1919 SECTION 1. SHORT TITLE. 3
2020 This Act may be cited as the ‘‘Witness Security and 4
2121 Protection Grant Program Act of 2023’’. 5
2222 SEC. 2. WITNESS PROTECTION GRANT PROGRAM. 6

2424 EFINITIONS.—In this section— 7

2828 (1) the term ‘‘applicant’’ means a State, tribal, 1
2929 or local government that applies for a grant under 2
3030 this section; and 3
3131 (2) the terms ‘‘serious drug offense’’ and ‘‘seri-4
3232 ous violent felony’’ have the meanings given the 5
3333 terms in section 3559(c) of title 18, United States 6
3434 Code. 7
3535 (b) G
3636 RANTSREQUIRED.—Subject to subsection (j), 8
3737 the Attorney General shall make competitive grants to 9
3838 State, tribal, and local governments to establish or main-10
3939 tain programs that provide protection or assistance to wit-11
4040 nesses in court proceedings involving— 12
4141 (1) a homicide, serious violent felony, or serious 13
4242 drug offense; or 14
4343 (2) gangs or organized crime. 15

4545 RITERIA.—In making grants under this section, 16
4646 the Attorney General shall evaluate applicants based upon 17
4747 the following: 18
4848 (1) The extent to which the applicant lacks in-19
4949 frastructure to support programs that provide pro-20
5050 tection or assistance to witnesses. 21
5151 (2) The prevalence of witness intimidation in 22
5252 the jurisdiction of the applicant. 23
5353 (3) The percentage of cases not prosecuted by 24
5454 the applicant due to witness intimidation. 25

5959 mitted in the jurisdiction of the applicant. 2
6060 (5) The number of serious violent felonies or se-3
6161 rious drug offenses per capita committed in the ju-4
6262 risdiction of the applicant. 5
6363 (6) The extent to which organized crime is 6
6464 present in the jurisdiction of the applicant. 7
6565 (7) Any other criteria that the Attorney Gen-8
6666 eral determines appropriate. 9

6868 ECHNICALASSISTANCE.—From amounts made 10
6969 available under subsection (j) to carry out this section, the 11
7070 Attorney General, upon request of a recipient of a grant 12
7171 under this section, shall direct the appropriate offices 13
7272 within the Department of Justice to provide technical as-14
7373 sistance to the recipient to the extent the Attorney General 15
7474 determines technical assistance is needed to establish or 16
7575 maintain a program that provides protection or assistance 17
7676 to witnesses. 18

8080 EPORT.—A recipient of a grant under this 20
8181 section shall submit to the Attorney General a re-21
8282 port, in such form and manner and containing such 22
8383 information as specified by the Attorney General, 23
8484 that evaluates each program established or main-24

8989 procedures under the program. 2

9191 EVELOPMENT OF BEST PRACTICES .— 3
9292 Based on the reports submitted under paragraph 4
9393 (1), the Attorney General shall develop best practice 5
9494 models to assist State, tribal, and local governments 6
9595 in addressing— 7
9696 (A) witness safety; 8
9797 (B) short-term and permanent witness re-9
9898 location; 10
9999 (C) financial and housing assistance; and 11
100100 (D) any other services related to witness 12
101101 protection or assistance that the Attorney Gen-13
102102 eral determines necessary. 14

104104 ISSEMINATION TO STATES .—Not later 15
105105 than 1 year after developing best practice models 16
106106 under paragraph (2), the Attorney General shall dis-17
107107 seminate the models to State, tribal, and local gov-18
108108 ernments. 19

110110 ENSE OF CONGRESS .—It is the sense of 20
111111 Congress that State, tribal, and local governments 21
112112 should use the best practice models developed and 22
113113 disseminated under this subsection to evaluate, im-23
114114 prove, and develop witness protection or witness as-24
115115 sistance programs as appropriate. 25

119119 (5) RULE OF CONSTRUCTION RELATING TO 1
120120 SENSITIVE INFORMATION .—Nothing in this section 2
121121 shall be construed to require the dissemination of 3
122122 any information that the Attorney General deter-4
123123 mines— 5
124124 (A) is law enforcement sensitive and 6
125125 should only be disclosed within the law enforce-7
126126 ment community; or 8
127127 (B) poses a threat to national security. 9

131131 N GENERAL.—The Federal share of the 11
132132 cost of a program carried out using a grant made 12
133133 under this section shall be not more than 75 per-13
134134 cent. 14

136136 N-KIND CONTRIBUTIONS.— 15

138138 N GENERAL.—Subject to subpara-16
139139 graph (B), the non-Federal share for a program 17
140140 carried out using a grant made under this sec-18
141141 tion may be in the form of in-kind contributions 19
142142 that are directly related to the purpose for 20
143143 which the grant was made. 21

145145 AXIMUM PERCENTAGE .—Not more 22
146146 than 50 percent of the non-Federal share for a 23
147147 program carried out using a grant made under 24

154154 DMINISTRATIVE COSTS.—Of amounts made 3
155155 available to carry out this section for a fiscal year, the 4
156156 Attorney General may use not more than 5 percent for 5
157157 administrative costs. 6

159159 EOGRAPHICDISTRIBUTION.—In making grants 7
160160 under this section, the Attorney General shall— 8
161161 (1) to the extent reasonable and practical, en-9
162162 sure an equitable geographical distribution through-10
163163 out the United States of programs that provide pro-11
164164 tection or assistance to witnesses; and 12
165165 (2) give due consideration to applicants from 13
166166 both urban and rural areas. 14

168168 EPORT TOCONGRESS.—The Attorney General 15
169169 shall submit a report to Congress— 16
170170 (1) not later than 1 year after the date of en-17
171171 actment of this Act, on the implementation of this 18
172172 section, including any information on programs 19
173173 funded by grants made under this section; and 20
174174 (2) not later than 5 years after the date of en-21
175175 actment of this Act, on the programs funded by 22
176176 grants made under this section, including on best 23
177177 practice models developed under subsection (e)(2). 24

182182 authorized to be appropriated to carry out this section 2
