16	16	within the Department, and for other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘VA medical Center 4
21	21	Absence and Notification Timeline Act’’ or the ‘‘VACANT 5
22	22	Act’’. 6

27	27	ICAL CENTERS OF DEPARTMENT OF VET-2
28	28	ERANS AFFAIRS TO DIFFERENT POSITIONS. 3

30	30	OTIFICATION.— 4
31	31	(1) I
32	32	N GENERAL.—Not later than 90 days after 5
33	33	detailing a director of a medical center of the De-6
34	34	partment of Veterans Affairs to a different position 7
35	35	within the Department, the Secretary of Veterans 8
36	36	Affairs shall notify the Committee on Veterans’ Af-9
37	37	fairs of the Senate and the Committee on Veterans’ 10
38	38	Affairs of the House of Representatives of such de-11
39	39	tail. 12
40	40	(2) M
41	41	ATTERS TO BE INCLUDED .—The notifica-13
42	42	tion required by paragraph (1) shall include, with re-14
43	43	spect to a director of a medical center who is de-15
44	44	tailed to a different position within the Department, 16
45	45	the following information: 17
46	46	(A) The location at which the director is 18
47	47	detailed. 19
48	48	(B) The position title of the detail. 20
49	49	(C) The estimated time the director is ex-21
50	50	pected to be absent from their duties at the 22
51	51	medical center. 23
52	52	(D) Such other information as the Sec-24
53	53	retary may determine appropriate. 25

57	57	(b) APPOINTMENT OFACTINGDIRECTOR.—Not later 1
58	58	than 120 days after detailing a director of a medical cen-2
59	59	ter of the Department to a different position within the 3
60	60	Department, the Secretary shall appoint an individual as 4
61	61	acting director of such medical center with all of the au-5
62	62	thority and responsibilities of the detailed director. 6
63	63	(c) U
64	64	PDATE ONDETAIL.—Not later than 120 days 7
65	65	after detailing a director of a medical center of the De-8
66	66	partment to a different position within the Department, 9
67	67	and not less frequently than every 30 days thereafter while 10
68	68	the detail is in effect or while the director position at the 11
69	69	medical center is vacant, the Secretary shall submit to the 12
70	70	Committee on Veterans’ Affairs of the Senate and the 13
71	71	Committee on Veterans’ Affairs of the House of Rep-14
72	72	resentatives an update regarding the status of the detail. 15

74	74	ETURN TOPOSITION ORREASSIGNMENT.— 16
75	75	(1) I
76	76	N GENERAL.—Except as provided in para-17
77	77	graph (2), not later than 180 days after detailing a 18
78	78	director of a medical center of the Department to a 19
79	79	different position within the Department, for a rea-20
80	80	son other than an ongoing investigation or adminis-21
81	81	trative action with respect to the director, the Sec-22
82	82	retary shall— 23
83	83	(A) return the individual to the position as 24
84	84	director of the medical center; or 25

89	89	tion as director of the medical center and begin 2
90	90	the process of hiring a new director for such po-3
91	91	sition. 4

93	93	AIVER.— 5
94	94	(A) I
95	95	N GENERAL.—The Secretary may 6
96	96	waive the requirement under paragraph (1) 7
97	97	with respect to an individual for successive 90- 8
98	98	day increments for a total period of not more 9
99	99	than 540 days from the original date the indi-10
100	100	vidual was detailed away from their position as 11
101	101	director of a medical center. 12
102	102	(B) N
103	103	OTIFICATION.—Not later than 30 13
104	104	days after exercising a waiver under subpara-14
105	105	graph (A), the Secretary shall notify Congress 15
106	106	of the waiver and provide to Congress informa-16
107	107	tion as to why the waiver is necessary. 17
