19	19	tives of the United States of America in Congress assembled, 2

25	25	ONTROL ANDMANAGEMENT OF DEPARTMENT 7
26	26	OFDEFENSEDATA.—The Chief Digital and Artificial In-8

31	31	maintain the authority, but not the requirement, to access 2
32	32	and control, on behalf of the Secretary of Defense, of all 3
33	33	data collected, acquired, accessed, or utilized by Depart-4
34	34	ment of Defense components consistent with section 1513 5
35	35	of the James M. Inhofe National Defense Authorization 6
36	36	Act for Fiscal Year 2023 (Public Law 117–263; 10 U.S.C. 7

41	41	FFICERGOVERNINGCOUNCIL.—Section 238(d) of the 10
42	42	John S. McCain National Defense Authorization Act for 11
43	43	Fiscal Year 2019 (Public Law 115–232; 10 U.S.C. note 12
44	44	prec. 4061) is amended by striking paragraph (3) and in-13
45	45	serting the following new paragraph (3): 14
46	46	‘‘(3) C
47	47	HIEF DIGITAL AND ARTIFICIAL INTEL -15
48	48	LIGENCE OFFICER GOVERNING COUNCIL .— 16
49	49	‘‘(A) E
50	50	STABLISHMENT.—(i) The Secretary 17
51	51	shall establish a council to provide policy over-18
52	52	sight to ensure the responsible, coordinated, 19
53	53	and ethical employment of data and artificial 20
54	54	intelligence capabilities across Department of 21
55	55	Defense missions and operations. 22
56	56	‘‘(ii) The council established pursuant to 23
57	57	clause (i) shall be known as the ‘Chief Digital 24

64	64	EMBERSHIP.—The Council shall be 3
65	65	composed of the following: 4
66	66	‘‘(i) Joint Staff J–6. 5
67	67	‘‘(ii) The Under Secretary of Defense 6
68	68	for Acquisition and Sustainment. 7
69	69	‘‘(iii) The Under Secretary of Defense 8
70	70	for Research and Engineering. 9
71	71	‘‘(iv) The Under Secretary of Defense 10
72	72	for Intelligence and Security. 11
73	73	‘‘(v) The Under Secretary of Defense 12
74	74	for Policy. 13
75	75	‘‘(vi) The Director of Cost Analysis 14
76	76	and Program Evaluation. 15
77	77	‘‘(vii) The Chief Information Officer 16
78	78	of the Department. 17
79	79	‘‘(viii) The Director of Administration 18
80	80	and Management. 19
81	81	‘‘(ix) The service acquisition execu-20
82	82	tives of each of the military departments. 21

84	84	EAD OF COUNCIL .—The Council 22
85	85	shall be headed by the Chief Digital and Artifi-23
86	86	cial Intelligence Officer of the Department. 24

90	90	‘‘(D) MEETINGS.—The Council shall meet 1
91	91	not less frequently than twice each fiscal year. 2
92	92	‘‘(E) D
93	93	UTIES OF COUNCIL.—The duties of 3
94	94	the Council are as follows: 4
95	95	‘‘(i) To streamline the organizational 5
96	96	structure of the Department as it relates 6
97	97	to artificial intelligence development, im-7
98	98	plementation, and oversight. 8
99	99	‘‘(ii) To improve coordination on arti-9
100	100	ficial intelligence governance with the de-10
101	101	fense industry sector. 11
102	102	‘‘(iii) To establish and oversee artifi-12
103	103	cial intelligence guidance on ethical re-13
104	104	quirements and protections for usage of ar-14
105	105	tificial intelligence supported by Depart-15
106	106	ment funding and reduces or mitigates in-16
107	107	stances of unintended bias in artificial in-17
108	108	telligence algorithms. 18
109	109	‘‘(iv) To identify, monitor, and peri-19
110	110	odically update appropriate recommenda-20
111	111	tions for operational usage of artificial in-21
112	112	telligence. 22
113	113	‘‘(v) To review, as the head of the 23
114	114	Council considers necessary, artificial intel-24
115	115	ligence program funding to ensure that 25

120	120	intelligence tool, system, or algorithm ad-2
121	121	heres to all Department established policy 3
122	122	related to artificial intelligence. 4
123	123	‘‘(vi) To provide periodic status up-5
124	124	dates on the efforts of the Department to 6
125	125	develop and implement artificial intel-7
126	126	ligence into existing Department programs 8
127	127	and processes. 9
128	128	‘‘(vii) To provide guidance on access 10
129	129	and distribution restrictions relating to 11
130	130	data, models, tool sets, or testing or valida-12
131	131	tion infrastructure. 13
132	132	‘‘(viii) to implement and oversee a 14
133	133	data and artificial intelligence educational 15
134	134	program for the purpose of familiarizing 16
135	135	the Department at all levels on the applica-17
136	136	tions of artificial intelligence in their oper-18
137	137	ations. 19
138	138	‘‘(ix) To implement and oversee a 20
139	139	data decree scorecard. 21
140	140	‘‘(x) Such other duties as the Council 22
141	141	determines appropriate. 23

143	143	ERIODIC REPORTS.—Not later than 24
144	144	180 days after the date of the enactment of this 25

150	150	submit to the Secretary and the congressional 3
151	151	defense committees a report on the activities of 4
152	152	the Council during the period covered by the re-5
