17	17	To direct the Administrator of the Transportation Security
18	18	Administration to prohibit the use of certain identifica-
19	19	tion documents at airport security checkpoints, and for
20	20	other purposes.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. SHORT TITLE. 3
24	24	This Act may be cited as the ‘‘Strengthening En-4
25	25	forcement to Curtail Unlawful, Risky Entrance to Flights 5
26	26	Act of 2023’’ or the ‘‘SECURE Flights Act of 2023’’. 6

30	30	SEC. 2. PROHIBITED IDENTIFICATION DOCUMENTS AT AIR-1
31	31	PORT SECURITY CHECKPOINTS; NOTIFICA-2
32	32	TION TO IMMIGRATION AGENCIES. 3
33	33	(a) I
34	34	NGENERAL.—The Administrator may not ac-4
35	35	cept as valid proof of identification a prohibited identifica-5
36	36	tion document at an airport security checkpoint. 6
37	37	(b) N
38	38	OTIFICATION TOIMMIGRATIONAGENCIES.—If 7
39	39	an individual presents a prohibited identification docu-8
40	40	ment to an officer of the Transportation Security Admin-9
41	41	istration at an airport security checkpoint, the Adminis-10
42	42	trator shall promptly notify the Director of U.S. Immigra-11
43	43	tion and Customs Enforcement, the Director of U.S. Cus-12
44	44	toms and Border Protection, and the head of the appro-13
45	45	priate local law enforcement agency to determine whether 14
46	46	the individual is in violation of any term of release from 15
47	47	the custody of any such agency. 16

49	49	NTRYINTOSTERILEAREAS.— 17
50	50	(1) I
51	51	N GENERAL.—Except as provided in para-18
52	52	graph (2), if an individual is found to be in violation 19
53	53	of any term of release under subsection (b), the Ad-20
54	54	ministrator shall not permit such individual to enter 21
55	55	a sterile area. 22
56	56	(2) E
57	57	XCEPTION.—An individual presenting a 23
58	58	prohibited identification document under this section 24
59	59	may enter a sterile area if the individual— 25

64	64	purposes of removal or deportation; or 2
65	65	(B) presents a covered identification docu-3
66	66	ment. 4
67	67	SEC. 3. COLLECTION OF BIOMETRIC INFORMATION FROM 5
68	68	CERTAIN INDIVIDUALS SEEKING ENTRY INTO 6
69	69	STERILE AREAS. 7
70	70	(a) I
71	71	NGENERAL.—Beginning not later than 120 8
72	72	days after the date of the enactment of this Act, the Ad-9
73	73	ministrator shall collect biometric information from an in-10
74	74	dividual described in subsection (b) prior to authorizing 11
75	75	such individual to enter into a sterile area. 12
76	76	(b) I
77	77	NDIVIDUALDESCRIBED.—An individual de-13
78	78	scribed in this subsection is an individual who— 14
79	79	(1) is seeking entry into a sterile area; 15
80	80	(2) does not present a covered identification 16
81	81	document; and 17
82	82	(3) the Administrator cannot verify is a na-18
83	83	tional of the United States. 19

85	85	ARTICIPATION INIDENT.—Beginning not later 20
86	86	than 120 days after the date of the enactment of this Act, 21
87	87	the Administrator, in coordination with the Secretary of 22
88	88	Homeland Security, shall submit biometric data collected 23
89	89	under this section to the Automated Biometric Identifica-24
90	90	tion System (IDENT). 25

97	97	DMINISTRATOR.—The term ‘‘Adminis-3
98	98	trator’’ means the Administrator of the Transpor-4
99	99	tation Security Administration. 5

101	101	IOMETRIC INFORMATION .—The term ‘‘bio-6
102	102	metric information’’ means any of the following: 7
103	103	(A) A fingerprint. 8
104	104	(B) A palm print. 9
105	105	(C) A photograph, including— 10
106	106	(i) a photograph of an individual’s 11
107	107	face for use with facial recognition tech-12
108	108	nology; and 13
109	109	(ii) a photograph of any physical or 14
110	110	anatomical feature, such as a scar, skin 15
111	111	mark, or tattoo. 16
112	112	(D) A signature. 17
113	113	(E) A voice print. 18
114	114	(F) An iris image. 19

116	116	OVERED IDENTIFICATION DOCUMENT .— 20
117	117	The term ‘‘covered identification document’’ means 21
118	118	any of the following, if the document is valid and 22
119	119	unexpired: 23
120	120	(A) A United States passport or passport 24

131	131	Travelers Rapid Inspection (SENTRI); 7

133	133	(iv) Free and Secure Trade (FAST). 9

135	135	Department of Defense, including such a card 11
136	136	issued to a dependent. 12
137	137	(D) Any document required for admission 13
138	138	to the United States under section 211(a) of 14
139	139	the Immigration and Nationality Act (8 U.S.C. 15

141	141	(E) An enhanced driver’s license issued by 17

143	143	(F) A photo identification card issued by a 19
144	144	federally recognized Indian Tribe. 20
145	145	(G) A personal identity verification creden-21
146	146	tial issued in accordance with Homeland Secu-22

172	172	tion laws’’ has the meaning given that term in sec-19
173	173	tion 101 of the Immigration and Nationality Act (8 20
