34 | 34 | | where the provider or recipient of such services is located, 5 |
---|
35 | 35 | | if the provision of such services is within the scope of the 6 |
---|
36 | 36 | | authorized Federal duties of the provider. 7 |

38 | 38 | | OVEREDMENTALHEALTHPROFESSIONALS.— 8 |
---|
39 | 39 | | A mental health professional described in this subsection 9 |
---|
40 | 40 | | is a person who is— 10 |
---|
41 | 41 | | (1) a currently licensed or certified mental 11 |
---|
42 | 42 | | health care provider who holds an unrestricted li-12 |
---|
43 | 43 | | cense or certification that is— 13 |
---|
44 | 44 | | (A) issued by a State, the District of Co-14 |
---|
45 | 45 | | lumbia, or a territory or possession of the 15 |
---|
46 | 46 | | United States; and 16 |
---|
47 | 47 | | (B) recognized by the Secretary of De-17 |
---|
48 | 48 | | fense; 18 |
---|
49 | 49 | | (2) a member of the uniformed services, a civil-19 |
---|
50 | 50 | | ian employee of the Department of Defense, or a 20 |
---|
51 | 51 | | contractor designated by the Secretary; and 21 |
---|
52 | 52 | | (3) performing authorized duties for the De-22 |
