3131 This Act may be cited as the ‘‘Defending Against Ad-2
3232 versary Recruitment Efforts Act’’ or the ‘‘DAARE Act’’. 3
3333 SEC. 2. PROHIBITION ON FORMER MEMBERS OF THE 4
3434 ARMED FORCES ACCEPTING POST-SERVICE 5
3535 EMPLOYMENT WITH CERTAIN FOREIGN GOV-6
3636 ERNMENTS. 7
3737 (a) I
3838 NGENERAL.—Chapter 49 of title 10, United 8
3939 States Code, is amended by adding at the end the fol-9
4040 lowing new section: 10
4141 ‘‘§ 989. Prohibition on former members of the armed 11
4242 forces accepting post-service employment 12
4343 with certain foreign governments 13
4444 ‘‘(a) I
4545 NGENERAL.—Except as provided by subsection 14
4646 (b), a covered individual may not occupy a covered post- 15
4747 service position. 16
4848 ‘‘(b) T
4949 EMPORARYWAIVER.— 17
5050 ‘‘(1) I
5151 N GENERAL.—The Secretary of Defense 18
5252 shall establish a process under which a covered indi-19
5353 vidual may be granted a temporary waiver of the 20
5454 prohibition under subsection (a) if— 21
5555 ‘‘(A) the individual, or a Federal agency on 22
5656 behalf of, and with the consent of, the indi-23
5757 vidual, submits to the Secretary a written appli-24
5858 cation for a waiver in such form and manner as 25
5959 the Secretary determines appropriate; and 26

6464 waiver is necessary to advance the national se-2
6565 curity interests of the United States. 3

6767 ERIOD OF WAIVER .—A waiver issued 4
6868 under paragraph (1) shall apply for a period not ex-5
6969 ceeding 5 years. The Secretary may renew such a 6
7070 waiver. 7
7171 ‘‘(3) R
7272 EVOCATION.—The Secretary may revoke 8
7373 a waiver issued under paragraph (1) to a covered in-9
7474 dividual with respect to a covered-post service posi-10
7575 tion if the Secretary determines that the employ-11
7676 ment of the individual in the covered-post service po-12
7777 sition poses a threat to national security. 13
7878 ‘‘(4) N
7979 OTIFICATION.— 14
8080 ‘‘(A) I
8181 N GENERAL.—Not later than 30 15
8282 days after the date on which the Secretary 16
8383 issues a waiver under paragraph (1) or revokes 17
8484 a waiver under paragraph (3), the Secretary 18
8585 shall submit to the Committees on Armed Serv-19
8686 ices of the Senate and the House of Represent-20
8787 atives written notification of the waiver or rev-21
8888 ocation, as the case may be. 22

9090 LEMENTS.—A notification required 23
9191 by subparagraph (A) shall include the following: 24

9595 ‘‘(i) With respect to a waiver issued to 1
9696 a covered individual— 2
9797 ‘‘(I) the details of the applica-3
9898 tion, including the position held by the 4
9999 individual in the armed forces; 5
100100 ‘‘(II) the nature of the post-serv-6
101101 ice position of the individual; 7
102102 ‘‘(III) a description of the na-8
103103 tional security interests that will be 9
104104 advanced by reason of issuing such a 10
105105 waiver; and 11
106106 ‘‘(IV) the specific reasons why 12
107107 the Secretary determines that issuing 13
108108 the waiver will advance such interests. 14
109109 ‘‘(ii) With respect to a revocation of a 15
110110 waiver issued to a covered individual— 16
111111 ‘‘(I) the details of the waiver, in-17
112112 cluding any renewals of the waiver, 18
113113 and the dates of such waiver and re-19
114114 newals; and 20
115115 ‘‘(II) the specific reasons why the 21
116116 Secretary determined that the revoca-22
117117 tion is warranted. 23
118118 ‘‘(c) C
119119 ERTIFICATION OF PROHIBITION.—In imple-24
120120 menting the prohibition under subsection (a), the Sec-25

124124 retary shall establish a process under which each member 1
125125 of the armed forces is, before the member retires or is 2
126126 otherwise separated from the armed forces— 3
127127 ‘‘(1) informed in writing of the prohibition, and 4
128128 the penalties for violations of the prohibition; and 5
129129 ‘‘(2) is required to certify that the member un-6
130130 derstands the prohibition and those penalties. 7
131131 ‘‘(d) P
132132 ENALTIES.—In the case of a covered individual 8
133133 who knowingly and willfully fails to comply with the prohi-9
134134 bition under subsection (a), the Secretary shall, as applica-10
135135 ble— 11
136136 ‘‘(1) withhold any pay, allowances, or benefits 12
137137 that would otherwise be provided to the individual by 13
138138 the Department of Defense; and 14
139139 ‘‘(2) revoke any security clearance of the indi-15
140140 vidual. 16

142142 NNUALREPORTS.— 17
143143 ‘‘(1) R
144144 EQUIREMENT.—Not later than March 18
145145 31, 2024, and annually thereafter, the Secretary 19
146146 shall submit to the congressional defense committees 20
147147 a report on covered post-service employment occur-21
148148 ring during the year covered by the report. 22
149149 ‘‘(2) E
150150 LEMENTS.—Each report required by 23
151151 paragraph (1) shall include the following: 24

156156 viduals who occupy a covered post-service posi-2
157157 tion, broken down by— 3
158158 ‘‘(i) the name of the employer; 4
159159 ‘‘(ii) the foreign government, includ-5
160160 ing by the specific foreign individual, agen-6
161161 cy, or entity, for whom the covered post- 7
162162 service employment is being performed; 8
163163 and 9
164164 ‘‘(iii) the nature of the services pro-10
165165 vided as part of the covered post-service 11
166166 employment. 12
167167 ‘‘(B) An assessment by the Secretary of 13
168168 whether— 14
169169 ‘‘(i) the Department of Defense main-15
170170 tains adequate systems and processes for 16
171171 ensuring that former members of the 17
172172 armed forces are submitting required re-18
173173 ports relating to their employment by for-19
174174 eign governments; 20
175175 ‘‘(ii) all covered individuals who oc-21
176176 cupy a covered post-service position are in 22
177177 compliance with this section; 23
178178 ‘‘(iii) the services provided by the cov-24
179179 ered individuals who occupy a covered 25

186186 ‘‘(iv) there is any credible information 4
187187 or reporting that any covered individual 5
188188 who occupies a covered post-service posi-6
189189 tion has engaged in activities that violate 7
190190 Federal law. 8
191191 ‘‘(3) F
192192 ORM OF REPORT.—Each report required 9
193193 by paragraph (1) shall be submitted in unclassified 10
194194 form, but may include a classified annex. 11

199199 EQUIREMENT.—In addition to the annual 14
200200 reports under subsection (d), if the Secretary deter-15
201201 mines that the services provided by a covered indi-16
202202 vidual who occupies a covered post-service position 17
203203 pose a threat described in clause (iii) of paragraph 18
204204 (2)(B) of that subsection, or include activities de-19
205205 scribed in clause (iv) of such paragraph, the Sec-20
206206 retary shall notify the congressional defense commit-21
207207 tees of that determination by not later than 30 days 22
208208 after making the determination. 23
209209 ‘‘(2) E
210210 LEMENTS.—A notification required by 24
211211 paragraph (1) shall include the following: 25

216216 ‘‘(B) The name of the employer. 2
217217 ‘‘(C) The foreign government, including 3
218218 the specific foreign individual, agency, or entity, 4
219219 for whom the covered post-service employment 5
220220 is being performed. 6
221221 ‘‘(D) As applicable, a description of the 7
222222 risk to national security and the activities that 8
223223 may violate Federal law. 9
224224 ‘‘(g) R
225225 ULE OFCONSTRUCTION.—Nothing in this sec-10
226226 tion may be construed to indemnify or shield covered indi-11
227227 viduals from prosecution under any relevant provision of 12
228228 title 18. 13

230230 EFINITIONS.—In this section: 14
231231 ‘‘(1) C
232232 OVERED INDIVIDUAL .—The term ‘cov-15
233233 ered individual’ means an individual who has retired 16
234234 or otherwise separated from an active or reserve 17
235235 component of the armed forces. 18
236236 ‘‘(2) C
237237 OVERED POST-SERVICE EMPLOYMENT .— 19
238238 The term ‘covered post-service employment’ means 20
239239 direct or indirect employment by, representation of, 21
240240 or any provision of advice or services relating to na-22
241241 tional security, intelligence, the military, or internal 23
242242 security to— 24
243243 ‘‘(A) the government of— 25

249249 Basic Authorities Act of 1956 (22 U.S.C. 3

251251 ‘‘(ii) a country the Secretary of De-5
252252 fense determines acts as a proxy or pass-6
253253 through for services for a country of con-7
254254 cern; or 8
255255 ‘‘(B) any company, entity, or other person 9
256256 the activities of which are directly or indirectly 10
257257 supervised, directed, controlled, financed, or 11
258258 subsidized, in whole or in major part, by a gov-12
259259 ernment described in subparagraph (A). 13
260260 ‘‘(3) C
261261 OVERED POST-SERVICE POSITION.—The 14
262262 term ‘covered post-service position’ means a position 15
263263 of employment described in paragraph (2).’’. 16

265265 LERICALAMENDMENT.—The table of sections 17
266266 at the beginning of chapter 49 of such title is amended 18
267267 by adding at the end the following new item: 19
268268 ‘‘989. Prohibition on former members of the armed forces accepting post-service
269269 employment with certain foreign governments.’’.

271271 37, United States Code, is amended by adding at the end 21
