani-9
289289 mals past their intended slaughter 10
290290 date; and 11
291291 (II) alternative slaughter and 12
292292 processing arrangements, including 13
293293 contracting with small-scale Depart-14
294294 ment of Agriculture, State-certified, 15
295295 or mobile operations with existing ca-16
296296 pacity, in the event of supply chain 17
297297 disruptions; 18
298298 (iv) a plan for accessing necessary re-19
299299 sources, personal protective equipment, 20
300300 and labor to carry out depopulation in 21
301301 ways that most rapidly render animals un-22
302302 conscious in the event that depopulation is 23
303303 unavoidable; 24

313313 (II) does not rely on unlined bur-7
314314 ial or onsite incineration; and 8
315315 (vi) other information, as determined 9
316316 appropriate by the Secretary. 10

318318 NNUAL SUBMISSION.—A covered industrial 11
319319 operator that is registered with the Office pursuant 12
320320 to this subsection shall submit to the Office the in-13
321321 formation described in paragraph (2) on an annual 14
322322 basis. 15

324324 ESTRICTED FUNDS FOR PLAN .—A covered 16
325325 industrial operator shall not, in developing a stand-17
326326 ard disaster mitigation plan described in paragraph 18
327327 (2)(B), use any Federal funds, including funds pro-19
328328 vided under the environmental quality incentive pro-20
329329 gram under subchapter A of chapter 4 of subtitle D 21
330330 of title XII of the Food Security Act of 1985 (16 22
331331 U.S.C. 3839aa et seq.). 23

338338 ator registered under subsection (a) shall pay to the 2
339339 Office an annual fee by January 15 of each year for 3
340340 each high-risk AFO owned or controlled by the cov-4
341341 ered industrial operator. 5

343343 OTAL AMOUNT OF FEES .—The amount of 6
344344 the fee required under paragraph (1)— 7
345345 (A) shall be determined by the Secretary in 8
346346 a manner that will ensure that the total amount 9
347347 of fees collected for each fiscal year shall suffi-10
348348 ciently fund the activities of the Office for that 11
349349 fiscal year; but 12
350350 (B) shall not be less than $1 per animal 13
351351 unit (as defined by the Administrator of the 14
352352 Environmental Protection Agency) for each fis-15
353353 cal year. 16

355355 ESTRICTION.—A covered industrial oper-17
356356 ator may not reduce wages or grower payments in 18
357357 order to derive the amount of the fee required under 19
358358 paragraph (1). 20

363363 STABLISHMENT.—There is established in 23
364364 the Treasury of the United States a fund, to be 24
365365 known as the ‘‘High-Risk AFO Disaster Mitigation 25

372372 OURCE; USE.—All moneys derived from 3
373373 fees collected by the Office under subsection (b) 4
374374 shall be deposited in the Fund and made available 5
375375 to the Secretary, without fiscal year limitation, to 6
376376 offset costs relating to— 7
377377 (A) the administrative costs associated 8
378378 with operating the Office and technical assist-9
379379 ance offered by staff of the Office; 10
380380 (B) creating the national stockpile pursu-11
381381 ant to section 114(c)(2); 12
382382 (C) enforcement actions against covered 13
383383 industrial operators that do not comply with 14
384384 this subtitle; and 15
385385 (D) any other activities determined by the 16
386386 Secretary. 17
387387 SEC. 113. COVERED INDUSTRIAL OPERATOR RESPONSIBIL-18
388388 ITIES AND LIABILITIES. 19
389389 A covered industrial operator shall be responsible and 20
390390 liable for, with respect to each high-risk AFO owned or 21
391391 controlled by the covered industrial operator, all costs as-22
392392 sociated with activities related to disaster events or de-23
393393 population of livestock or poultry, including— 24

398398 stock or poultry, including from the national stock-2
399399 pile described in section 114(c)(2); 3
400400 (2) disposal of deceased animals that— 4
401401 (A) satisfies requirements under all rel-5
402402 evant Federal, State, and local environmental 6
403403 and public health laws; and 7
404404 (B) does not rely on unlined burial or on-8
405405 site incineration; 9
406406 (3) compensation for contract growers and 10
407407 workers, as provided in subtitle B; 11
408408 (4) compensation for any adverse health im-12
409409 pacts, property value diminution, and loss of use and 13
410410 enjoyment of property suffered by neighboring resi-14
411411 dents of the high-risk AFO; and 15
412412 (5) other costs determined by the Secretary. 16
413413 SEC. 114. RESTRICTION ON CERTAIN METHODS OF DE-17
414414 POPULATION. 18

416416 EFINITIONS.—In this section: 19

418418 ESTRICTED PRACTICE .—The term ‘‘re-20
419419 stricted practice’’ means— 21
420420 (A) sodium nitrite poisoning; 22
421421 (B) ventilation shutdown; 23
422422 (C) ventilation shutdown plus; 24
423423 (D) water-based foaming; and 25

430430 ODIUM NITRITE POISONING .—The term 3
431431 ‘‘sodium nitrite poisoning’’ means a method of ani-4
432432 mal depopulation that involves feeding the toxic sub-5
433433 stance sodium nitrite to animals, causing changes to 6
434434 the blood that prevent delivery of oxygen to tissues 7
435435 and result in prolonged respiratory distress prior to 8
436436 loss of consciousness. 9

438438 ENTILATION SHUTDOWN .—The term ‘‘ven-10
439439 tilation shutdown’’ means a method of animal de-11
440440 population that involves sealing a building in which 12
441441 animals are confined, shutting inlets, and turning off 13
442442 fans in order to raise the temperature in the build-14
443443 ing until the animals die from hyperthermia or hy-15
444444 poxia, including ventilation shutdown plus. 16

446446 ENTILATION SHUTDOWN PLUS .—The term 17
447447 ‘‘ventilation shutdown plus’’ means a ventilation 18
448448 shutdown method that involves the use of additional 19
449449 heat or humidity. 20

451451 ATER-BASED FOAMING .—The term 21
452452 ‘‘water-based foaming’’ means a method of animal 22
453453 depopulation that involves pumping foam con-23
454454 centrate combined with water into a building in 24

461461 ESTRICTIONS; CIVILPENALTY.—Notwith-3
462462 standing any other provision of law, beginning 1 year after 4
463463 the date of enactment of this Act, a covered industrial op-5
464464 erator that uses 1 or more restricted practices for any 6
465465 event of depopulation of livestock or poultry on a high- 7
466466 risk AFO owned or controlled by the covered industrial 8
467467 operator, as determined by the Office— 9
468468 (1) shall not be eligible for any Federal contract 10
469469 for a period of 10 years beginning on that date; 11
470470 (2) shall not be eligible for inspection of any fa-12
471471 cility owned or controlled by the covered industrial 13
472472 operator pursuant to the Federal Meat Inspection 14

678678 event with 12 weeks of severance pay, at a weekly 15
679679 rate equal to the average weekly earnings of the cov-16
