21	21	To amend title 41, United States Code, to prohibit the Fed-
22	22	eral Government from entering into contracts with an
23	23	entity that discriminates against firearm or ammunition
24	24	industries, and for other purposes.
25	25	Be it enacted by the Senate and House of Representa-1
26	26	tives of the United States of America in Congress assembled, 2
27	27	SECTION 1. SHORT TITLE. 3
28	28	This Act may be cited as the ‘‘Firearm Industry Non- 4
29	29	Discrimination Act’’ or the ‘‘FIND Act’’. 5

34	34	WITH ENTITIES DISCRIMINATING AGAINST 2
35	35	FIREARM OR AMMUNITION INDUSTRIES. 3

37	37	ROHIBITION.—Chapter 47 of title 41, United 4
38	38	States Code, is amended by adding at the end the fol-5
39	39	lowing: 6
40	40	‘‘§ 4715. Prohibition on entering into contracts with 7
41	41	entities discriminating against firearm or 8
42	42	ammunition industries. 9
43	43	‘‘(a) P
44	44	ROHIBITION.— 10
45	45	‘‘(1) I
46	46	N GENERAL.—The head of an executive 11
47	47	agency shall include in each contract for the pro-12
48	48	curement of goods or services awarded by the execu-13
49	49	tive agency, a clause requiring the prime contractor 14
50	50	to certify that the contractor— 15
51	51	‘‘(A) has no policy, practice, guidance, or 16
52	52	directive that discriminates against a firearm 17
53	53	entity or firearm trade association; and 18
54	54	‘‘(B) will not adopt a policy, practice, guid-19
55	55	ance, or directive that discriminates against a 20
56	56	firearm entity or firearm trade association dur-21
57	57	ing the term of the contract. 22
58	58	‘‘(2) S
59	59	UBCONTRACTS.—The head of an execu-23
60	60	tive agency shall include in each contract for the 24
61	61	procurement of goods or services awarded by the ex-25

65	65	ecutive agency, a clause that prohibits the prime 1
66	66	contractor on such contract from— 2
67	67	‘‘(A) awarding a first-tier subcontract with 3
68	68	a value greater than 10 percent of the total 4
69	69	value of the prime contract to an entity that 5
70	70	fails to certify in writing to the prime con-6
71	71	tractor that the entity— 7
72	72	‘‘(i) has no policy, practice, guidance, 8
73	73	or directive that discriminates against a 9
74	74	firearm entity or firearm trade association; 10
75	75	and 11
76	76	‘‘(ii) will not adopt a policy, practice, 12
77	77	guidance, or directive that discriminates 13
78	78	against a firearm entity or firearm trade 14
79	79	association during the term of the con-15
80	80	tract; and 16
81	81	‘‘(B) structuring subcontract tiers in a 17
82	82	manner designed to avoid violating subpara-18
83	83	graph (A) by enabling a subcontractor to per-19
84	84	form more than 10 percent of the total value of 20
85	85	the prime contract as a lower-tier subcon-21
86	86	tractor. 22
87	87	‘‘(3) P
88	88	ENALTIES.—The clause included in con-23
89	89	tracts pursuant to paragraph (1) or paragraph (2) 24

93	93	shall provide that, in the event that the prime con-1
94	94	tractor violates the clause— 2
95	95	‘‘(A) the prime contract shall be termi-3
96	96	nated for default; and 4
97	97	‘‘(B) a suspension or debarment pro-5
98	98	ceeding will be initiated for the contractor on 6
99	99	the basis of the violation. 7
100	100	‘‘(b) E
101	101	XCEPTION.—Subsection (a) shall not apply to 8
102	102	a contract for the procurement of goods or services that 9
103	103	is a sole-source contract. 10
104	104	‘‘(c) D
105	105	EFINITIONS.—In this section: 11
106	106	‘‘(1) D
107	107	ISCRIMINATE.—The term ‘discriminate’ 12
108	108	means to— 13
109	109	‘‘(A) make a judgement about a policy, 14
110	110	practice, guidance, or directive on the basis 15
111	111	of— 16
112	112	‘‘(i) partial criteria or a category- 17
113	113	based assessment analysis, rather than— 18
114	114	‘‘(I) on a case-by-case basis; or 19
115	115	‘‘(II) using empirical data evalu-20
116	116	ated under quantifiable standards; or 21
117	117	‘‘(ii) criteria other than criteria free 22
118	118	from— 23
119	119	‘‘(I) favoritism or prejudice 24
120	120	against or dislike for the firearm enti-25

125	125	or services sold by the firearm entity 2
126	126	or trade association; or 3
127	127	‘‘(II) favoritism for market alter-4
128	128	natives to the business of the firearm 5
129	129	entity or the trade association; 6
130	130	‘‘(B) refuse to provide services, or deny, 7
131	131	cancel, or limit services, to the firearm entity or 8
132	132	trade association on the basis of criteria other 9
133	133	than— 10
134	134	‘‘(i) criteria free from— 11
135	135	‘‘(I) favoritism or prejudice 12
136	136	against or dislike for the firearm enti-13
137	137	ty or trade association or the products 14
138	138	or services sold by the firearm entity 15
139	139	or trade association; or 16
140	140	‘‘(II) favoritism for market alter-17
141	141	natives to the business of the firearm 18
142	142	entity or the trade association; 19
143	143	‘‘(ii) criteria related to credit history 20
144	144	and financial risk specific to a customer or 21
145	145	potential customer; or 22
146	146	‘‘(iii) criteria related to noncompliance 23
147	147	with Federal, State, or local law; or 24

152	152	tity or trade association in manner not required 2
153	153	by— 3
154	154	‘‘(i) Federal, State, or local law; or 4
155	155	‘‘(ii) Federal, State, or local regula-5
156	156	tion. 6

158	158	IREARM ENTITY.—The term ‘firearm en-7
159	159	tity’ means any— 8
160	160	‘‘(A) person who is licensed under section 9
161	161	923 of title 18 to import, manufacture, or deal 10
162	162	in firearms; 11
163	163	‘‘(B) seller of ammunition, as defined in 12
164	164	section 7903 of title 15; 13
165	165	‘‘(C) manufacturer or importer of, or deal-14
166	166	er in, a secure gun storage or safety device, as 15
167	167	defined in section 921(a) of title 18; and 16
168	168	‘‘(D) manufacturer or importer of, or deal-17
169	169	er in, a component part or accessory of a fire-18
170	170	arm or ammunition. 19

172	172	IREARM TRADE ASSOCIATION .—The term 20
173	173	‘firearm trade association’ has the meaning in sec-21
174	174	tion 7903 of title 15. 22
175	175	‘‘(4) F
176	176	IRST-TIER SUBCONTRACT .—The term 23
177	177	‘first-tier subcontract’ means a subcontract entered 24

182	182	for the purposes of carrying out the prime contract. 2

184	184	OWER-TIER SUBCONTRACTOR .—The term 3
185	185	‘lower-tier subcontractor’ means any person entering 4
186	186	into a contract with a subcontractor of a prime con-5
187	187	tractor for the purposes of carrying out the prime 6
188	188	contract. 7
189	189	‘‘(6) P
190	190	RIME CONTRACT; PRIME CONTRACTOR .— 8
191	191	The terms ‘prime contract’ and ‘prime contractor’ 9
192	192	have the meaning given those terms in section 8701 10
193	193	of title 41.’’. 11
194	194	(b) A
195	195	PPLICATION.—Section 4715 of title 41, United 12
196	196	States Code, as added by subsection (a), shall apply with 13
197	197	respect to contracts awarded on or after the date of the 14
198	198	enactment of this Act. 15

200	200	LERICALAMENDMENT.—The table of sections 16
201	201	for chapter 47 of title 41, United States Code, is amended 17
202	202	by adding at the end the following: 18
203	203	‘‘4715. Prohibition on entering into contracts with entities discriminating
204	204	against firearm or ammunition industries.’’.
