2525 Be it enacted by the Senate and House of Representa-1
2626 tives of the United States of America in Congress assembled, 2
2727 SECTION 1. SHORT TITLE. 3
2828 This Act may be cited as the ‘‘Firearm Industry Non- 4
2929 Discrimination Act’’ or the ‘‘FIND Act’’. 5

3737 ROHIBITION.—Chapter 47 of title 41, United 4
3838 States Code, is amended by adding at the end the fol-5
3939 lowing: 6
4040 ‘‘§ 4715. Prohibition on entering into contracts with 7
4141 entities discriminating against firearm or 8
4242 ammunition industries. 9
4343 ‘‘(a) P
4444 ROHIBITION.— 10
4545 ‘‘(1) I
4646 N GENERAL.—The head of an executive 11
4747 agency shall include in each contract for the pro-12
4848 curement of goods or services awarded by the execu-13
4949 tive agency, a clause requiring the prime contractor 14
5050 to certify that the contractor— 15
5151 ‘‘(A) has no policy, practice, guidance, or 16
5252 directive that discriminates against a firearm 17
5353 entity or firearm trade association; and 18
5454 ‘‘(B) will not adopt a policy, practice, guid-19
5555 ance, or directive that discriminates against a 20
5656 firearm entity or firearm trade association dur-21
5757 ing the term of the contract. 22
5858 ‘‘(2) S
5959 UBCONTRACTS.—The head of an execu-23
6060 tive agency shall include in each contract for the 24
6161 procurement of goods or services awarded by the ex-25

6565 ecutive agency, a clause that prohibits the prime 1
6666 contractor on such contract from— 2
6767 ‘‘(A) awarding a first-tier subcontract with 3
6868 a value greater than 10 percent of the total 4
6969 value of the prime contract to an entity that 5
7070 fails to certify in writing to the prime con-6
7171 tractor that the entity— 7
7272 ‘‘(i) has no policy, practice, guidance, 8
7373 or directive that discriminates against a 9
7474 firearm entity or firearm trade association; 10
7575 and 11
7676 ‘‘(ii) will not adopt a policy, practice, 12
7777 guidance, or directive that discriminates 13
7878 against a firearm entity or firearm trade 14
7979 association during the term of the con-15
8080 tract; and 16
8181 ‘‘(B) structuring subcontract tiers in a 17
8282 manner designed to avoid violating subpara-18
8383 graph (A) by enabling a subcontractor to per-19
8484 form more than 10 percent of the total value of 20
8585 the prime contract as a lower-tier subcon-21
8686 tractor. 22
8787 ‘‘(3) P
8888 ENALTIES.—The clause included in con-23
8989 tracts pursuant to paragraph (1) or paragraph (2) 24

9494 tractor violates the clause— 2
9595 ‘‘(A) the prime contract shall be termi-3
9696 nated for default; and 4
9797 ‘‘(B) a suspension or debarment pro-5
9898 ceeding will be initiated for the contractor on 6
9999 the basis of the violation. 7
100100 ‘‘(b) E
101101 XCEPTION.—Subsection (a) shall not apply to 8
102102 a contract for the procurement of goods or services that 9
103103 is a sole-source contract. 10
104104 ‘‘(c) D
105105 EFINITIONS.—In this section: 11
106106 ‘‘(1) D
107107 ISCRIMINATE.—The term ‘discriminate’ 12
108108 means to— 13
109109 ‘‘(A) make a judgement about a policy, 14
110110 practice, guidance, or directive on the basis 15
111111 of— 16
112112 ‘‘(i) partial criteria or a category- 17
113113 based assessment analysis, rather than— 18
114114 ‘‘(I) on a case-by-case basis; or 19
115115 ‘‘(II) using empirical data evalu-20
116116 ated under quantifiable standards; or 21
117117 ‘‘(ii) criteria other than criteria free 22
118118 from— 23
119119 ‘‘(I) favoritism or prejudice 24
120120 against or dislike for the firearm enti-25

125125 or services sold by the firearm entity 2
126126 or trade association; or 3
127127 ‘‘(II) favoritism for market alter-4
128128 natives to the business of the firearm 5
129129 entity or the trade association; 6
130130 ‘‘(B) refuse to provide services, or deny, 7
131131 cancel, or limit services, to the firearm entity or 8
132132 trade association on the basis of criteria other 9
133133 than— 10
134134 ‘‘(i) criteria free from— 11
135135 ‘‘(I) favoritism or prejudice 12
136136 against or dislike for the firearm enti-13
137137 ty or trade association or the products 14
138138 or services sold by the firearm entity 15
139139 or trade association; or 16
140140 ‘‘(II) favoritism for market alter-17
141141 natives to the business of the firearm 18
142142 entity or the trade association; 19
143143 ‘‘(ii) criteria related to credit history 20
144144 and financial risk specific to a customer or 21
145145 potential customer; or 22
146146 ‘‘(iii) criteria related to noncompliance 23
147147 with Federal, State, or local law; or 24

152152 tity or trade association in manner not required 2
153153 by— 3
154154 ‘‘(i) Federal, State, or local law; or 4
155155 ‘‘(ii) Federal, State, or local regula-5
156156 tion. 6
157157 ‘‘(2) F
158158 IREARM ENTITY.—The term ‘firearm en-7
159159 tity’ means any— 8
160160 ‘‘(A) person who is licensed under section 9
161161 923 of title 18 to import, manufacture, or deal 10
162162 in firearms; 11
163163 ‘‘(B) seller of ammunition, as defined in 12
164164 section 7903 of title 15; 13
165165 ‘‘(C) manufacturer or importer of, or deal-14
166166 er in, a secure gun storage or safety device, as 15
167167 defined in section 921(a) of title 18; and 16
168168 ‘‘(D) manufacturer or importer of, or deal-17
169169 er in, a component part or accessory of a fire-18
170170 arm or ammunition. 19

172172 IREARM TRADE ASSOCIATION .—The term 20
173173 ‘firearm trade association’ has the meaning in sec-21
174174 tion 7903 of title 15. 22
175175 ‘‘(4) F
176176 IRST-TIER SUBCONTRACT .—The term 23
177177 ‘first-tier subcontract’ means a subcontract entered 24

184184 OWER-TIER SUBCONTRACTOR .—The term 3
185185 ‘lower-tier subcontractor’ means any person entering 4
186186 into a contract with a subcontractor of a prime con-5
187187 tractor for the purposes of carrying out the prime 6
188188 contract. 7
189189 ‘‘(6) P
190190 RIME CONTRACT; PRIME CONTRACTOR .— 8
191191 The terms ‘prime contract’ and ‘prime contractor’ 9
192192 have the meaning given those terms in section 8701 10
193193 of title 41.’’. 11

195195 PPLICATION.—Section 4715 of title 41, United 12
196196 States Code, as added by subsection (a), shall apply with 13
197197 respect to contracts awarded on or after the date of the 14
198198 enactment of this Act. 15

200200 LERICALAMENDMENT.—The table of sections 16
201201 for chapter 47 of title 41, United States Code, is amended 17
202202 by adding at the end the following: 18
203203 ‘‘4715. Prohibition on entering into contracts with entities discriminating
204204 against firearm or ammunition industries.’’.
