2323 SECTION 1. SHORT TITLE. 3
2424 This Act may be cited as the ‘‘Standing with Moms 4
2525 Act of 2023’’. 5
2626 SEC. 2. AWARENESS FOR EXPECTING MOTHERS. 6
2727 The Public Health Service Act is amended by adding 7

3434 ‘‘SEC. 3401. WEBSITE AND PORTAL. 3
3535 ‘‘(a) W
3636 EBSITE.—Not later than 1 year after the date 4
3737 of enactment of this section, the Secretary shall publish 5
3838 a user-friendly public website, life.gov, to provide a com-6
3939 prehensive list of Federal, State, local governmental, and 7
4040 private resources available to pregnant women including— 8
4141 ‘‘(1) resources to mental health counseling, 9
4242 pregnancy counseling, and other prepartum and 10
4343 postpartum services; 11
4444 ‘‘(2) comprehensive information on alternatives 12
4545 to abortion; 13
4646 ‘‘(3) information about abortion risks, including 14
4747 complications and failures; and 15
4848 ‘‘(4) links to information on child development 16
4949 from moment of conception. 17
5050 ‘‘(b) P
5151 ORTAL.—Not later than 1 year after the date 18
5252 of enactment of this section, the Secretary shall publish 19
5353 a portal on the public website of the Department of Health 20
5454 and Human Services that— 21
5555 ‘‘(1) through a series of questions, will furnish 22
5656 specific tailored information to the user on what 23
5757 pregnancy-related information they are looking for, 24
5858 such as— 25

6363 and private resources that may be available to 2
6464 the woman within her ZIP Code, including the 3
6565 resources specified in subsection (c); and 4
6666 ‘‘(B) risks related to abortion at all stages 5
6767 of fetal gestation; and 6
6868 ‘‘(2) provides for the submission of feedback on 7
6969 how user-friendly and helpful the portal was in pro-8
7070 viding the tailored information the user was seeking. 9
7171 ‘‘(c) R
7272 ESOURCES.—The Federal, State, local govern-10
7373 mental, and private resources specified in this subsection 11
7474 are the following: 12
7575 ‘‘(1) Mentorship opportunities, including preg-13
7676 nancy help and case management resources. 14
7777 ‘‘(2) Health and well-being services, including 15
7878 women’s medical services such as obstetrical and 16
7979 gynecological support services for women, abortion 17
8080 pill reversal, breastfeeding, general health services, 18
8181 primary care, and dental care. 19
8282 ‘‘(3) Financial assistance, work opportunities, 20
8383 nutrition assistance, childcare, and education oppor-21
8484 tunities. 22
8585 ‘‘(4) Material or legal support, including trans-23
8686 portation, food, nutrition, clothing, household goods, 24
8787 baby supplies, housing, shelters, maternity homes, 25

9292 family leave, breastfeeding protections, and custody 2
9393 issues. 3
9494 ‘‘(5) Recovery and mental health services, in-4
9595 cluding services with respect to addiction or suicide 5
9696 intervention, intimate partner violence, sexual as-6
9797 sault, rape, sex trafficking, and counseling for 7
9898 women and families surrounding unexpected loss of 8
9999 a child. 9
100100 ‘‘(6) Prenatal diagnostic services, including dis-10
101101 ability support organizations, medical interventions 11
102102 for a baby, perinatal hospice resources, pregnancy 12
103103 and infant loss support, and literature on pregnancy 13
104104 wellness. 14
105105 ‘‘(7) Healing and support services for abortion 15
106106 survivors and their families. 16
107107 ‘‘(8) Services providing care for children, in-17
108108 cluding family planning education, adoption, foster 18
109109 care, and short-term care resources. 19
110110 ‘‘(d) A
111111 DMINISTRATION.—The Secretary may not del-20
112112 egate implementation or administration of the portal es-21
113113 tablished under subsection (b) below the level of the Office 22
114114 of the Secretary. 23
115115 ‘‘(e) F
116116 OLLOW-UP.—The Secretary shall develop a 24
117117 plan under which— 25

121121 ‘‘(1) the Secretary includes in the portal estab-1
122122 lished under subsection (b), a mechanism for users 2
123123 of the portal to take an assessment through the por-3
124124 tal and provide consent to use the user’s contact in-4
125125 formation; 5
126126 ‘‘(2) the Secretary conducts outreach via phone 6
127127 or email to follow up with users of the portal estab-7
128128 lished under subsection (b) on additional resources 8
129129 that would be helpful for the users to review; and 9
130130 ‘‘(3) upon the request of a user of the portal for 10
131131 specific information, after learning of the additional 11
132132 resources through the portal, agents of the Depart-12
133133 ment of Health and Human Services make every ef-13
134134 fort to furnish specific information to such user in 14
135135 coordination with Federal, State, local governmental, 15
136136 and private health care providers and resources. 16
137137 ‘‘(f) R
138138 ESOURCELISTAGGREGATION.— 17
139139 ‘‘(1) I
140140 N GENERAL.—Pursuant to criteria devel-18
141141 oped in subsection (e)(2), each State shall provide 19
142142 recommendations of State, local governmental, and 20
143143 private resources under subsection (b)(1)(A) to in-21
144144 clude in the portal. 22
145145 ‘‘(2) C
146146 RITERIA FOR MAKING RECOMMENDA -23
147147 TIONS.—The Secretary shall develop criteria to pro-24
148148 vide to the States to determine whether resources 25

153153 clusion in the portal can appear in the portal. Such 2
154154 criteria shall include the requirement that the re-3
155155 source provider is not a prohibited entity and the re-4
156156 quirement that the resource provider has been en-5
157157 gaged in providing services for a minimum of 3 con-6
158158 secutive years. 7
159159 ‘‘(3) G
160160 RANT PROGRAM.— 8
161161 ‘‘(A) I
162162 N GENERAL.—The Secretary may 9
163163 provide grants to States to establish or support 10
164164 a system that aggregates the resources de-11
165165 scribed in subsection (b)(1)(A), in accordance 12
166166 with the criteria developed under paragraph 13
167167 (2), and that may be coordinated, to the extent 14
168168 determined appropriate by the State, by a 15
169169 statewide, regionally based, or community-based 16
170170 public entity or private nonprofit. 17
171171 ‘‘(B) A
172172 PPLICATIONS.—To be eligible to re-18
173173 ceive a grant under subparagraph (A), a State 19
174174 shall submit an application to the Secretary at 20
175175 such time, in such manner, and containing such 21
176176 information as the Secretary may require, in-22
177177 cluding a plan for outreach and awareness ac-23
178178 tivities, and a list of service providers that 24

185185 ATERNALMENTALHEALTHHOTLINE.—The 3
186186 Secretary shall ensure that the Maternal Mental Health 4
187187 Hotline of the Health Resources and Services Administra-5
188188 tion— 6
189189 ‘‘(1) disseminates information regarding, and 7
190190 linkages to, the life.gov website and portal described 8
191191 in subsections (a) and (b); 9
192192 ‘‘(2) has the capacity to help families in every 10
193193 State and community in the Nation; and 11
194194 ‘‘(3) includes live chat features, 24 hours a day, 12
195195 to connect individuals to the information the portal 13
196196 hosts. 14
197197 ‘‘(h) P
198198 ROHIBITIONREGARDINGCERTAINENTI-15
199199 TIES.—The resources listed on the life.gov website, and 16
200200 made available through the portal and hotline established 17
201201 under this section may not include any resource offered 18
202202 by a prohibited entity. 19
203203 ‘‘(i) S
204204 ERVICES INDIFFERENTLANGUAGES.—The 20
205205 life.gov website and hotline shall ensure the widest possible 21
206206 access to services for families who speak languages other 22
207207 than English. 23
208208 ‘‘(j) R
209209 EPORTINGREQUIREMENTS.— 24

213213 ‘‘(1) IN GENERAL.—Not later than 180 days 1
214214 after date on which the life.gov website and portal 2
215215 are established under subsection (a), the Secretary 3
216216 shall submit to Congress a report on— 4
217217 ‘‘(A) the traffic of the website and the 5
218218 interactive portal; 6
219219 ‘‘(B) user feedback on the accessibility and 7
220220 helpfulness of the website and interactive portal 8
221221 in tailoring to the user’s needs; 9
222222 ‘‘(C) insights on gaps in Federal, State, 10
223223 local governmental, and private programming 11
224224 with respect to services for pregnant and 12
225225 postpartum women; and 13
226226 ‘‘(D) suggestions on how to improve user 14
227227 experience and accessibility based on user feed-15
228228 back and missing resources that would be help-16
229229 ful to include in future updates. 17
230230 ‘‘(2) C
231231 ONFIDENTIALITY.—The report under 18
232232 paragraph (1) shall not include any personal identi-19
233233 fying information regarding individuals who have 20
234234 used the website or portal. 21
235235 ‘‘(k) D
236236 EFINITIONS.—In this section: 22
237237 ‘‘(1) A
238238 BORTION.—The term ‘abortion’ means 23
239239 the use or prescription of any instrument, medicine, 24
240240 drug, or other substance or device to intentionally— 25

245245 known to be pregnant; or 2
246246 ‘‘(B) prematurely terminate the pregnancy 3
247247 of a woman known to be pregnant, with an in-4
248248 tention other than to— 5
249249 ‘‘(i) increase the probability of a live 6
250250 birth or of preserving the life or health of 7
251251 the child after live birth; or 8
252252 ‘‘(ii) remove a dead unborn child. 9
253253 ‘‘(2) B
254254 ORN ALIVE.—The term ‘born alive’ has 10
255255 the meaning given such term in section 8(b) of title 11
256256 1, United States Code. 12
257257 ‘‘(3) P
258258 ROHIBITED ENTITY.—The term ‘prohib-13
259259 ited entity’ means an entity, including its affiliates, 14
260260 subsidiaries, successors, and clinics that performs, 15
261261 induces, refers for, or counsels in favor of abortions, 16
262262 or provides financial support to any other organiza-17
263263 tion that conducts such activities. 18
264264 ‘‘(4) U
265265 NBORN CHILD.—The term ‘unborn child’ 19
266266 means an individual organism of the species homo 20
267267 sapiens, beginning at fertilization, until the point of 21
268268 being born alive.’’. 22
