25	25	Be it enacted by the Senate and House of Representa-1

30	30	SECTION 1. SHORT TITLE. 1
31	31	This Act may be cited as the ‘‘Defending Against Ad-2
32	32	versary Recruitment Efforts Act’’ or the ‘‘DAARE Act’’. 3
33	33	SEC. 2. PROHIBITION ON FORMER MEMBERS OF THE 4
34	34	ARMED FORCES ACCEPTING POST-SERVICE 5
35	35	EMPLOYMENT WITH CERTAIN FOREIGN GOV-6
36	36	ERNMENTS. 7
37	37	(a) I
38	38	NGENERAL.—Chapter 49 of title 10, United 8
39	39	States Code, is amended by adding at the end the fol-9
40	40	lowing new section: 10
41	41	‘‘§ 989. Prohibition on former members of the armed 11
42	42	forces accepting post-service employment 12
43	43	with certain foreign governments 13
44	44	‘‘(a) I
45	45	NGENERAL.—Except as provided by subsection 14
46	46	(b), a covered individual may not occupy a covered post- 15
47	47	service position. 16
48	48	‘‘(b) T
49	49	EMPORARYWAIVER.— 17
50	50	‘‘(1) I
51	51	N GENERAL.—The Secretary of Defense 18
52	52	shall establish a process under which a covered indi-19
53	53	vidual may be granted a temporary waiver of the 20
54	54	prohibition under subsection (a) if— 21
55	55	‘‘(A) the individual, or a Federal agency on 22
56	56	behalf of, and with the consent of, the indi-23
57	57	vidual, submits to the Secretary a written appli-24
58	58	cation for a waiver in such form and manner as 25
59	59	the Secretary determines appropriate; and 26

64	64	waiver is necessary to advance the national se-2
65	65	curity interests of the United States. 3

67	67	ERIOD OF WAIVER .—A waiver issued 4
68	68	under paragraph (1) shall apply for a period not ex-5
69	69	ceeding 5 years. The Secretary may renew such a 6
70	70	waiver. 7
71	71	‘‘(3) R
72	72	EVOCATION.—The Secretary may revoke 8
73	73	a waiver issued under paragraph (1) to a covered in-9
74	74	dividual with respect to a covered-post service posi-10
75	75	tion if the Secretary determines that the employ-11
76	76	ment of the individual in the covered-post service po-12
77	77	sition poses a threat to national security. 13

79	79	OTIFICATION.— 14
80	80	‘‘(A) I
81	81	N GENERAL.—Not later than 30 15
82	82	days after the date on which the Secretary 16
83	83	issues a waiver under paragraph (1) or revokes 17
84	84	a waiver under paragraph (3), the Secretary 18
85	85	shall submit to the Committees on Armed Serv-19
86	86	ices of the Senate and the House of Represent-20
87	87	atives written notification of the waiver or rev-21
88	88	ocation, as the case may be. 22
89	89	‘‘(B) E
90	90	LEMENTS.—A notification required 23
91	91	by subparagraph (A) shall include the following: 24

96	96	a covered individual— 2
97	97	‘‘(I) the details of the applica-3
98	98	tion, including the position held by the 4
99	99	individual in the armed forces; 5
100	100	‘‘(II) the nature of the post-serv-6
101	101	ice position of the individual; 7
102	102	‘‘(III) a description of the na-8
103	103	tional security interests that will be 9
104	104	advanced by reason of issuing such a 10
105	105	waiver; and 11
106	106	‘‘(IV) the specific reasons why 12
107	107	the Secretary determines that issuing 13
108	108	the waiver will advance such interests. 14
109	109	‘‘(ii) With respect to a revocation of a 15
110	110	waiver issued to a covered individual— 16
111	111	‘‘(I) the details of the waiver, in-17
112	112	cluding any renewals of the waiver, 18
113	113	and the dates of such waiver and re-19
114	114	newals; and 20
115	115	‘‘(II) the specific reasons why the 21
116	116	Secretary determined that the revoca-22
117	117	tion is warranted. 23
118	118	‘‘(c) C
119	119	ERTIFICATION OF PROHIBITION.—In imple-24
120	120	menting the prohibition under subsection (a), the Sec-25

124	124	retary shall establish a process under which each member 1
125	125	of the armed forces is, before the member retires or is 2
126	126	otherwise separated from the armed forces— 3
127	127	‘‘(1) informed in writing of the prohibition, and 4
128	128	the penalties for violations of the prohibition; and 5
129	129	‘‘(2) is required to certify that the member un-6
130	130	derstands the prohibition and those penalties. 7
131	131	‘‘(d) P
132	132	ENALTIES.—In the case of a covered individual 8
133	133	who knowingly and willfully fails to comply with the prohi-9
134	134	bition under subsection (a), the Secretary shall, as applica-10
135	135	ble— 11
136	136	‘‘(1) withhold any pay, allowances, or benefits 12
137	137	that would otherwise be provided to the individual by 13
138	138	the Department of Defense; and 14
139	139	‘‘(2) revoke any security clearance of the indi-15
140	140	vidual. 16

142	142	NNUALREPORTS.— 17
143	143	‘‘(1) R
144	144	EQUIREMENT.—Not later than March 18
145	145	31, 2024, and annually thereafter, the Secretary 19
146	146	shall submit to the congressional defense committees 20
147	147	a report on covered post-service employment occur-21
148	148	ring during the year covered by the report. 22

150	150	LEMENTS.—Each report required by 23
151	151	paragraph (1) shall include the following: 24

156	156	viduals who occupy a covered post-service posi-2
157	157	tion, broken down by— 3
158	158	‘‘(i) the name of the employer; 4
159	159	‘‘(ii) the foreign government, includ-5
160	160	ing by the specific foreign individual, agen-6
161	161	cy, or entity, for whom the covered post- 7
162	162	service employment is being performed; 8
163	163	and 9
164	164	‘‘(iii) the nature of the services pro-10
165	165	vided as part of the covered post-service 11
166	166	employment. 12
167	167	‘‘(B) An assessment by the Secretary of 13
168	168	whether— 14
169	169	‘‘(i) the Department of Defense main-15
170	170	tains adequate systems and processes for 16
171	171	ensuring that former members of the 17
172	172	armed forces are submitting required re-18
173	173	ports relating to their employment by for-19
174	174	eign governments; 20
175	175	‘‘(ii) all covered individuals who oc-21
176	176	cupy a covered post-service position are in 22
177	177	compliance with this section; 23
178	178	‘‘(iii) the services provided by the cov-24
179	179	ered individuals who occupy a covered 25

187	187	or reporting that any covered individual 5
188	188	who occupies a covered post-service posi-6
189	189	tion has engaged in activities that violate 7
190	190	Federal law. 8

192	192	ORM OF REPORT.—Each report required 9
193	193	by paragraph (1) shall be submitted in unclassified 10
194	194	form, but may include a classified annex. 11

196	196	OTIFICATIONS OFDETERMINATIONS OF CER-12

199	199	EQUIREMENT.—In addition to the annual 14
200	200	reports under subsection (d), if the Secretary deter-15
201	201	mines that the services provided by a covered indi-16
202	202	vidual who occupies a covered post-service position 17
203	203	pose a threat described in clause (iii) of paragraph 18
204	204	(2)(B) of that subsection, or include activities de-19
205	205	scribed in clause (iv) of such paragraph, the Sec-20
206	206	retary shall notify the congressional defense commit-21
207	207	tees of that determination by not later than 30 days 22
208	208	after making the determination. 23
209	209	‘‘(2) E
210	210	LEMENTS.—A notification required by 24
211	211	paragraph (1) shall include the following: 25

221	221	‘‘(D) As applicable, a description of the 7
222	222	risk to national security and the activities that 8
223	223	may violate Federal law. 9

225	225	ULE OFCONSTRUCTION.—Nothing in this sec-10
226	226	tion may be construed to indemnify or shield covered indi-11
227	227	viduals from prosecution under any relevant provision of 12
228	228	title 18. 13

230	230	EFINITIONS.—In this section: 14
231	231	‘‘(1) C
232	232	OVERED INDIVIDUAL .—The term ‘cov-15
233	233	ered individual’ means an individual who has retired 16
234	234	or otherwise separated from an active or reserve 17
235	235	component of the armed forces. 18
236	236	‘‘(2) C
237	237	OVERED POST-SERVICE EMPLOYMENT .— 19
238	238	The term ‘covered post-service employment’ means 20
239	239	direct or indirect employment by, representation of, 21
240	240	or any provision of advice or services relating to na-22
241	241	tional security, intelligence, the military, or internal 23
242	242	security to— 24
243	243	‘‘(A) the government of— 25

252	252	fense determines acts as a proxy or pass-6
253	253	through for services for a country of con-7
254	254	cern; or 8
255	255	‘‘(B) any company, entity, or other person 9
256	256	the activities of which are directly or indirectly 10
257	257	supervised, directed, controlled, financed, or 11
258	258	subsidized, in whole or in major part, by a gov-12
259	259	ernment described in subparagraph (A). 13
260	260	‘‘(3) C
261	261	OVERED POST-SERVICE POSITION.—The 14
262	262	term ‘covered post-service position’ means a position 15
263	263	of employment described in paragraph (2).’’. 16

265	265	LERICALAMENDMENT.—The table of sections 17
266	266	at the beginning of chapter 49 of such title is amended 18
267	267	by adding at the end the following new item: 19
268	268	‘‘989. Prohibition on former members of the armed forces accepting post-service
