16	16	To require the Secretary of Defense to appropriately consider
17	17	Taiwan for enhanced defense industrial base cooperation
18	18	activities, and for other purposes.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘Transpacific Allies In-4
23	23	vesting in Weapons to Advance National Security Act’’ or 5
24	24	the ‘‘TAIWAN Security Act’’. 6

33	33	(1) I
34	34	N GENERAL.—Consistent with the Taiwan 5
35	35	Relations Act (22 U.S.C. 3301 et seq.), the Sec-6
36	36	retary of Defense, in coordination with the Secretary 7
37	37	of State and the head of any other relevant Federal 8
38	38	department or agency, shall take measures to ensure 9
39	39	that Taiwan is appropriately considered for en-10
40	40	hanced defense industrial base cooperation activities 11
41	41	aligned with the United States National Defense In-12
42	42	dustrial Strategy to expand global defense produc-13
43	43	tion, increase supply chain security and resilience, 14
44	44	and meet the defense needs of Taiwan. 15
45	45	(2) E
46	46	LEMENTS.—Consideration for enhanced 16
47	47	defense industrial base cooperation activities under 17
48	48	paragraph (1) shall include the consideration of Tai-18
49	49	wan for the following: 19
50	50	(A) Eligibility for funding to initiate or fa-20
51	51	cilitate cooperative research, development, test-21
52	52	ing, or evaluation projects with the Department 22
53	53	of Defense. 23
54	54	(B) Eligibility to enter into a memo-24
55	55	randum of understanding or other formal 25
56	56	agreement with the Department of Defense for 26

61	61	and development projects on defense equipment 2
62	62	and munitions, with a focus on enhancing the 3
63	63	defense industry and supply chain resilience of 4
64	64	Taiwan. 5
65	65	(b) F
66	66	EASIBILITYSTUDY.— 6
67	67	(1) I
68	68	N GENERAL.—The Secretary of Defense, in 7
69	69	coordination with the Secretary of State, the Gov-8
70	70	ernment of Taiwan, and representatives of the 9
71	71	United States defense industry, shall conduct a 10
72	72	study on the feasibility and advisability of entering 11
73	73	into one or more defense industrial agreements with 12
74	74	Taiwan. 13
75	75	(2) E
76	76	LEMENTS.—The study required by para-14
77	77	graph (1) shall— 15
78	78	(A) evaluate the strategic benefits and im-16
79	79	plications of entering into a defense industrial 17
80	80	agreement with Taiwan, including with respect 18
81	81	to— 19
82	82	(i) long-term supply chain security 20
83	83	and resilience; 21
84	84	(ii) mutual supply of defense goods 22
85	85	and services; 23
86	86	(iii) supply of regional maintenance, 24
87	87	repair, and overhaul capabilities and any 25

91	91	other support capability the Secretary of 1
92	92	Defense considers appropriate; and 2
93	93	(iv) the promotion of interoperability; 3
94	94	(B) account for the legal, economic, and 4
95	95	defense policy aspects of a closer defense pro-5
96	96	curement partnership between the United 6
97	97	States and Taiwan; and 7
98	98	(C) include a list of not fewer than five de-8
99	99	fense capabilities— 9
100	100	(i)(I) developed by, and produced in, 10
101	101	Taiwan; and 11
102	102	(II) that require expedited licenses for 12
103	103	components produced in the United States; 13
104	104	or 14
105	105	(ii) developed by the United States 15
106	106	but for which the United States defense in-16
107	107	dustry cannot meet the demand of Taiwan 17
108	108	on a timely basis so as to necessitate pro-18
109	109	duction in Taiwan. 19
110	110	(3) R
111	111	EPORT.—Not later than 180 days after 20
112	112	the date of the enactment of this Act, the Secretary 21
113	113	of Defense shall submit to the Committees on Armed 22
114	114	Services of the Senate and the House of Representa-23
