4949 NGENERAL.—Section 24 of the Internal Rev-3
5050 enue Code of 1986 is amended by striking subsections (a), 4
5151 (b), and (c) and inserting the following new subsections: 5
5252 ‘‘(a) A
5353 LLOWANCE OF CREDIT.—There shall be al-6
5454 lowed as a credit against the tax imposed by this chapter 7
5555 for the taxable year an amount equal to the sum of— 8
5656 ‘‘(1) $3,500 for each qualifying child of the tax-9
5757 payer ($4,500 in the case of a qualifying child who 10
5858 has not attained age 6 as of the close of the cal-11
5959 endar year in which the taxable year of the taxpayer 12

107107 For purposes of this subsection, the term ‘social se-4
108108 curity number’ means, with respect to a return of 5
109109 tax, a social security number issued to an individual 6
110110 by the Social Security Administration, but only if 7
111111 the social security number is issued— 8
112112 ‘‘(A) to a citizen of the United States or 9
113113 pursuant to subclause (I) (or that portion of 10
114114 subclause (III) that relates to subclause (I)) of 11

202202 N GENERAL.—The term ‘qualifying child’ 10
203203 includes an unborn child of an eligible taxpayer, and 11
204204 the requirements of subsection (c)(1)(C) shall be 12
205205 treated as met with respect to such child, for the 13
206206 taxable year immediately preceding the year in 14
207207 which such child is born alive, if the taxpayer in-15
208208 cludes on the return of tax for such taxable year a 16
209209 social security number for such child which is issued 17
210210 before the due date for such return of tax (without 18
211211 regard to extensions). 19

230230 ‘‘(ii) the amount of the credit allowed 8
231231 (before the application of this subsection) 9
232232 under subsection (d)(1), 10
233233 shall each be increased by the amount of the 11
234234 credit which would have been allowed under 12
235235 each such subsection respectively with respect 13
236236 to such child for the preceding taxable year if 14
237237 such child had been treated as a qualifying 15
238238 child of the taxpayer for such preceding year. 16

241241 CREDIT.—In the case of a child otherwise de-18
242242 scribed in subparagraph (A) who, but for this 19
243243 subparagraph, would not be treated as a quali-20
244244 fying child of the eligible taxpayer for the tax-21
245245 able year in which such child is born alive— 22
246246 ‘‘(i) subparagraph (A) shall not apply 23
247247 with respect to such child, 24

257257 out regard to this subparagraph, be 7
258258 treated as a qualifying child, and 8
259259 ‘‘(iii) in the case of the eligible tax-9
260260 payer, the amount of the credit allowed 10
261261 under subsection (a) and the amount of 11
262262 the credit allowed under subsection (d)(1) 12
263263 for such taxable year shall each be equal to 13

265265 been allowed under each such subsection 15

282282 gible taxpayer’ means a taxpayer who— 2
283283 ‘‘(i) with respect to a child, is the 3
284284 mother who— 4
285285 ‘‘(I) carries or carried such child 5
286286 in the womb, and 6
287287 ‘‘(II) is the biological mother of 7
288288 such child or initiated the pregnancy 8
289289 with the intention of bearing and re-9
290290 taining custody of and parental rights 10
291291 to such child (or acted to such effect), 11
292292 or 12
293293 ‘‘(ii) in the case of a joint return, is 13
294294 the husband of such mother, 14
295295 but only if such taxpayer includes on the return 15
296296 of tax for the taxable year the social security 16
297297 number of such taxpayer (of at least 1 of such 17
298298 mother or husband, in the case of a joint re-18
299299 turn). 19

301301 OCIAL SECURITY NUMBER .—The 20

318318 SEC. 4. DENIAL OF DEDUCTION FOR STATE AND LOCAL 7

533533 amount of a monthly payment made in any benefit 14

535535 tled to a parental leave benefit shall be an amount 16

538538 efit determined for the individual under sub-19
539539 section (b); divided by 20

567567 subject to criminal and civil penalties; 17
568568 ‘‘(ii) the full cost to the Trust Funds 18
569569 of any amount received by an individual as 19
570570 a parental leave benefit must be repaid 20
571571 through reductions to old-age insurance 21
572572 benefits payable to the individual in subse-22
573573 quent months, or by other means; and 23
574574 ‘‘(iii) entitlement to a parental leave 24
575575 benefit has no effect on the determination 25

602602 a social security account number for such qualified 23

617617 cial Security shall establish procedures to ensure the 9
618618 prevention of fraud with respect to applications for 10
619619 parental leave benefits under this section, including 11
620620 procedures for the submission of such proof or docu-12
621621 mentation as the Commissioner may require to 13
622622 verify the information contained in such an applica-14
623623 tion. 15
624624 ‘‘(2) E
625625 NFORCEMENT.—In any case in which an 16
626626 individual willfully, knowingly, and with intent to de-17
627627 ceive the Commissioner of Social Security fails to 18
628628 comply with the procedures established under para-19
629629 graph (1), the Commissioner may impose on such in-20
630630 dividual, in addition to any other penalties that may 21
631631 be prescribed by law— 22
632632 ‘‘(A) a civil monetary penalty of not more 23
633633 than $7,500 for each such failure; and 24

689689 such individual may elect, at the time of appli-18
690690 cation for such benefit, to be subject to a retire-19
691691 ment age increase in accordance with this para-20
692692 graph. Such election shall be irrevocable, and 21
693693 an individual who makes such an election shall 22
694694 not be subject to a deduction under paragraph 23

741741 ‘‘(B) the Commissioner may recover such 13
742742 amounts by means of any method available to 14
743743 the Commissioner under such section. 15

949949 mental nutrition assistance program, as defined in section 14
950950 3(t) of the Food and Nutrition Act of 2008 (7 U.S.C. 15
951951 2012(t)), and, at the option of the State, may limit partici-16
952952 pation in such program to such eligible non-custodial par-17

15821582 mother and help that mother address barriers to 17
15831583 care, mental, behavioral, and physical well-being, 18
15841584 and economic mobility by providing support services 19
15851585 and linkages to community resources. A community- 20
15861586 based mentoring relationship should, to the extent 21
15871587 practicable, have an understanding of the barriers 22
15881588 and lived experience of that community, which may 23
15891589 include shared lived experience. 24
