2323 SECTION 1. SHORT TITLE. 3
2424 This Act may be cited as the ‘‘Strengthening En-4
2525 forcement to Curtail Unlawful, Risky Entrance to Flights 5
2626 Act of 2023’’ or the ‘‘SECURE Flights Act of 2023’’. 6

3434 NGENERAL.—The Administrator may not ac-4
3535 cept as valid proof of identification a prohibited identifica-5
3636 tion document at an airport security checkpoint. 6

3838 OTIFICATION TOIMMIGRATIONAGENCIES.—If 7
3939 an individual presents a prohibited identification docu-8
4040 ment to an officer of the Transportation Security Admin-9
4141 istration at an airport security checkpoint, the Adminis-10
4242 trator shall promptly notify the Director of U.S. Immigra-11
4343 tion and Customs Enforcement, the Director of U.S. Cus-12
4444 toms and Border Protection, and the head of the appro-13
4545 priate local law enforcement agency to determine whether 14
4646 the individual is in violation of any term of release from 15
4747 the custody of any such agency. 16

4949 NTRYINTOSTERILEAREAS.— 17

5151 N GENERAL.—Except as provided in para-18
5252 graph (2), if an individual is found to be in violation 19
5353 of any term of release under subsection (b), the Ad-20
5454 ministrator shall not permit such individual to enter 21
5555 a sterile area. 22

5757 XCEPTION.—An individual presenting a 23
5858 prohibited identification document under this section 24
5959 may enter a sterile area if the individual— 25

6767 SEC. 3. COLLECTION OF BIOMETRIC INFORMATION FROM 5
6868 CERTAIN INDIVIDUALS SEEKING ENTRY INTO 6
6969 STERILE AREAS. 7
7070 (a) I
7171 NGENERAL.—Beginning not later than 120 8
7272 days after the date of the enactment of this Act, the Ad-9
7373 ministrator shall collect biometric information from an in-10
7474 dividual described in subsection (b) prior to authorizing 11
7575 such individual to enter into a sterile area. 12
7676 (b) I
7777 NDIVIDUALDESCRIBED.—An individual de-13
7878 scribed in this subsection is an individual who— 14
7979 (1) is seeking entry into a sterile area; 15
8080 (2) does not present a covered identification 16
8181 document; and 17
8282 (3) the Administrator cannot verify is a na-18
8383 tional of the United States. 19

8585 ARTICIPATION INIDENT.—Beginning not later 20
8686 than 120 days after the date of the enactment of this Act, 21
8787 the Administrator, in coordination with the Secretary of 22
8888 Homeland Security, shall submit biometric data collected 23
8989 under this section to the Automated Biometric Identifica-24
9090 tion System (IDENT). 25

102102 metric information’’ means any of the following: 7
103103 (A) A fingerprint. 8
104104 (B) A palm print. 9
105105 (C) A photograph, including— 10
106106 (i) a photograph of an individual’s 11
107107 face for use with facial recognition tech-12
108108 nology; and 13
109109 (ii) a photograph of any physical or 14
110110 anatomical feature, such as a scar, skin 15
111111 mark, or tattoo. 16
112112 (D) A signature. 17
113113 (E) A voice print. 18
114114 (F) An iris image. 19

116116 OVERED IDENTIFICATION DOCUMENT .— 20
117117 The term ‘‘covered identification document’’ means 21
118118 any of the following, if the document is valid and 22
119119 unexpired: 23
120120 (A) A United States passport or passport 24

127127 Department of Homeland Security, including— 3
128128 (i) Global Entry; 4

130130 (iii) Secure Electronic Network for 6
131131 Travelers Rapid Inspection (SENTRI); 7
132132 and 8
133133 (iv) Free and Secure Trade (FAST). 9
134134 (C) An identification card issued by the 10
135135 Department of Defense, including such a card 11
136136 issued to a dependent. 12
137137 (D) Any document required for admission 13
138138 to the United States under section 211(a) of 14
139139 the Immigration and Nationality Act (8 U.S.C. 15
140140 1181(a)). 16
141141 (E) An enhanced driver’s license issued by 17
142142 a State. 18
143143 (F) A photo identification card issued by a 19
144144 federally recognized Indian Tribe. 20
145145 (G) A personal identity verification creden-21
146146 tial issued in accordance with Homeland Secu-22

171171 MMIGRATION LAWS.—The term ‘‘immigra-18
172172 tion laws’’ has the meaning given that term in sec-19
173173 tion 101 of the Immigration and Nationality Act (8 20
174174 U.S.C. 1101). 21
