18	18	To amend titles 10 and 38, United States Code, to improve
19	19	benefits and services for surviving spouses, and for other
20	20	purposes.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. SHORT TITLE. 3
24	24	This Act may be cited as the ‘‘Love Lives On Act 4
25	25	of 2025’’. 5

33	33	Section 103(d) of title 38, United States Code, is 5
34	34	amended— 6
35	35	(1) in paragraph (2)(B)— 7
36	36	(A) by inserting ‘‘(i)’’ before ‘‘The remar-8
37	37	riage’’; 9
38	38	(B) in clause (i), as designated by subpara-10
39	39	graph (A), by striking ‘‘Notwithstanding the 11
40	40	previous sentence’’ and inserting the following: 12
41	41	‘‘(ii) Notwithstanding clause (i)’’; and 13
42	42	(C) by adding at the end the following new 14
43	43	clause: 15
44	44	‘‘(iii) Notwithstanding clause (ii), the remarriage of 16
45	45	a surviving spouse shall not bar the furnishing of benefits 17
46	46	under section 1311 or 1562 of this title to the surviving 18
47	47	spouse of a veteran.’’; and 19
48	48	(2) in paragraph (5)— 20
49	49	(A) by striking subparagraph (A); and 21
50	50	(B) by renumbering subparagraphs (B) 22
51	51	through (E) as subparagraphs (A) through (D), 23
52	52	respectively. 24

59	59	Section 1450(b)(2) of title 10, United States Code, 4
60	60	is amended— 5
61	61	(1) by striking ‘‘An annuity’’ and inserting the 6
62	62	following: 7
63	63	‘‘(A) I
64	64	N GENERAL.—(A) Subject to sub-8
65	65	paragraph (B), an annuity’’; and 9
66	66	(2) by adding at the end the following new sub-10
67	67	paragraph: 11
68	68	‘‘(B) T
69	69	REATMENT OF SURVIVORS OF MEM -12
70	70	BERS WHO DIE ON ACTIVE DUTY .—The Sec-13
71	71	retary may not terminate payment of an annu-14
72	72	ity for a surviving spouse described in subpara-15
73	73	graph (A) or (B) of section 1448(d)(1) solely 16
74	74	because that surviving spouse remarries. In the 17
75	75	case of a surviving spouse who remarried before 18
76	76	reaching age 55 and before the date of the en-19
77	77	actment of Love Lives On Act of 2025, the Sec-20
78	78	retary shall resume payment of the annuity to 21
79	79	that surviving spouse— 22
80	80	‘‘(i) except as provided by clause (ii), 23
81	81	for each month that begins on or after the 24
82	82	date that is one year after such date of en-25
83	83	actment; or 26

88	88	month beginning after such date of enact-2
89	89	ment, in the case of a surviving spouse 3
90	90	who elected to transfer payment of that 4
91	91	annuity to a surviving child or children 5
92	92	under the provisions of section 6
93	93	1448(d)(2)(B) of title 10, United States 7
94	94	Code, as in effect on December 31, 2019.’’. 8
95	95	SEC. 4. EXPANSION OF DEFINITION OF DEPENDENT UNDER 9
96	96	TRICARE PROGRAM TO INCLUDE A REMAR-10
97	97	RIED WIDOW OR WIDOWER WHOSE SUBSE-11
98	98	QUENT MARRIAGE HAS ENDED. 12
99	99	Section 1072(2) of title 10, United States Code, is 13
100	100	amended— 14
101	101	(1) in subparagraph (H), by striking ‘‘; and’’ 15
102	102	and inserting a semicolon; 16
103	103	(2) in subparagraph (I)(v), by striking the pe-17
104	104	riod at the end and inserting ‘‘; and’’; and 18
105	105	(3) by adding at the end the following new sub-19
106	106	paragraph: 20
107	107	‘‘(J) a remarried widow or widower whose 21
108	108	subsequent marriage has ended due to death, 22
109	109	divorce, or annulment.’’. 23
