Fund and Complete the Border Wall Act This bill establishes funding for a U.S.-Mexico border barrier and revises how border patrol agents are compensated for overtime. The Department of the Treasury shall set up an account for funding the design, construction, and maintenance of the barrier. The funds in the account are appropriated only for that purpose and for vehicles and equipment for border patrol agents. For each fiscal year, financial assistance to a country shall be reduced by $2,000 for each citizen or national of that country apprehended for illegally entering the United States through its southern border. The reduced amount shall be transferred to the border barrier account. The Department of State may opt not to reduce amounts appropriated to Mexico for various military and law enforcement-related activities. This bill establishes a 5% fee on foreign remittance transfers and increases the fee for the arrival/departure I-94 form for various aliens entering the United States, with part of the fees to go into the border barrier account. By December 31, 2023, DHS shall (1) take all actions necessary, including constructing barriers, to prevent illegal crossings along the U.S.-Mexico barrier; and (2) achieve operational control over all U.S. international borders. The bill changes how border patrol agents receive overtime pay when working up to 100 hours in a two-week period. For hours worked above 80, an agent shall receive at least 150% of the agent's regular hourly rate.

Ending Common Core and Expanding School Choice Act This bill revises requirements related to federal education funding for disadvantaged children. Specifically, the bill (1) eliminates the standards, assessments, and academic accountability requirements for state and local educational agencies that receive federal funds for the education of disadvantaged children; (2) requires such funds to be allocated based on the number of children residing in each state who are living in poverty; and (3) allows educational agencies to distribute per-pupil amounts from such funds to parents for qualified elementary and secondary education expenses. The bill prohibits federal officers or employees from mandating academic standards, assessments, curricula, or accountability systems.

Small Business Flexibility ActThis bill provides statutory authority for the pooling of tips among two pools of employees. The first pool consists of employees who customarily and regularly receive tips (as is permitted under the current statute). The second pool consists of (1) employees who customarily and regularly receive tips and are paid at least minimum wage, and (2) employees who do not customarily and regularly receive tips.

Native American Education Opportunity Act This bill addresses education savings account programs and charter schools for tribal students. Specifically, the bill requires the Department of Education and the Department of the Interior, at the request of federally recognized Indian tribes, to provide funds to tribes for tribal-based education savings account programs. Tribes must use these funds to award grants to education savings accounts for students who (1) attended or will be eligible to attend a school operated by the Bureau of Indian Education (BIE); or (2) will not be attending a school operated by the BIE, receiving an education savings account from another tribe, or attending public elementary or secondary school while participating in the program. Funds may be used for items and activities such as costs of attendance at private schools, private tutoring and online learning programs, textbooks, educational software, or examination fees. The Government Accountability Office must review the implementation of these education savings account programs, including any factors impacting increased participation in such programs. Additionally, the bill authorizes the BIE to approve and fund charter schools at any school that it operates or funds.

Paycheck Fairness Act This bill addresses wage discrimination on the basis of sex, which is defined to include pregnancy, sexual orientation, gender identity, and sex characteristics. Specifically, it limits an employer's defense that a pay differential is based on a factor other than sex to only bona fide job-related factors in wage discrimination claims, enhances nonretaliation prohibitions, and makes it unlawful to require an employee to sign a contract or waiver prohibiting the employee from disclosing information about the employee's wages. The bill also increases civil penalties for violations of equal pay provisions. Additionally, the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs must train EEOC employees and other affected parties on wage discrimination. The bill directs the Department of Labor to (1) establish and carry out a grant program to provide training in negotiation skills related to compensation and equitable working conditions, (2) conduct studies to eliminate pay disparities between men and women, and (3) make available information on wage discrimination to assist the public in understanding and addressing such discrimination. The bill establishes the National Award for Pay Equity in the Workplace for an employer who has made a substantial effort to eliminate pay disparities between men and women. It also establishes the National Equal Pay Enforcement Task Force to address compliance, public education, and enforcement of equal pay laws. Finally, the bill requires the EEOC to issue regulations for collecting from employers compensation and other employment data according to the sex, race, and national origin of employees for use in enforcing laws prohibiting pay discrimination.

Richard L. Trumka Protecting the Right to Organize Act of 2023 This bill expands various labor protections related to employees' rights to organize and collectively bargain in the workplace. Among other things, it (1) revises the definitions of employee, supervisor, and employer to broaden the scope of individuals covered by the fair labor standards; (2) permits labor organizations to encourage participation of union members in strikes initiated by employees represented by a different labor organization (i.e., secondary strikes); and (3) prohibits employers from bringing claims against unions that conduct such secondary strikes. The bill also allows collective bargaining agreements to require all employees represented by the bargaining unit to contribute fees to the labor organization for the cost of such representation, notwithstanding a state law to the contrary; and expands unfair labor practices to include prohibitions against replacement of, or discrimination against, workers who participate in strikes. The bill makes it an unfair labor practice to require or coerce employees to attend employer meetings designed to discourage union membership and prohibits employers from entering into agreements with employees under which employees waive the right to pursue or a join collective or class-action litigation. The bill further prohibits employers from taking adverse actions against an employee, including employees with management responsibilities, in response to that employee participating in protected activities related to the enforcement of the prohibitions against unfair labor practices (i.e., whistleblower protections). Such protected activities include providing information about a potential violation to an enforcement agency, participating in an enforcement proceeding, initiating a proceeding concerning an alleged violation or assisting in such a proceeding, or refusing to participate in an activity the employee reasonably believes is a violation of labor laws. Finally, the bill addresses the procedures for union representation elections, provides employees with the ability to vote in such elections remotely by telephone or the internet, modifies the protections against unfair labor practices that result in serious economic harm, and establishes penalties and permits injunctive relief against entities that fail to comply with National Labor Relations Board orders.

Adjusting Davis-Bacon for Inflation Act This bill increases from $2,000 to $50,000 the threshold above which the prevailing wage requirements apply to federal or District of Columbia government contracts involving the construction, alteration, or repair of public buildings or public works. These requirements generally ensure that workers are paid the prevailing local wage where such projects takes place.

Freedom from Mandates Act This bill nullifies certain executive orders regarding COVID-19 safety and prohibits the Departments of Labor and Health and Human Services (HHS) from taking specified actions with respect to vaccination against COVID-19. Specifically, the bill nullifies Executive Order 14042 (relating to ensuring adequate COVID-19 safety protocols for federal contractors) and Executive Order 14043 (requiring COVID-19 vaccination for federal employees). Labor may not issue any rule requiring employers to mandate vaccination of employees against COVID-19 or requiring testing of employees who are unvaccinated. HHS may not (1) require a health care provider, as a condition of participation in the Medicare or Medicaid program, to mandate vaccination of employees against COVID-19 or require testing of employees who are unvaccinated; or (2) otherwise penalize such a provider for failure to mandate such vaccination or require such testing.

Original Living Wage Act This bill increases the federal minimum wage to the minimum hourly wage sufficient for a person working for 40 hours per week, 52 weeks per year, to earn an annual income 25.5% higher than the federal poverty threshold for a four-person household, with two children under age 18, and living in the 48 contiguous states. (Under current poverty thresholds, the national minimum wage would be set at approximately $15.64 per hour.) The Department of Labor must determine the minimum wage rate by June 1, 2023, and review it every four years. Labor may not adjust the minimum wage to a lower rate.

National Jazz Preservation, Education, and Promulgation Act of 2023 This bill establishes a National Jazz Preservation Program and a National Jazz Appreciation Program, to be carried out by the Smithsonian Institution through the National Museum of American History, to (1) preserve knowledge and promote education about jazz, and (2) further the appreciation of jazz music throughout the nation. The Smithsonian Institution shall (1) record interviews with leading jazz artists; (2) acquire, preserve, and interpret jazz artifacts; (3) continue to recognize Jazz Appreciation Month; (4) establish collaborative agreements for the sharing of such artifacts; and (5) encourage, consult with, and engage in capacity building with community-based and regional organizations with the potential to establish jazz archival collections. The bill amends the Elementary and Secondary Education Act of 1965 to allow the use of certain funds for programs to promote jazz education, which may include (1) a Jazz Artists in the Schools program, (2) a program for the development and distribution of educational materials about jazz and teacher training on jazz education, and (3) an Ambassadors of Jazz program. The Smithsonian Institution shall establish a series of jazz performances at Smithsonian affiliates that provides broad geographic access to jazz and supports public appreciation for the diversity of jazz music.

Terminate TikTok on Campus Act of 2023 This bill prohibits an institution of higher education (IHE) from receiving federal funds unless the IHE takes certain actions to ban the use of the social media video application TikTok. Specifically, the IHE must develop and implement standards and guidelines (1) prohibiting the use of TikTok on electronic devices owned or issued by the IHE, and (2) requiring the removal of TikTok from these devices. The bill includes an exception for research that (1) is conducted, supervised, or authorized by an IHE's faculty; and (2) pertains to national security, law enforcement, telecommunications, or cybersecurity.

World Deserves To Know Act This bill requires sanctions on certain members of the Chinese Communist Party (CCP) and officials of Chinese health agencies. It also addresses related issues. The President must impose visa- and property-blocking sanctions on any foreign person who is a CCP official and who is knowingly responsible for or complicit in (1) the disappearances of whistleblowers and citizen journalists in China relating to COVID-19, or (2) limiting free speech and academic freedom in China relating to COVID-19. The President must also impose such sanctions on specified individuals who have leadership positions in China's Center for Disease Control and Prevention and China's National Health Commission (NHC). The authority to impose such sanctions shall end when the President certifies to Congress that an independent and unimpeded investigation into the potential origin of COVID-19 from the Wuhan Institute of Virology has taken place. The bill also bars federal funds and certain federal student assistance from going to institutions of higher education that enter into a contract with any element or China-based affiliate of the NHC. Federal funding to the National Academy of Sciences may not be used to enter into a contract with any element or China-based affiliate of the NHC. The Government Accountability Office must report to Congress a review of all funds that the National Institutes of Health have made available to the NHC since FY2010. This report must also be publicly available.
