5252 tives of the United States of America in Congress assembled, 2
5353 SECTION 1. SHORT TITLE. 3
5454 This Act may be cited as the ‘‘Antisemitism Aware-4
5555 ness Act of 2025’’. 5
5656 SEC. 2. SENSE OF CONGRESS. 6
5757 It is the sense of Congress that— 7
5858 (1) title VI of the Civil Rights Act of 1964 (42 8
5959 U.S.C. 2000d et seq.), prohibits discrimination on 9
6060 the basis of race, color, and national origin in pro-10
6161 grams and activities receiving Federal financial as-11
6262 sistance; 12
6363 (2) while such title does not cover discrimina-13
6464 tion based solely on religion, individuals who face 14
6565 discrimination based on actual or perceived shared 15
6666 ancestry or ethnic characteristics do not lose protec-16
6767 tion under such title for also being members of a 17
6868 group that share a common religion; 18
6969 (3) discrimination against Jews may give rise to 19
7070 a violation of such title when the discrimination is 20
7171 based on race, color, or national origin, which can 21
7272 include discrimination based on actual or perceived 22
7373 shared ancestry or ethnic characteristics; 23
7474 (4) it is the policy of the United States to en-24
7575 force such title against prohibited forms of discrimi-25

7979 nation rooted in antisemitism as vigorously as 1
8080 against all other forms of discrimination prohibited 2
8181 by such title; and 3
8282 (5) as noted in the U.S. National Strategy to 4
8383 Counter Antisemitism issued by the White House on 5
8484 May 25, 2023, it is critical to— 6
8585 (A) increase awareness and understanding 7
8686 of antisemitism, including its threat to America; 8
8787 (B) improve safety and security for Jewish 9
8888 communities; 10
8989 (C) reverse the normalization of anti-11
9090 semitism and counter antisemitic discrimina-12
9191 tion; and 13
9292 (D) expand communication and collabora-14
9393 tion between communities. 15
9494 SEC. 3. FINDINGS. 16
9595 Congress finds the following: 17
9696 (1) Antisemitism is on the rise in the United 18
9797 States and is impacting Jewish students in K–12 19
9898 schools, colleges, and universities. 20
9999 (2) The International Holocaust Remembrance 21
100100 Alliance (referred to in this Act as the ‘‘IHRA’’) 22
101101 Working Definition of Antisemitism is a vital tool 23
102102 which helps individuals understand and identify the 24
103103 various manifestations of antisemitism. 25

107107 (3) On December 11, 2019, Executive Order 1
108108 13899 extended protections against discrimination 2
109109 under the Civil Rights Act of 1964 to individuals 3
110110 subjected to antisemitism on college and university 4
111111 campuses and tasked Federal agencies to consider 5
112112 the IHRA Working Definition of Antisemitism when 6
113113 enforcing title VI of such Act. 7
114114 (4) Since 2018, the Department of Education 8
115115 has used the IHRA Working Definition of Anti-9
116116 semitism when investigating violations of that title 10
117117 VI. 11
118118 (5) The use of alternative definitions of anti-12
119119 semitism impairs enforcement efforts by adding mul-13
120120 tiple standards and may fail to identify many of the 14
121121 modern manifestations of antisemitism. 15
122122 (6) The White House released the first-ever 16
123123 United States National Strategy to Counter Anti-17
124124 semitism on May 25, 2023, making clear that the 18
125125 fight against this hate is a national, bipartisan pri-19
126126 ority that must be successfully conducted through a 20
127127 whole-of-government-and-society approach. 21
128128 SEC. 4. DEFINITIONS. 22
129129 For purposes of this Act, the term ‘‘definition of anti-23
130130 semitism’’— 24

134134 (1) means the definition of antisemitism adopt-1
135135 ed on May 26, 2016, by the IHRA, of which the 2
136136 United States is a member, which definition has 3
137137 been adopted by the Department of State; and 4
138138 (2) includes the ‘‘[c]ontemporary examples of 5
139139 antisemitism’’ identified in the IHRA definition. 6
140140 SEC. 5. RULE OF CONSTRUCTION FOR TITLE VI OF THE 7
141141 CIVIL RIGHTS ACT OF 1964. 8
142142 In reviewing, investigating, or deciding whether there 9
143143 has been a violation of title VI of the Civil Rights Act 10
144144 of 1964 (42 U.S.C. 2000d et seq.) on the basis of race, 11
145145 color, or national origin, based on an individual’s actual 12
146146 or perceived shared Jewish ancestry or Jewish ethnic char-13
147147 acteristics, the Department of Education shall take into 14
148148 consideration the definition of antisemitism as part of the 15
149149 Department’s assessment of whether the practice was mo-16
150150 tivated by antisemitic intent. 17
151151 SEC. 6. OTHER RULES OF CONSTRUCTION. 18

153153 ENERALRULE OFCONSTRUCTION.—Nothing in 19
154154 this Act shall be construed— 20
155155 (1) to expand the authority of the Secretary of 21
156156 Education; 22
157157 (2) to alter the standards pursuant to which the 23
158158 Department of Education makes a determination 24

164164 (3) to diminish or infringe upon the rights pro-3
165165 tected under any other provision of law that is in ef-4
166166 fect as of the date of enactment of this Act. 5

168168 ONSTITUTIONAL PROTECTIONS.—Nothing in 6
169169 this Act shall be construed to diminish or infringe upon 7
170170 any right protected under the First Amendment to the 8
171171 Constitution of the United States. 9
