2525 SECTION 1. SHORT TITLE. 3
2626 This Act may be cited as the ‘‘Alaska’s Right to 4
2727 Produce Act of 2023’’. 5

3232 Congress finds that— 2
3333 (1) Congress provided clear authorization and 3
3434 direction that the Secretary of the Interior ‘‘shall es-4
3535 tablish and administer a competitive oil and gas pro-5
3636 gram for the leasing, development, production, and 6
3737 transportation of oil and gas in and from the Coast-7
3838 al Plain’’ in section 20001 of Public Law 115–97 8
3939 (16 U.S.C. 3143 note) (commonly known as the Tax 9
4040 Cuts and Jobs Act); 10
4141 (2) the timely administration of the Coastal 11
4242 Plain Oil and Gas Leasing Program is required and 12
4343 in the national and public interest; 13
4444 (3) the Department of the Interior’s cancelling 14
4545 of the leases for the covered Coastal Plain lease 15
4646 tracts represents a major decision of economic and 16
4747 political significance that Congress did not delegate 17
4848 to the Secretary; 18
4949 (4) the Naval Petroleum Reserves Production 19
5050 Act of 1976 (42 U.S.C. 6501 et seq.) requires that 20
5151 the Bureau of Land Management— 21
5252 (A) allow for the exploration, development, 22
5353 and production of petroleum products in the 23
5454 National Petroleum Reserve in Alaska; and 24
5555 (B) equally balance, to the extent con-25

109109 order or action by the President or the Secretary that has 16
110110 the effect of placing a moratorium on or otherwise sus-17
111111 pending or pausing oil and gas leasing in the Coastal Plain 18
112112 shall have no force or effect. 19

116116 OCUMENTATION AND AUTHORIZATIONS.—Notwith-21
117117 standing any other provision of law, Congress— 22
118118 (1) ratifies and approves all authorizations, per-23
119119 mits, verifications, extensions, biological opinions, in-24
120120 cidental take statements, and any other approvals or 25

129129 the Environmental Protection Agency, and the heads 6
130130 of other as applicable Federal departments and 7
131131 agencies to process, reinstate, or continue to main-8
132132 tain such authorizations, permits, verifications, ex-9
133133 tensions, biological opinions, incidental take state-10
134134 ments, and any other approvals or orders described 11
135135 in paragraph (1). 12

137137 PPLICABILITY OF OTHERLAW.—Notwith-13
138138 standing any other provision of law, the authorizations, 14
139139 permits, verifications, extensions, biological opinions, inci-15
140140 dental take statements, and any other approvals or orders 16
141141 described in subsection (b)(1) shall be considered to sat-17
142142 isfy the requirements of— 18
143143 (1) section 1002 of the Alaska National Inter-19
144144 est Lands Conservation Act (16 U.S.C. 3142); 20
145145 (2) section 102(2)(c) of the National Environ-21
146146 mental Policy Act of 1969 (42 U.S.C. 4332(2)(c)); 22
147147 (3) section 20001 of Public Law 115–97 (16 23
148148 U.S.C. 3143 note); 24

157157 SEC. 5. COASTAL PLAIN OIL AND GAS LEASING PROGRAM. 6

159159 EISSUANCE OFCANCELEDLEASES.— 7
160160 (1) A
161161 CCEPTANCE OF BIDS.—Not later than 30 8
162162 days after the date of enactment of this Act, the 9
163163 Secretary shall, without modification or delay— 10
164164 (A) accept the highest valid bid for each 11
165165 covered Coastal Plain lease tract for which a 12
166166 valid bid was received on January 6, 2021, pur-13
167167 suant to the requirement to hold the first lease 14
168168 sale in the Coastal Plain oil and gas leasing 15
169169 program; and 16
170170 (B) provide the appropriate lease form to 17
171171 each winning bidder under subparagraph (A) to 18
172172 execute and return to the Secretary. 19

174174 EASE ISSUANCE.—On receipt of an exe-20
175175 cuted lease form under paragraph (1)(B) and pay-21
176176 ment in accordance with that lease of the rental for 22
177177 the first year, the balance of the bonus bid (unless 23
178178 deferred), and any required bond or security from 24
179179 the high bidder, the Secretary shall promptly issue 25

190190 EQUIREMENT FOR FUTURELEASES.— 7

192192 ECOND LEASE SALE.—Not later than De-8
193193 cember 22, 2024, the Secretary shall conduct the 9
194194 second lease sale required by section 10
195195 20001(c)(1)(B)(ii)(II) of Public Law 115–97 (16 11
196196 U.S.C. 3143 note) in accordance with the Record of 12
197197 Decision. 13

199199 XCEPTIONS FOR CANCELING A LEASE .— 14
200200 Notwithstanding any other provision of law, the 15
201201 President and the Secretary may not cancel a lease 16
202202 issued under the Coastal Plain oil and gas leasing 17
203203 program if the Secretary has previously opened bids 18
204204 for such a lease or disclosed the high bidder for any 19
205205 tract that was included in a lease sale under the 20
206206 Coastal Plain oil and gas leasing program unless the 21
207207 lessee is in violation of the terms of the lease and 22
208208 fails to cure the violation after a reasonable period 23
209209 of time. 24

214214 SION.—Notwithstanding any other provision of law and 2
215215 with respect to reissuing leases under subsection (a), the 3
216216 Record of Decision shall be considered to satisfy the re-4
217217 quirements of— 5
218218 (1) section 1002 of the Alaska National Inter-6
219219 est Lands Conservation Act (16 U.S.C. 3142); 7
220220 (2) section 102(2)(c) of the National Environ-8
221221 mental Policy Act of 1969 (42 U.S.C. 4332(2)(c)); 9
222222 (3) section 20001 of Public Law 115–97 (16 10
223223 U.S.C. 3143 note); 11
224224 (4) the Endangered Species Act of 1973 (Public 12
225225 Law 93–205; 16 U.S.C. 1533); and 13
226226 (5) subchapter II of chapter 5 of title 5, United 14
227227 States Code, and chapter 7 of title 5, United States 15
228228 Code. 16

230230 ITHDRAWAL OF SUPPLEMENTAL ENVIRON-17
231231 MENTALIMPACTSTATEMENT.—The Director of the Bu-18
232232 reau of Land Management— 19
233233 (1) shall withdraw the notice of availability en-20
234234 titled ‘‘Notice of Availability of the Draft Coastal 21
235235 Plain Oil and Gas Leasing Program Supplemental 22
236236 Environmental Impact Statement’’ (88 Fed. Reg. 23
237237 62104 (September 8, 2023)); and 24

247247 UDICIAL PRECLUSION .—Notwithstanding 5
248248 any other provision of law and except as provided in 6
249249 paragraph (2), no court shall have jurisdiction to re-7
250250 view any action taken by the Secretary, the Adminis-8
251251 trator of the Environmental Protection Agency, a 9
252252 State administrative agency, an Indian Tribe, or any 10
253253 other Federal agency acting pursuant to Federal law 11
254254 that grants an authorization, permit, verification, bi-12
255255 ological opinion, incidental take statement, or other 13
256256 approval described in section 4(b) for the Coastal 14
257257 Plain Oil and Gas Leasing Program, whether issued 15
258258 prior to, on, or after the date of enactment of this 16
259259 Act, and including any lawsuit or any other action 17
260260 pending in a court as of the date of enactment of 18
261261 this Act. 19

263263 ORUM EXCLUSIVITY.—The United States 20
264264 Court of Appeals for the District of Columbia Cir-21
265265 cuit shall have original and exclusive jurisdiction 22
266266 over any claim regarding— 23
267267 (A) the validity of this section; or 24

277277 graph (1), a lease holder may obtain a review 5
278278 of an alleged failure by an agency to act in ac-6
279279 cordance with section 20001 of Public Law 7
280280 115–97 (16 U.S.C. 3143 note) or with any law 8
281281 pertaining to the grant of an authorization, per-9
282282 mit, verification, biological opinion, incidental 10
283283 take statement, or other approval related to the 11
284284 lease holder’s lease by filing a written petition 12
285285 with a court of competent jurisdiction seeking 13
286286 an order under subparagraph (B). 14

288288 EADLINES.—If a court of competent 15
289289 jurisdiction finds that an agency has failed to 16
290290 act in accordance with section 20001 of Public 17
291291 Law 115–97 (16 U.S.C. 3143 note) or with any 18
292292 law pertaining to the grant of an authorization, 19
293293 permit, verification, biological opinion, inci-20
294294 dental take statement, or other approval related 21
295295 to the lease holder’s lease, the court shall set a 22
296296 schedule and deadline for the agency to act as 23
297297 soon as practicable, which shall not exceed 90 24
298298 days from the date on which the order of the 25
