2424 This Act may be cited as the ‘‘Protecting Our Wealth 4
2525 of Energy Resources Act of 2023’’ or the ‘‘POWER Act’’. 5

3838 N GENERAL.—The term ‘‘Federal 7
3939 land’’ means— 8
4040 (i) National Forest System land; 9
4141 (ii) public lands (as defined in section 10
4242 103 of the Federal Land Policy and Man-11
4343 agement Act of 1976 (43 U.S.C. 1702)); 12
4444 (iii) the outer Continental Shelf (as 13
4545 defined in section 2 of the Outer Conti-14
4646 nental Shelf Lands Act (43 U.S.C. 1331)); 15
4747 and 16
4848 (iv) land managed by the Secretary of 17
4949 Energy. 18

5151 NCLUSION.—The term ‘‘Federal 19
5252 land’’ includes land described in clauses (i) 20
5353 through (iv) of subparagraph (A) for which the 21
5454 rights to the surface estate or subsurface estate 22
5555 are owned by a non-Federal entity. 23

5757 INERAL.—The term ‘‘mineral’’ means any 24
5858 mineral subject to sections 2319 through 2344 of 25
5959 the Revised Statutes (commonly known as the ‘‘Min-26

6868 RESIDENT.—The term ‘‘President’’ means 5
6969 the President or any designee, including— 6
7070 (A) the Secretary of Agriculture; 7
7171 (B) the Secretary of Energy; and 8
7272 (C) the Secretary of the Interior. 9

7474 ROHIBITIONS.— 10

7676 N GENERAL.—Notwithstanding any other 11
7777 provision of law, the President shall not carry out 12
7878 any action that would prohibit or substantially delay 13
7979 the issuance of any of the following on Federal land, 14
8080 unless such an action has been authorized by an Act 15
8181 of Congress: 16
8282 (A) New oil and gas leases, drill permits, 17
8383 approvals, or authorizations. 18
8484 (B) New coal leases, permits, approvals, or 19
8585 authorizations. 20
8686 (C) New mineral patents, leases, permits, 21
8787 approvals, or authorizations. 22

8989 ROHIBITION ON WITHDRAWAL .—Notwith-23
9090 standing any other provision of law, the President 24
9191 may not withdraw any Federal land from forms of 25

9696 land laws, location, entry, and patent under the min-2
9797 ing laws, or disposition under laws pertaining to 3
9898 mineral and geothermal leasing or mineral materials 4
9999 unless the withdrawal has been authorized by an Act 5
