18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Justice for Murder 4
22	22	Victims Act’’. 5

28	28	NGENERAL.—Chapter 51 of title 18, United 2
29	29	States Code, is amended by adding at the end the fol-3
30	30	lowing: 4
31	31	‘‘§ 1123. No maximum time period between act or 5
32	32	omission and death of victim 6
33	33	‘‘(a) I
34	34	NGENERAL.—A prosecution may be instituted 7
35	35	for any homicide offense under this title without regard 8
36	36	to the time that elapsed between— 9
37	37	‘‘(1) the act or omission that caused the death 10
38	38	of the victim; and 11
39	39	‘‘(2) the death of the victim. 12
40	40	‘‘(b) R
41	41	ELATION TOSTATUTE OF LIMITATIONS.— 13
42	42	Nothing in subsection (a) shall be construed to supersede 14
43	43	the limitations period under section 3282(a), to the extent 15
44	44	applicable. 16

48	48	ENALTYIMPOSED.—A sentence of death may not be im-18
49	49	posed for a homicide offense under this title unless the 19
50	50	Government proves beyond a reasonable doubt that not 20
51	51	more than 1 year and 1 day elapsed between— 21
52	52	‘‘(1) the act or omission that caused the death 22
53	53	of the victim; and 23
54	54	‘‘(2) the death of the victim.’’. 24

58	58	(b) TABLE OFCONTENTS.—The table of sections for 1
59	59	chapter 51 of title 18, United States Code, is amended 2
60	60	by adding at the end the following: 3
61	61	‘‘1123. No maximum time period between act or omission and death of victim.’’.
62	62	(c) APPLICABILITY.—Section 1123(a) of title 18, 4
63	63	United States Code, as added by subsection (a), shall 5
64	64	apply with respect to an act or omission described in that 6
65	65	section that occurs after the date of enactment of this Act. 7

71	71	‘‘imprisonment for life’’ the following: ‘‘, unless the death 12
72	72	of the victim occurred more than 1 year and 1 day after 13
73	73	the act or omission that caused the death of the victim, 14
74	74	in which case the punishment shall be imprisonment for 15
75	75	any term of years or for life’’. 16
