19	19	To prohibit the President from issuing moratoria on leasing
20	20	and permitting energy and minerals on certain Federal land.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. SHORT TITLE. 3
24	24	This Act may be cited as the ‘‘Protecting Our Wealth 4
25	25	of Energy Resources Act of 2023’’ or the ‘‘POWER Act’’. 5

34	34	EFINITIONS.—In this section: 5
35	35	(1) F
36	36	EDERAL LAND.— 6
37	37	(A) I
38	38	N GENERAL.—The term ‘‘Federal 7
39	39	land’’ means— 8
40	40	(i) National Forest System land; 9
41	41	(ii) public lands (as defined in section 10
42	42	103 of the Federal Land Policy and Man-11
43	43	agement Act of 1976 (43 U.S.C. 1702)); 12
44	44	(iii) the outer Continental Shelf (as 13
45	45	defined in section 2 of the Outer Conti-14
46	46	nental Shelf Lands Act (43 U.S.C. 1331)); 15
47	47	and 16
48	48	(iv) land managed by the Secretary of 17
49	49	Energy. 18
50	50	(B) I
51	51	NCLUSION.—The term ‘‘Federal 19
52	52	land’’ includes land described in clauses (i) 20
53	53	through (iv) of subparagraph (A) for which the 21
54	54	rights to the surface estate or subsurface estate 22
55	55	are owned by a non-Federal entity. 23

57	57	INERAL.—The term ‘‘mineral’’ means any 24
58	58	mineral subject to sections 2319 through 2344 of 25
59	59	the Revised Statutes (commonly known as the ‘‘Min-26

64	64	erals located on ‘‘lands acquired by the United 2
65	65	States’’ (as defined in section 2 of the Mineral Leas-3
66	66	ing Act for Acquired Lands (30 U.S.C. 351)). 4

68	68	RESIDENT.—The term ‘‘President’’ means 5
69	69	the President or any designee, including— 6
70	70	(A) the Secretary of Agriculture; 7
71	71	(B) the Secretary of Energy; and 8
72	72	(C) the Secretary of the Interior. 9

74	74	ROHIBITIONS.— 10
75	75	(1) I
76	76	N GENERAL.—Notwithstanding any other 11
77	77	provision of law, the President shall not carry out 12
78	78	any action that would prohibit or substantially delay 13
79	79	the issuance of any of the following on Federal land, 14
80	80	unless such an action has been authorized by an Act 15
81	81	of Congress: 16
82	82	(A) New oil and gas leases, drill permits, 17
83	83	approvals, or authorizations. 18
84	84	(B) New coal leases, permits, approvals, or 19
85	85	authorizations. 20
86	86	(C) New mineral patents, leases, permits, 21
87	87	approvals, or authorizations. 22

89	89	ROHIBITION ON WITHDRAWAL .—Notwith-23
90	90	standing any other provision of law, the President 24
91	91	may not withdraw any Federal land from forms of 25

95	95	entry, appropriation, or disposal under the public 1
96	96	land laws, location, entry, and patent under the min-2
97	97	ing laws, or disposition under laws pertaining to 3
98	98	mineral and geothermal leasing or mineral materials 4
99	99	unless the withdrawal has been authorized by an Act 5
100	100	of Congress. 6
